HomeMy WebLinkAboutItem 06.kFebruary 28, 2014 Item No. AUTHORIZATION OF DISTRIBUTION AND PUBLISHED NOTICE OF THE DRAFT FIRST PARK LAKEVILLE ALTERNATIVE URBAN AREAWIDE REVIEW UPDATE March 3, 2014 City Council Meeting Proposed Action Staff recommends adoption of the following motion: Move to authorize the distribution and published notice of the Draft Update of First Park Lakeville Alternative Urban Areawide Review (AUAR for the site located at the southeast corner of Dodd Blvd. and CSAH 70. Passage of this motion will result in the distribution of the draft AUAR Update for the proposed First Park Development to the required review agencies and any citizens requesting a copy and publication in the Environmental Quality Board (EQB) Monitor. Review agencies will have 10 days in which to comment after it has been published in the EQB Monitor on March 17th. Overview A final Alternative Urban Areawide Review (AUAR) was approved for this 140 acre industrial development in April of 2008. This type of environmental review was required under MN Rules because of the size of the overall development. The 2013 Update is required by Minnesota Rules because more than five years have passed since the City adopted the original AUAR and Mitigation Plan and the site has not yet been fully developed. Trammel Crow Company is the current developer of First Park and their master plan for the development of the remaining land is consistent with the 2008 approvals in terms of building square footage, land use and off -site improvements. The City is the Responsible Government Unit (RGU) in the preparation of the proposed AUAR Update. City staff and staff at WSB Engineering and SRF have coordinated with Trammel Crow's consultant, Westwood on the preparation of the Draft AUAR Update. A copy of the complete AUAR is included in the Council's electronic packet. Staff recommends that the Council move to authorize the distribution and publication of the AUAR Update. Primary Issues to Consider Is the proposed development of this property consistent with the original approved AUAR? The type of development being proposed is consistent with the original AUAR. Future Environmental Concerns or Impacts not Anticipated in the AUAR and Mitigation Plan.. 10 2013 Updated Mitigation Plan For Alternative Urban Areawide Review First Park Lakeville - Lakeville, Minnesota This 2013 Updated Mitigation Plan is a component of the 2013 Updated Alternative Urban Areawide Review (AUAR), prepared by the City of Lakeville, Minnesota, for the First Park Lakeville to be developed by the Trammell Crow Company. The 2013 Update identifies the impacts anticipated to result from the full development planned for the 140+ acre geographic area covered by the AUAR. This Updated Mitigation Plan identifies the mitigation measures that will be followed by the City and/or other responsible parties to avoid or mitigate potential environmental impacts. The Updated Mitigation Plan was prepared in accordance with Environmental Quality Board Environmental Review Program Rules and the Environmental Quality Board memorandum entitled, Recommended Content and Format - Alternative Urban Areawide Review Documents. The original 2008 AUAR determined that the following development- related impacts required implementation of mitigation measures to avoid or mitigate potential environmental impacts: • traffic; • impact on infrastructure and public services; • additional mitigation measures. Section III of this Mitigation Plan summarizes the updated potential environmental impacts and the mitigation measures proposed to be implemented to avoid, minimize or compensate for each of the above development - related impacts. Section III also includes information concerning the agency or agencies involved in review, approval or implementation of specific mitigation measures; the timeframes for implementing mitigation measures; and the party or parties financially responsible for implementing mitigation measures. The City of Lakeville is the Responsible Governmental Unit (RGU) for preparing and adopting the 2013 Updated AUAR and Updated Mitigation Plan. The City of Lakeville is also the governmental unit with the greatest responsibility for supervising or approving development within the geographic area of the AUAR. The City's review and approval of the Developer's AUAR plan, site plans, preliminary and final plats, building permits and grading permits is the primary local government mechanism for ensuring compliance with the mitigation measures identified in this Mitigation Plan. City approval of development plans for the First Park Lakeville site also involves reaching agreement with the Trammell Crow Company or its successors to ensure the detailed site development plans conform to the Updated AUAR and Updated Mitigation Plan. Attachment A - Final Mitigation Plan -R0001 957 City of Lakeville First Park Lakeville November 8th, 2013 Page 2 of 1 1 The Updated AUAR also identifies other units of government that are likely to have plan review or permit authority over the development proposed for the study area. These agencies include: Vermillion River Watershed Joint Powers Organization (VRWJPO); Minnesota Department of Transportation (MnDOT); Minnesota Department of Natural Resources (DNR); Minnesota Pollution Control Agency (MPCA); Metropolitan Council Environmental Services (MCES); Minnesota Department of Health (MDH) and Dakota County. In most cases, responsibility for obtaining required permits and approvals and for implementing mitigation measures specified as conditions to such permits and approvals lies with the Trammell Crow Company for the First Park Lakeville site. Based on applicable Environmental Quality Board guidelines for preparation of an AUAR mitigation plan, this section provides the following information for each area of potential environmental impact identified in the AUAR: (1) summary of potential impacts; (2) planned mitigation measures; (3) governmental programs that regulate mitigation plan preparation and compliance; (4) timeframes for implementing mitigation measures; and (5) identification of party or parties with financial responsibility for implementing mitigation measures. 1.0 TRAFFIC 1.1 Summary of Impacts A Traffic Impact Study has been conducted to update potential transportation impacts associated with the development of the First Park Lakeville AUAR site in the City of Lakeville, Dakota County, Minnesota. This 2013 AUAR Update carries forward the alternative urban Areawide review originally completed for this site in 2008. The following discussion summarizes the local and regional impacts and potential mitigation strategies identified in the study. The full Traffic Impact Study has been included as Attachment C of the 2013 AUAR Update document. Two design years were identified for study: 2018, corresponding to the year after potential build - out of the AUAR study area, and 2030 to coincide with Dakota County and MnDOT future planning efforts. The Traffic Impact Study focused on the impacts to the Interstate 35 and CSAH 70 Interchange, CSAH 70, 9 and 23 as well as the following intersections: ➢ CSAH 70 & Keokuk Avenue CSAH 70 & Interstate 35 Southbound Ramps ➢ CSAH 70 & Interstate 35 Northbound Ramps CSAH 70 & Kenrick Avenue ➢ CSAH 70 & Kensington Boulevard ➢ CSAH 70 & 215th Street West ➢ CSAH 70 & Jacquard Avenue ➢ CSAH 70 & CSAH 9 (Dodd Boulevard) 225th Street West & CSAH 9 ➢ 210th Street West & CSAH 9 ➢ CSAH 70 & Holyoke Avenue ➢ CSAH 70 & Hamburg Avenue ➢ CSAH 70 & CSAH 23 (Cedar Avenue) ➢ CSAH 9 (Dodd Avenue) and 217th Street ➢ CSAH 9 (Dodd Avenue) and 220th Street Attachment A - Final Mitigation Plan -R0001 957 City of Lakeville First Park Lakeville November 8th, 2013 Page 3 of 1 1 Full development of the AUAR site includes 139.5 -acres of general office and warehousing land uses. Two warehouse /light industrial uses have been constructed in the site since the previous AUAR. The remainder of the site is to be comprised of office and warehouse land uses. For the purposes of this study, it is anticipated that the AUAR Update site will be completed and fully occupied by 2017. The review of the traffic conditions includes an assessment of the No -Build conditions and Build conditions for the 2018 and 2030 design years. An estimate of infrastructure enhancements to accommodate each design scenario is detailed. The growth potential included in the No -Build conditions considered the development of potential properties in the study area along with an annual background growth rate, which are detailed further in the full Traffic Impact Study. Based on review of Dakota County's 2030 Transportation Plan and discussions with County staff, the following improvement on the roadway network can be expected as funding has been obtained and current plans for construction are underway: Reconstruction of CSAH 9 (Dodd Blvd) from CSH 46/2 in Scott County to CSAH 70 in Lakeville -- This project comprises the reconstruction of County Road 9 (Dodd Boulevard) from Scott County Road 2 to just south of County Road 70. County Road 9 will still be a 2- lane highway, but will have paved shoulders along the entire length and turn lanes or bypass lanes at intersections. Construction is scheduled to begin spring 2014. Roadway plans detailing the layout and geometry have been obtained from Dakota County and are incorporated in the 2018 No -Build Conditions. (Note that left and right turn lanes were already constructed as part of the construction of 217th Street, and the southbound left turn lane has already been constructed as part of 220th Street construction. The First Park property owner has already contributed funds toward the construction of the northbound right turn lane at 220th Street, with completion of that lane to occur with the overall CSAH 9 project construction in 2014.) 1.2 Improvement and Mitigation Measures By 2018, under the No -Build conditions, the roadway network cannot accommodate the increase in background traffic without improvements at many intersections. The following is a summary of the suggested improvements needed by 2020 to accommodate the growth in background traffic: The following roadway improvement is considered a County potential improvement or "need ". This potential improvement is not part of the current five -year Capital Improvement Project (CIP) as funding has not been identified, but the improvement may possibly be constructed by 2030. Widening of CSAH 70 -- The potential for widening of CSAH 70 just east of Kensington Boulevard to CSAH 23 from two -lanes undivided to four -lanes divided is on the future project agenda for Dakota County. Originally, preliminary design for this improvement was in the 2008 -2012 program, but has been postponed to some point in the future due to funding shortfalls and higher priority projects in the County. As volumes increase on CSAH 70 due to background growth, this project will become a higher priority. Attachment A - Final Mitigation Plan -R0001 957 City of Lakeville First Park Lakeville November 8th, 2013 Page 4 of 1 1 In the 2008 AUAR, it was reported that Dakota County had identified the potential need for future widening of CSAH 9 from CSAH 50 to the Lakeville /Eureka border. The County's 2030 Transportation Plan now indicates that the segment of CSAH 9 will not be a capacity deficiency in 2030. Therefore, the 2030 network has been adjusted to reflect a two -lane roadway with turn lanes at intersections for CSAH 9 south of CSAH 70. 2018 No -Build Scenario Operations of the 2018 No -Build PM Peak Hour roadway network are for the most part acceptable. For the PM peak hour, overall intersection and worst movement LOS is D or better and all 95th percentile queues are accommodated by the roadway geometry. The following details potential improvements for each intersection for consideration in future County need programming: ➢ CSAH 70 and Kensington Blvd. For the 2018 No Build PM Peak Hour Conditions, the CSAH 70 & Kensington left turn movement operates at LOS -E or —F in PM Peak Hour. These movements are improved to LOS -C if operation is changed to flashing yellow arrow. ➢ CSAH 70 and Hamburg In addition, the unsignalized intersection of CSAH 70 & Hamburg operates at LOS -d, with the eastbound movements operating at LOS-f. This intersection level of service improves to LOS -B if signalized, with each movement also improving to LOS -B or better. 2030 No -Build Scenario The capacity analysis of the 2030 No -Build roadway network has identified several unacceptable intersection operations. Many intersections experience LOS E or F with extensive 95th percentile queues. The following details potential improvements for each intersection for consideration in future County need programming: ➢ CSAH 70 and Keokuk (South of CSAH 70) Overall operations of this side - street (Keokuk) stop- controlled intersection are LOS A with failing minor movements. With construction of the north leg of this intersection connecting to the segment of Keokuk near of the theatres, combined with the land use development in these areas, will likely warrant signalization at CSAH 70 & Keokuk. Operation improves to LOS D or better for this intersection. ➢ CSAH 70 and 215th Street Overall operations of this side - street (215th Street) stop- controlled intersection are LOS A with failing minor movements. Due to minimal 95th percentile queuing there is no need for improvements at this intersection. ➢ CSAH 70 and Jacquard Avenue For the 2030 No Build conditions, a need has been identified for CSAH 70 to be improved to 4 -lanes divided from the Stepka Access to the existing roadway taper that is approximately 600 feet east of the Kensington Boulevard. Additionally, all turn lanes may need to be lengthened to 300 feet at this intersection. This capacity deficiency for Attachment A - Final Mitigation Plan -R0001 957 City of Lakeville First Park Lakeville November 8th, 2013 Page 5 of 1 1 CSAH 70 has been identified in the 2030 County Transportation Plan, and is listed as a highway expansion need to four lanes. ➢ CSAH 70 and Stepka Access Overall operations of this side - street ( Stepka Access) stop - controlled intersection are LOS A with failing minor movements. Due to minimal 95th percentile queuing there is no need for improvements at this intersection. ➢ CSAH 70 and CSAH 9 2030 Background forecast conditions suggest improvements may be needed in the form of dual eastbound left turn lanes with protected phasing to accommodate the high volume of PM peak hour eastbound left turns (169 vehicles). If the dual eastbound left turn lanes are provided, two northbound through lanes will be needed on the north leg of the intersection. The two northbound through lanes could be tapered down to one northbound lane starting approximately 500 feet north of the intersection. ➢ CSAH 9 and 210th Street West Operations of this all -way stop - controlled intersection are failing under the forecast 2030 No Build Conditions. Traffic control modifications, such as the installation of a traffic signal (the predicted 2030 No Build traffic volumes satisfy peak hour volume warrants), may be appropriate. ➢ CSAH 70 and Holyoke Avenue Overall operations of this side -street stop- controlled intersection are LOS A with failing minor movements with low volumes. Due to the low side -street volumes and short 95th percentile queue lengths, no needs (improvements) are recommended for this intersection. ➢ CSAH 70 and Hamburg Avenue Traffic control modifications are needed that this intersection. If warrants are satisfied by future traffic volumes, then a signal may be necessary. ➢ CSAH 70 and Cedar Avenue Traffic control modifications are needed that this intersection. The future alignment of this intersection is highly contingent on the future of CSAH 70 to the east of Cedar. If CSAH 70 extends to Farmington, as is ultimately envisioned, the traffic needs of this intersection will change significantly, as forecast traffic will also increase. In the interim, a redesign of the eastbound leg to exclusive left, shared left -thru and exclusive right lanes will improve intersection operation. 2018 Build Scenario Operations of the 2018 Build roadway network are acceptable. For the AM peak hour, overall intersection and worst movement LOS is D or better and all 95th percentile queues are accommodated by the roadway geometry. No mitigation measures are recommended for the 2018 Build Conditions. For the 2018 Build PM peak hour, all intersections operate at LOS -C or better, but there are some intersections that record movements that operate at LOS -E or —F. The two signalized intersections with Kenrick Avenue show left turn movements that operate at LOS -E, but each movement improves to LOS -C if operation is switched to flashing yellow arrow control. The Attachment A - Final Mitigation Plan -R0001 957 City of Lakeville First Park Lakeville November 8th, 2013 Page 6 of 1 1 three unsignalized intersections of CSAH 70 and 215th, Holyoke and Hamburg record movements of LOS -F due to the delay caused by stop sign control. The cross - street volumes are minimal at 215th and at Holyoke, so the predominant flow is on CSAH 70. These operations are acceptable as the side - streets are the minor movements and the 95th queuing is minimal. ➢ CSAH 70 & Hamburg Signal warrants are likely met, which would improve intersection operation to LOS -B /C. Eastbound left turn modification at CSAH 70 and Cedar would improve left turn operation to LOS -D or better. CSAH 9 and CSAH 70 at the proposed site accesses (217th Street, 220th Street onto CSAH 9 and Humboldt Road on CSAH 70) are included with the site design of the development and have been included in the analysis. Each operates at acceptable levels of service. 2030 Build Scenario Overall intersections operations of the 2030 Build roadway network are acceptable. For both the AM and the PM peak hours, overall intersection operation is LOS is D or better and all 95th percentile queues are accommodated by the roadway geometry. The minor movements at 215th Street, at the Stepka Access, and at Holyoke on CSAH 70 and 217th Street on CSAH 9 show failing side - street operations. These operations are acceptable as the side - streets are the minor movements and the 95th queuing is minimal. It is once again noted that the construction of right and left turn lanes on CSAH 9 and CSAH 70 at the proposed site accesses (217th Street and 220th Street on CSAH 9, and Humboldt Road on CSAH 70) are included with the site design of the development and have been included in the analysis. Operational analyses of the CSAH 70 /CSAH 9 intersection indicate there may be insufficient capacity to accommodate the anticipated demand. The mitigation measure of installation of an additional northbound left turn lane at the CSAH 70 /CSAH 9 signalized intersection is suggested to accommodate the increase in traffic estimated to make this left turn movement (219 vehicles). To accommodate the suggested dual northbound left turn lanes, CSAH 70 would need to be widened to four lanes from the Stepka Access to CSAH 9. Additionally, it is suggested that the dual eastbound and single westbound left turn lanes on CSAH 70 be lengthened to 350'. For the dual northbound turn lanes, 250' of storage is adequate with the predicted truck traffic. Similar to previous analyses, the site - street operations at the Stepka Access, 217th Street, 220th Street, Humboldt Road Access and Holyoke Avenue show failing operations. However, these are all minor movements and intersections operate acceptably with overall LOS A and minimal 95th percentile queues. These types of operations are typical for side - street stop controlled intersection with high priority /high volume roadways. 1.3 Implementation Information Reaulatory Proerams Related to Mitiaation Plan AUUroval and Mitiaation Plan Compliance Monitoring • City of Lakeville preliminary and final plat approval. • Dakota County site plan and plat approval. • MnDOT site plan approval. Financially ponsible Party/Parties The responsible parties for funding will be the developer for the mitigation discussed above. 2.0 IMPACT ON INFRASTRUCTURE AND PUBLIC SERVICES 2.1 Summary of Impacts Roadways will be impacted by traffic generated by the industrial developments within the project site and outside the project site as described in Section 1.2 Roadway Needs and Mitigation Measures. 2.2 Mitigation Measures Traffic mitigation measures are described in the traffic section of this Mitigation Plan. 2.3 Implementation Information Traffic implementation information is described in the traffic section of this Mitigation Plan. 3.0 ADDITIONAL MITIGATION MEASURES 3.1 Wetlands Where wetlands exist on the site, a natural vegetative buffer averaging 50 -foot (minimum 25- foot) is provided to preserve and protect the wetland. The wetland buffer also assists in stormwater management. 3.2 Stormwater Management The First Park Lakeville project proposes an integrated stormwater management system to provide runoff rate control, water quality, infiltration, and sediment removal consistent with City, and Watershed requirements. The development will also comply with the Minnesota Pollution Control Agency (MPCA) requirements for trout stream protection with respect to stormwater runoff, as required in the MPCA Construction Stormwater (CSW) Permit. Stormwater basins will be designed to provide total suspended solids and total phosphorous removal efficiencies to the maximum extent possible. Surface water runoff temperatures will be controlled by utilizing on -site infiltration and by designing a stormwater management system that will limit temperature increase thru vegetation shading, infiltration design, submerged outlet devices, and other acceptable measures. Attachment A - Final Mitigation Plan -R0001 957 City of Lakeville First Park Lakeville November 8th, 2013 Page 8 of 1 1 The development will meet the volume control requirements of the Watershed (Vermillion River Watershed Joint Powers Organization) of a no net increase in runoff volume for a 2 year 24 hour storm. This will be achieved by encouraging Best Management Practices such as infiltration / rain gardens, vegetative swales, infiltration basins; and where feasible, within private development, perforated storm sewer and porous pavement. The City will track, measure and document rate, volume, and water quality results by requiring said analysis from Developer for overall development and will reevaluate analysis as individual parcels are developed. This requirement will be met through the City of Lakeville's plat approval process. 3.3 Erosion Control A Stormwater Pollution Prevention Plan will be prepared, as required, as development occurs. During construction, erosion control measures will likely include silt fencing, rock checks, temporary seeding and mulching, temporary rock construction entrances, and slope stabilization/erosion control fabric. Permanent BMP's will include prompt sodding /seeding, mulching, and erosion control blanket of disturbed areas. Stormwater basins and outlet structures will be designed, graded and surfaced to minimize sediment transportation. The proposed stormwater basins will have adequate capacity to provide storage and sedimentation management for stormwater runoff during construction and from the entire fully developed site. 3.4 Noise Noise analysis is a "worst case" modeling of potential future noise levels. By "worst case ", it is meant that natural noise barriers (elevations, existing tree lines, berms, etc.) were not considered in the evaluation. The model demonstrates that any potential future noise impacts come predominately from proposed development on other sites in the area and from growth in traffic on adjacent roadways. Results of the noise analysis could be used as a factor to consider when planning the layout of future developments (i.e. locations of residential and commercial structures, noise mitigation features such as berms and tree lines, etc.). Noise analysis and modeling receptors were selected based on proximity to the selected intersections and known sensitive receptors (residential areas). The intersections were selected based on level of service and proximity to the project. Land use for selected receptors was based on current land use and proposed land use relative to the proposed development. Future land use has not been sufficiently defined in other undeveloped areas. The City will work with Dakota County to evaluate potential noise mitigation when CSAH 70 is upgraded in the future. Potential mitigation measures could include berming and planting as well as building placement. 3.5 Building/Lighting Restrictions The First Park Lakeville site is located west of property owned by the Metropolitan Airports Commission (MAC) and the Airlake Airport. A portion of the site is located within State Safety Zone B for the Airport. This safety zone limits construction activity within the zone. Height restrictions will apply to building heights and illumination to site lighting within the development. These restrictions are governed by City and State codes. However, as specific development plans are completed and more information becomes available, or as regulatory requirements change, environmental concerns or issues that differ from those addressed in the AUAR or Mitigation Plan may be identified. Also, new information concerning feasible and practicable mitigation measures may be developed after adoption of this Mitigation Plan. In these instances, development plans will be reviewed to identify measures to avoid or mitigate potential environmental impacts consistent with the new information, while maintaining the basic intent and process identified in this Mitigation Plan. As required by Environmental Quality Board regulations (Minn. Rules Pt. 4410.3610, subp. 7), the AUAR and the Mitigation Plan will be revised if any of the specific circumstances enumerated in state regulation apply.
