HomeMy WebLinkAboutItem 09 CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES April 10, 2014 Chair Lillehei called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The pledge of allegiance to the flag was given. 2. Swearing in of new Planning Commission Ex-officio Member Nic Stevens The Recording Secretary Penny Brevig swore Nic Stevens in as the new Planning Commission Ex-officio Member. Members Present: Linda Maguire, Vice Chair Bob Boerschel, Chair Brooks Lillehei, Jason Swenson, Karl Drotning, Ex-officio member Nic Stevens Members Absent: Paul Reuvers Others Present: Daryl Morey, Planning Director; Alex Jordan, Civil Engineer; and Penny Brevig, Recording Secretary 3. Approval of the Meeting Minutes The March 20, 2014 Planning Commission meeting minutes were approved as presented. The March 20, 2014 Planning Commission work session minutes were approved as presented. 4. Announcements Mr. Morey welcomed Nic Stevens as our new Ex-officio member. He also introduced Alex Jordan, Civil Engineer and indicated that Mr. Jordan will be attending some Planning Commission meetings. Mr. Morey stated that the following was handed out at tonight’s meeting: A. Draft minutes of the April 9, 2014 Parks, Recreation and Natural Resources Committee meeting regarding the Legacy preliminary plat. Mr. Morey stated that the May Planning Commission meetings are being considered to be shifted to May 8th and May 22nd to align with the May Parks, Recreation and Natural Resources and City Council meetings. Ms. Brevig will send out an e-mail to the Planning Commission members to check on availability. Planning Commission Meeting Minutes, April 10, 2014 Page 2 5. Legacy Chair Lillehei opened the public hearing to consider the application of D. R. Horton for a preliminary plat of 148 single family lots, located east of Holyoke Avenue and south of 195th Street. Ron Mullenbach from D.R. Horton presented a brief overview of their request. Mr. Mullenbach stated that they are requesting preliminary plat approval of 145 single family lots on the Sullivan/Zweber, Jacobson, and Roulliard properties located on the east side of Holyoke Avenue. Mr. Mullenbach indicated that they are working with the City regarding the relocation of Pond 5E to the southeast side of the wetland in Outlot B, just west of the proposed trail, to maximize the amount of usable park space and potential parking lot location. He stated that Kurt Quaintance, Civil Engineer with James R. Hill, and the subject property owners were also in attendance to answer questions. Planning Director Daryl Morey presented the planning report. Mr. Morey stated that the development consists of 145 single family lots, not 148 as stated in the public hearing notice. The site currently consists of three parcels, with two of the parcels including homes and outbuildings. Mr. Morey stated that all of the lots in the legacy preliminary plat meet the lot area, width and depth requirements of the RS-3 District. Mr. Morey stated that 195th Street will be extended through the Legacy development. The main access will be 197th Street at Holyoke Avenue and will align with 197th Street on the west side of Holyoke Avenue in the Donnelly Farm development. Mr. Morey indicated that 11 lots abutting Holyoke Avenue require increased buffer yard lot sizes and setbacks in the Legacy preliminary plat. He stated that a landscape plan was submitted with the Legacy preliminary plat that includes the required buffer yard screening. Mr. Morey stated that there are four outlots in the Legacy preliminary plat. Outlots A, B, and C will be deeded to the City and Outlot D will be retained by the developer for future residential development. He indicated that a future neighborhood park is proposed within Outlot B. Mr. Morey indicated that the Parks, Recreation and Natural Resources Committee reviewed the Legacy preliminary plat at their April 9, 2014 meeting and unanimously recommended approval. Mr. Morey stated that staff recommends approval of the Legacy preliminary plat, subject to the 14 stipulations listed in the April 3, 2014 planning report. Planning Commission Meeting Minutes, April 10, 2014 Page 3 Chair Lillehei opened the hearing to the public for comment. Robert Pond, 8534 195th Street Mr. Pond questioned whether the electrical and gas lines that are currently above ground and located in the rear yards of the homes that face 195th Street will be buried, and if so, by whom. Motion was made by Maguire, seconded by Boerschel to close the public hearing at 6:13 p.m. Ayes: Maguire, Boerschel, Lillehei, Swenson, Drotning. Nays: 0 Chair Lillehei asked the developer to respond to the public comment. Mr. Mullenbach stated that the overhead lines to the homes that front on 195th Street are just outside the Legacy preliminary plat boundaries, within the rear yards of these lots, and that without an easement they do not have a right to enter these properties. He indicated that he has had discussions with Dakota Electric and they indicated that there are electric and phone lines utilizing these poles. Mr. Mullenbach indicated that there are some challenges and cost with the process of burying the electric lines. The homes would need to be rewired and the pole where the line starts would still exist, but the lines between the poles would be underground. In addition, he indicated that Dakota Electric would prefer the lines be buried in the front yards of the homes for easier access. Chair Lillehei asked for comments from the Planning Commission. Discussion points included:  Commissioner Boerschel complimented the developer on the layout of the plat and stated he was glad to see a neighborhood park and trail access to the park proposed with this preliminary plat. Chair Lillehei allowed more public comment prior to the Planning Commission making their recommendation: Terry Schreiner, 8490 195th Street Mr. Schreiner indicated quite a few problems with the Crescent Ridge development to the north of Legacy, such as water build up and blowing debris. He felt the City was not very responsive at times to addressing these issues. Mr. Schreiner asked about the grading and slope onto the Legacy property. He also asked about Outlot D and why the developer is retaining it when it is such a small parcel. Planning Commission Meeting Minutes, April 10, 2014 Page 4 Kurt Quaintance, Civil Engineer with James R. Hill Engineering, pointed out the location Mr. Schreiner was referring to, which is the existing platted right-of-way that D.R. Horton does not control and, as such, is not part of the Legacy preliminary plat. Mr. Quaintance indicated that the proposed grades will slope down from the rear lot lines of the existing single family homes fronting 195 th Street to the homes to be constructed on the north side of the Legacy preliminary plat at a maximum 3:1 slope. The proposed grades east of the referenced right-of-way will match into the existing grades. Mr. Mullenbach identified the exact location of Outlot D. He stated that Outlot D is intended to be combined with the property to the north as part of a possible future redevelopment. He stated that when the Crescent Ridge development was proposed, a decision was made at that time not to construct a roadway utilizing the existing right-of-way adjacent to Mr. Schreiner’s home. W ith the Legacy preliminary plat, Mr. Mullenbach stated they are proposing to shift Highview Avenue to the east so that in the future when it is extended to the north it will be adequately spaced from the Holyoke Avenue/190th Street intersection. Mr. Mullenbach indicated that Mr. Schreiner could request the existing right-of-way be vacated since it is no longer needed. Motion was made by Drotning, seconded by Maguire to recommend to City Council approval of the Legacy preliminary plat, subject to the following stipulations: 1. Implementation of the recommendations listed in the April 3, 2014 engineering report. 2. The recommendation of the Parks, Recreation, and Natural Resources Committee. 3. All houses shall meet the following minimum setback requirements of the RS-3 District: Front yard – 30 feet Side Yards: Rear Yard – 30 feet Interior – 10 feet Buffer Yard – 50 feet Corner – 20 feet Buffer – 30 feet 4. All new local utilities and any existing overhead service utilities located on the property shall be placed underground. 5. Park dedication shall be satisfied with a combination of land dedication and cash contribution paid with the final plat. 6. The developer shall construct 5 foot wide concrete sidewalks along one side of all streets except Highview Avenue, which shall have a sidewalk on both sides of the street. The developer shall construct a 10 foot wide bituminous trail from the Highview Avenue cul-de-sac to existing Highview Avenue at the south property line of the development. The devel oper shall submit a cash escrow with the final plat for future trail construction on the east side of Holyoke Avenue. 7. The removal of all structures on the site shall require a demolition permit from the City prior to removal. Planning Commission Meeting Minutes, April 10, 2014 Page 5 8. The existing wells within the plat area shall be abandoned in compliance with state and local requirements. 9. Outlots A, B, and C shall be deeded to the City with the final plat. 10. Buffer yard landscaping shall be installed according to the approved landscape plan. A security for the buff er yard landscaping shall be submitted with the final plat. 11. On Lot 1, Block 6, the landscape plan indicates an Austrian Pine that is shown to be located right above a storm sewer pipe that runs from 197 th Street to a pond in Outlot A. The tree location mu st be shifted to avoid a conflict with that pipe. 12. Any subdivision signs that are not maintenance-free must be located within an outlot owned and maintained by a homeowner’s association. 13. The developer shall install a “Future Street Extension” sign at the terminus of Highview Avenue, Holdingford Way, and Henning Avenue. 14. Temporary turnarounds are required at the north end of Highview Avenue and the east end of Henning Avenue. Ayes: Boerschel, Lillehei, Swenson, Drotning, Maguire. Landscape Notes: 1. Tree saucer mulch to be four inches (4") depth natural single-shred hardwood bark for trees outside of a plant bed. Install per tree planting detail. 2. Refer to civil plan sheets for grading, drainage, site dimensions, survey, tree removal, proposed utilities & erosion control. 3. All plant material shall comply with the latest edition of the American Standard for Nursery, American Association of Nurserymen. Unless noted otherwise, deciduous shrubs shall have at least 5 canes at the specified shrub height. Plant material shall be delivered as specified. 4. Plan takes precedence over plant schedule if discrepancies in quantities exist and all proposed plants shall be located and staked as shown. 5. Trees required for individual single family lots will be provided by the building contractor once the home has been built. Planting per City of Lakeville requirements. 6. Adjustment in location of proposed plant material may be needed in field. Should an adjustment be required, the client will provide field approval. Significant changes may require city review and approval. 7. The project landscape contractor shall be held responsible for watering and properly handling all plant materials brought on the site both before and after installation. Schedule plant deliveries to coincide with expected installation time within 36 hours. Plan to water trees no less than 1" per week by truck or at the trunk with Tree Gator bags, furnished and maintained by the landscape contractor for 1 full growing season. 8. All plant materials shall be fertilized upon installation as specified. 9. If the landscape contractor is concerned or perceives any deficiencies in the plant selections, soil conditions, drainage or any other site condition that might negatively affect plant establishment, survival or guarantee, they must bring these deficiences to the attention of the landscape architect & client prior to bid submission. 10. Contractor is responsible for ongoing maintenance of all newly installed material until time of owner acceptance. Any acts of vandalism or damage which may occur prior to owner acceptance shall be the responsibility of the contractor. Contractor shall provide the owner with a maintenance program including, but not limited to, pruning, fertilization and disease/pest control. 11. The contractor shall guarantee newly planted material through one calendar year from the date of written owner acceptance. Plants that exhibit more than 10% die-back damage shall be replaced at no additional cost to the owner. The contractor shall also provide adequate tree wrap and deer/rodent protection measures for the plantings during the warranty period. 12. The landscape contractor shall be responsible for obtaining any permits and coordinating inspections as required throughout the work process. 13. Plant size & species substitutions must be approved in writing prior to acceptance in the field. 14. Landscape Contractor is responsible for coordination with the General Contractor, to protect the new improvements on and off-site during landscape work activities. Report any damage to the General Contractor immediately. 15. The landscape contractor shall contact Gopher State One Call no less than 48 hours before digging for field utility locations. 16. The landscape contractor shall be responsible for the removal of erosion control measures once vegetation has been established to the satisfaction of the municipal staff. This includes silt curtain fencing and sediment logs placed in the landscape. Notify the Owner and General Contractor if erosion control needs to be adjusted based upon plant locations shown on this plan. 17. Trees planted on front-sides of houses shall be field located once the driveway locations are know for each dwelling. Keep newly planted trees no less than 10' from the side property line. 18.
