Acting Mayor Mulvihill called the meeting to order at 7:00 p.m. The pledge of allegiance to the flag was given. Roll call was taken. Present: Council Members Bellows, Mulvihill, Rieb and Luick. Absent: Mayor Johnson. Also present: R. Knutson, City Attorney; B. Erickson, City Administrator; K. Nelson,. City Engineer; D. Feller, Finance Director; S. Michaud, Parks & Recreation Director; D. Fr-iedges, City Clerk. • MINUTES The minutes of the January 7, 2002 City Council meeting were approved as presented. STAFF ANNOUNCEMENTS ATTORNEY: None ENGINEER: None ADMINISTRATOR: Mr. Erickson stated he would like to provide a brief overview of the presentation he made to the State Senate Property Tax Committee earlier today. He will address this matter under New Business. PARKS & RECREATION DIRECTOR: Mr. Michaud presented the December monthly report of the Parks & Recreation Department. Meals on Wheels Committee members Sandy Cross, Chuck Hadley, Tom Vucinovich, Helen Adrian and Jean. Kane. A plaque was also prepared for Michelle Volk, the Meals on Wheels Site Coordinator. Ms. Voik, Ms. Adrian and Ms. Kane were not in attendance. Their plaques will be delivered to them. Lakeville High School DECA members Erica Brettingen, Amy Jo Adelmann and Melissa Jo Mueller, along with their advisor, Mike Zweber, asked the City Council to proclaim the week of January 22-25 Free Enterprise Week in Lakeville. Council Member Bellows read the proclamation. Chief Martens presented a National Night Out Award to Crime Prevention Specialist Lori Clemmer. Ms. Clemmer has shepherded the National Night Out events in Lakeville since their inception. Chief Martens then introduced Officer Andy Bohlen, Lakeville • Police Department's senior officer on the Mutual Aid Assistance Group (MAAG), the county swat team. Officer Bohlen, along with other members of the MAAG, presented a plaque to Paul Anderson of Air Lake Truck Body and Paint, Mr. Anderson's firm painted the MAAG utility vehicle free of charge, saving the MAAG approximately $4,000. Acting Mayor Mulvihill presented a plaque recognizing former Planning Commission member Jerry Comer. Mr. Comer was not in attendance, and the plaque. wi l be delivered to him. Ayes, Bellows, Mulvihill, Rieb, Luick. ~` r CITY OF LAKEVILLE COUNCIL MEETING JANUARY 22, 2002 PAGE 5 • ITEM 8 City Attorney Roger Knutson presented a proposed ordinance amendment concerning the revocation or suspension of intoxicating liquor and 3.2% malt liquor. He explained that under State law, the City can. suspend a license for up to 60 days, impose a fine up to $2.,000 or revoke a license for statutory or ordinance violation by the license holder. The proposed ordinance provides presumptive penalties for specified violations. The penalties increase for second, third and fourth violations. Mr. Knutson explained that the purpose of having presumptive penalties is to ensure fairness and. consistency. The City Council has the right to deviate from the presumed penalty if circumstances warrant. Mr. Knutson went on to explain that when. a violation. is alleged, the license holder is entitled to a hearing before the City Council. For a first offense where the presumed penalty is a fine, the license holder is given the option of paying the fine and waiving • the right to a hearing. 02.12 Motion was made by Rieb, seconded by Bellows to adopt Ordinance No. 701 amending Title 3, Chapter 1 of the Lakeville .City Code concerning the revocation or suspension of licenses for the sale of intoxicating liquor or 3.2 percent malt Liquor. Roll call was taken on the motion. Ayes, Mulvihill, Rieb, Luick, Bellows. ITEM 9 Mr. Olson requested Council consideration of a resolution related to a study of mineral resource extraction in Empire Township. The resolution, which is consistent with the Council's discussion at its January 14t",work session., requests the Metropolitan Council fund a study to determine a staging and reclamation plan for the extraction of mineral resources in northern Empire .Township. He explained that the township recently identified several sites outside their Mineral Extraction Overlay District where extensive gravel mining operations may take place in the . .future. The extraction of these mineral resources will likely have a significant impact on surrounding communities and the }. r CITY OF LAKEVILLE COUNCIL MEETING JANUARY 22, 2002 PAGE 6 • environment. The resolution will be forwarded to the Metropolitan Council. 02.13 Motion by Bellows, seconded by Rieb to approve .Resolution No. 02-24 related to a study of mineral resource extraction in Empire Township. Roll call was taken on the motion. .Ayes, Rieb,. Luick, Bellows, Mulvihill. UNFINISHED BUSINESS None NEW BUSINESS Mr. Erickson provided an update of the proposed plan by the Governor to address the State's $1.95 billion shortfall and how it will impact the City's budget. The Governor's plan as it stands now, he explained, would force Lakeville to forfeit approximately $627,000 from the City's current budget. As a result, the City has implemented a temporary freeze on filling any new positions until the State . legislature adjourns and staff is assured that these positions can be funded. He stated he addressed the Senate Property Tax Committee this morning, pointing out the impacts that. the Governor's proposed state aid formula would have on the City of Lakeville.
