HomeMy WebLinkAboutItem 06.pApril 21, 2014 Item No. Extension of the On -Sale Liquor License for Teresa's Mexican Restaurant Proposed Action Staff recommends adoption of the following motion: Move to approve the extension of the On -Sale Liquor License for Teresa's Mexican Restaurant. Passage of this motion will result in Teresa's Mexican Restaurant extending their ability to sell liquor in a controlled access tent in the parking lot of their establishment for their annual Cinco de Mayo event which will be held on May 5th, 2014, from 3:00 PM to 10:00 PM. Overview Teresa's Mexican Restaurant has requested an extension of their liquor license to cover the sale of alcohol in their controlled access tent in the parking lot, as well as entertainment during their annual Cinco de Mayo event on May 5th, 2014. This is a family event open to persons of all ages, and it will have only one access point that will be controlled. A copy of the site plan is attached and the insurance certificate has been obtained. The site plan has been reviewed and security issues as well as entrance and exit issues have been explained and are covered. The police department has no objection to the extension of the liquor license, provided Teresa's Mexican Restaurant abides by the site plan and the stipulations listed on the attached list. Kevin Manias Financial Impact: $ Budgeted: Y/N Source: Related Documents (CIP, ERP, etc.): Notes: Stipulations Stipulations ➢ Teresa's Mexican Restaurant is planning Cinco de Mayo activities for both May 3rd and May 5th; however, the May 3rd event, which will run from 5:00 PM until their normal closing time of 11:00 PM, will be held entirely within the physical building occupied by Teresa's Restaurant. The tent to be used on May 5th will be erected on May 3rd; but there will be no outside alcohol sales during the May 3rd event. In addition, Teresa's Restaurant will hire private security for the event on May 3rd to ensure that alcoholic beverages are not taken out of the building by patrons. ➢ No amplification of music during the event on Monday, May 5th, except for the Karaoke segment which will be conducted from 4:00 PM to 6:00 PM. ➢ The tent will have only one point of access that will be controlled with adequate security and perimeter monitoring by Teresa's personnel. ➢ Persons consuming alcoholic beverages will be given wrist bands identifying them as over 21 after being properly identified. ➢ Teresa's Mexican Restaurant will hire two off-duty police officers for security for Monday, May 5th, from 3:00 PM until the event ends at 10:00 PM. ➢ Emergency exits and fire codes will be followed as prescribed by the Lakeville Fire Marshall. ➢ Portable toilets shall be available as noted on the site plan. ➢ All alcohol service will cease at 10:00 PM on May 5th, at which time Teresa's Mexican Restaurant will close for the night. ➢ The closing time shall be prominently displayed throughout so there is no confusion at the end of the evening when patrons are asked to leave. ➢ The Police Chief, Fire Chief, or their designee, has the ability to direct the event manager to control the level of noise and/or terminate the event at any time. ➢ Teresa's will work effectively with the Lakeville Police Department to minimize any parking or traffic problems created by the event. ➢ Teresa's will notify all area businesses in advance of the date, duration, and parking impacts of the event. ➢ Teresa's will provide evidence of liability coverage for the parking lot area to be used for the event. MEXICAN RESTAURANT April 7, 2014 Dear Lakeville City Council: Teresa's Mexican Restaurant is requesting your permission for our annual Cinco de Mayo celebration. This is to take place on Monday, May 5, 2014. We are requesting your approval for a tent that will be placed in the parking lot on the south side of the restaurant. We also are asking for an extension on our on -sale liquor license to allow the sale of alcoholic beverages in this fenced in area. Pending your approval the tent will be installed on the morning of May 3rd and will be removed the morning of May 6th. This event will begin at 3 in the afternoon with a live broadcast with local country station K102. Teresa's is planning on having a live acoustic performance by local country singer Chris Hawkey. His performance will be held from 6 p.m. to 8 p.m. This Cinco de Mayo event will conclude at 10 p.m. As directed by the Lakeville Fire Department, there will be two emergency exits and two fire extinguishers on hand. This is detailed on the submitted site plan. After speaking with the Lakeville Police Department, Teresa's has agreed to hire two off-duty officers for security. Teresa's will also have staff present at the main entrance of the restaurant checking identification and will provide those of age with wristbands to properly identify them. This is to assure compliance with state and local liquor laws. In conclusion, Teresa's would like to thank the Lakeville City Council for their time and attention.
