FOR THE NORTH CREEK GREENWAY TRAIL
Proposed Action
Staff recommends adoption of the following motion: Move to approve agreement with WSB &
Associates Inc. for preliminary and final design services for the North Creek Greenway Trail.
Overview
City Council reviewed advancing the North Creek Greenway Trail project at the April 28, 2014 City
Council work session. As stated at the work session, approving the attached WSB agreement would
authorize preliminary and final design plans in an amount not to exceed $100,000 in 2014 without
prior written consent from the City. Requests for additional funding would only be needed if the City
Council decides to move forward with the project following the review of the design and engineer
estimates. If needed, the additional funds would be used to keep the project moving forward to
obtain our goal of bidding the project no later than mid-February.
Staff is therefore recommending City Council consider approving the attached agreement with WSB
to complete the preliminary and final design services for construction of the North Creek Greenway
Trail Project. If City Council has any questions prior to the meeting, please do not hesitate to contact
me.

Dear Mr. Altergott:
WSB & Associates, Inc. (WSB) appreciates the opportunity to present this proposal for
professional engineering services relating to the improvements proposed for the North Creek
Greenway Trail for the City of Lakeville and Dakota County. This letter proposal outlines the
engineering services required to prepare a preliminary design study, as well as final design and
construction documents for the North Creek Greenway Trail from 173rd Street to the City of
Lakeville's south City limits.
BACKCROUND
The Dakota County master plan for the North Creek Greenway provides 14 -miles of trail
traveling through Eagan, Apple Valley, Lakeville, Farmington and Empire Township in central
Dakota County. The greenway will interconnect important regional destinations including
Lebanon Hills Regional Park, the Minnesota Zoo, downtown Farmington, the Vermillion River
and the new regional park in Empire Township. The new North Creek Greenway trail segment
in Lakeville will constitute approximately 0.9 -miles of the ultimate 14 -mile North Creek
Greenway design, and will be located between 173rd Street and Lakeville's south City limits
leading into Farmington, east of Pilot Knob Road. Construction of the trail will require a
crossing over the North Creek drainage channel, which is identified as a Water of the State and
will require Minnesota DNR approval.
In 2011, the City of Lakeville and Dakota County jointly submitted a grant application for
Transportation Enhancement (TE) funds through the Transportation Advisory Board (TAB) of
the Metropolitan Council. The City and County were awarded $899,410 in TE funds for
construction, and City and Council CIP budgets for the project were established using the
construction cost estimates produced in 2011.
Because the costs to construct the crossing over the North Creek drainage channel are still
largely unknown, a preliminary design study is proposed to develop the preliminary design,
associated costs, topographic conditions, wetland impacts, and floodplain impacts that must be

addressed to complete the project. This preliminary design study will be used to complete final
design of the project and a more detailed estimate the construction costs associated with the
project, so that the City can make a decision as to whether or not to move forward with
construction of the project in 2015.
PROJECT UNDERSTANDING
The project consists of approximately 0.9 -miles of new greenway construction extending from
the existing trail at 173a Street to the southerly City of Lakeville limits, where the trail will enter
into the City of Farmington. The trail is proposed to be 10 -foot wide bituminous with 2 -foot
clear zones on each side. The pavement section will consist of 3 -inches of bituminous over 5 -
inches of class 5 aggregate. The trail design must meet federal requirements.
The City of Lakeville desires to determine the exact location of the trail so that Dakota County
can acquire the necessary easements from adjacent property owners in order to construct the
trail. For this reason, many considerations such as wetland delineations, floodplain impacts,
topographic survey of existing conditions, cost estimating, preliminary design and the federally -
required project memorandum are included in the preparation of the preliminary design study. It
should be noted that these are all required elements of the project to get to final design. This is
not an effort that delays the project or increases costs, but is a process that evaluates project
needs.
At the trail crossing over the North Creek drainage channel, WSB will seek to design a new
pedestrian/bicycle bridge that will minimize both the flood stage impacts and construction costs
associated with the bridge. At this time, the preferred crossing is located south and east of the
existing North Creek drainage channel weir.
The original TE grant application also identified construction of a new trailhead facility adjacent
to an existing segment of the North Creek Greenway Trail within East Community Park. The
trailhead building will include parking, permanent restrooms, drinking water and benches.
Design and construction of this building will be completed by the City under a separate contract.
PRELIMINARY DESIGN/SCOPE OF SERVICES
WSB's project scope and proposed work plan are based on our understanding of the project as
previously discussed. In order to complete the project, we propose the following scope of
services:
1. Project Management
Project management is a key task included in each phase of the project. In each case, this
task consists of management, administration, project coordination, and communication with
the City of Lakeville, Dakota County and WSB personnel. Additional work included in this
task involves attendance at progress meetings with City Staff and Dakota County during
preliminary design (3 meetings). Proper completion of this task will allow for open lines of
communication and routine updates on project issues, as well as keeping the project on
schedule and within budget.

2. Preliminary Design
The preliminary design will provide a guide for final design of the project, including a
proposed trail location and creek crossing that will minimize both the impacts to the
surrounding area and the construction costs associated with the new bridge. The preliminary
design will include a discussion of the existing conditions, proposed improvements, probable
project costs, easement needs, wetland impacts and floodplain impacts. Proposed
improvements will be shown on preliminary drawings using aerial background drawings and
will include trail alignment, wetland and floodplain impacts. The preliminary design will
also include a discussion with Staff regarding the recommended improvements, an opinion of
cost, project exhibits, and easement requirements.
2.1 Preliminary Topographic Survey
A topographic survey is proposed to be completed in order to clearly identify existing
conditions. This will allow WSB Staff to prepare accurate preliminary design,
estimation of quantities, and costs. Survey control will be established with GPS. The
survey datum will be on the Dakota County Coordinate System. The topographic
survey will include cross sections every 50 -feet for the length of the project. The
cross sections will be to a minimum width of 50 -feet on each side of centerline for a
total width of 100 -feet or wider in areas based on preliminary construction limits.
The topographic survey will also include locating municipal utilities, private utilities,
property irons needed for parcel base mapping and wetland delineations.
WSB anticipates that the City/County will obtain the necessary permissions from
private property owners to complete the necessary topographic survey work within
the project corridor.
2.2 Wetland Delineation
Wetlands exist within and adjacent to the 0.9 -mile project corridor; therefore, a
wetland delineation must be conducted during the 2014 growing season and
submitted to the City of Lakeville for approval (30-60 days). The wetland delineation
will be conducted within a 30 -foot corridor of the final trail alignment. Delineation
methodologies will conform to the Midwest Regional Supplement of the Corps of
Engineers Wetland Delineation Manual (US Army Corps of Engineers, August 2010).
The wetland delineation report will be prepared and submitted to the City of
Lakeville (Local Government Unit-LGU), Technical Evaluation Panel (TEP), U.S.
Fish & Wildlife Service, and US Army Corps of Engineers for their review and
approval. The location of delineation flags will be imported into the project design
and used to generate a wetland delineation map. This task also includes one pre -
application agency meeting to field review the delineation (if requested by the LGU),
present preliminary impacts, and discuss sequencing alternatives and mitigation
options. A wetland delineation report will allow for the accurate estimation of
wetland impacts and costs associated with them.
2.3 Preliminary Design
Using the preliminary topographic survey, contour maps, site visits, and wetland
inventory maps and delineations, a preliminary alignment and profile of the proposed
greenway will be developed. Extensive discussions with the City and County will be

necessary to adequately locate the trail and to facilitate acquisition of the necessary
easements. Consideration must to be given to construction of the trail within the
North Creek floodway, and the fact that portions of the trail may be submerged for
periods following snowmelt or heavy rainfall events. Federal trail design standards
will need to be implemented while also meeting the constraints of portions of the
corridor. Under this task, preliminary cross sections will be prepared for the
estimation of floodplain and wetland fill.
Starting on the north end of the trail segment, the preliminary design will look at
connecting the existing trail at 173rd Street, and following the west bank of the north
tributary to the North Creek drainage channel through the properties owned by Mr.
Mikell Smith. It is proposed that the trail would cross the drainage channel south and
east of the existing weir location, and then continue along the south and west banks of
the North Creek drainage channel, through the properties owned by the City of Apple
Valley and KJ Walk, Inc. It is our understanding that the City of Lakeville will work
with KJ Walk, Inc. to obtain the necessary easements/outlots to facilitate construction
of the trail within that property as a part of the plat application process currently
under review at the City.
2.4 Storm Water Management
The storm water management plan for the North Creek Greenway will involve water
quality treatment and floodplain evaluation. The preliminary design will identify the
required permits and regulations. As part of the preliminary design, a single meeting
with the regulatory agencies will be held. These agencies include MnDNR, ALOE,
the Vermillion River Watershed JPO and the City of Lakeville.
Due to the amount of new impervious surface and the proximity to the North Creek
drainage channel, we anticipate the need for water quality treatment as part of this
project. It is assumed water quality treatment will be in the adjacent green space
along the trail which is typical for trail projects. It is also assumed rate control will
not be required and volume control will be waived.
The preliminary design study will also include floodplain regulation research and
ordinance requirements for the North Creek Greenway. We anticipate that the profile
and alignment of the trail will be set to minimize fill; however, if fill is needed, there
will have to be an equal amount of compensatory storage created. Once cross
sections are available for the proposed trail, a floodplain assessment can be
completed. The assessment will identify the amount of compensatory storage needed.
Preparation of submittal documents to FEMA for purposes of obtaining a
LOMR\LOMA or LOMR-F are not included as part of the study. As part of the
study, we will identify whether or not additional floodplain evaluation is needed.
2.5 Land Use Clearance Coordination
It is not anticipated that a Conditional Use Permit (land use clearance) will be
necessary to construct the project, as Section 11-101-11 of the City's Zoning
Ordinance lists trails and pedestrian bridges as permitted used within a Floodway

District. However, confirmation that no additional land use clearances will be
required will be evaluated as a part of the preliminary design phase of this project.
3. Geotechnical Investigation
Soil investigation is not included in this proposal. WSB & Associates will assist the City in
coordinating a geotechnical evaluation of the soils in the area as a part of the project
management tasks associated with preliminary design.
4. Right of Way Services
Through discussions with City Staff, it is understood that the permanent easement language,
documents and right of way / easement boundaries for the trail will be prepared by the City /
County, and are not included in this proposal. The work schedule and design fees as reflect
the County's successful acquisition of all necessary easements and right-of-way certificates
by March 31, 2015_ This proposal also assumes the City is successful in obtaining and
easement/outlot through the parcel currently being developed by KJ Walk, Inc.
5. Project Memorandum
WSB will complete a Project Memorandum (PM) consistent with the policies and procedures
outlined by Mr -DOT State Aid and FHWA. The work for this effort includes early
coordination with permitting and regulating agencies such as the Army Corp of Engineers,
Watershed Districts, City/County, MnDOT Cultural Resource Unit and Office of
Environmental Stewardship, and MnDNR. The PM will also address the agreed upon design
considerations and/or mitigation related to wetlands and floodplains which will be worked
through under separate tasks. It is not assumed that any Section 106 resources (historical)
will be impacted with this project. However, an archeological investigation may be
necessary due to the area's water features. This will be determined by the MnDOT Cultural
Resource Unit. Since MnDOT offers a consultant program, where they pay 80percent of the
cost of this service, WSB is not including the scope or fee necessary for completing an
archeological investigation. However, our services do include the work necessary to
coordinate with MnDOT's consultant and summarize the findings in the PM.
FINAL DESIGN AND CONSTRUCTION PLAN PREPARATION
Once the preliminary alignment and profile have been developed and approved by City/County
Staff, WSB will develop the final construction documents (plans, specifications, and estimates).
The tasks to be completed are shown below.

includes meetings as necessary with Lakeville Staff and one meeting with the City Council,
if requested.
WSB will also coordinate and meet with the affected private utility companies.
2. Final Design and Plan Preparation
WSB will prepare a set of detailed construction plans for the grading, surface drainage, and
paving in accordance with FHWA and MnDOT standards. We will coordinate our work
closely with the City during the entire design process to ensure the City's expectations are
satisfied. Design meetings will be held, as appropriate, to discuss design elements and
comments during the design process. A final set of plans will be submitted to the City for
their review and approval. The final construction plans will include the following:

WSB proposes to complete the plans to a 60% level which includes final profiles and cross-
sections and easement needs. Once WSB reaches this point, we will provide a copy to the
City for their review and comments.
It is assumed the turf restoration for the project will only involve providing turf establishment
plans and details and that no landscape design is needed (outside of the trailhead area). The
construction documents will be prepared using English units.
WSB will prepare a construction cost opinion based on quantities generated as part of the
preparation of the construction plans. Costs will be split by funding source (including pro
rata of lump sum items, percentage City, other percentage splits).

3. Bridge Design
A pedestrian/bicycle bridge will be required to cross the North Creek drainage channel.
WSB will continue to work to design and permit a bridge crossing that will minimize both
flood stage impacts and construction costs for the bridge.
4. Flood Plain Fill / Storm Water Management
Once the final trail design completed, a floodplain assessment will be completed. Modeling
of the flood stage will be completed to verifyno increase in flood elevation.
5. Wetlands
The project will have wetland impacts, and purchase of wetland bank credits is a viable
option for applicants that cannot feasibly replace a portion (or all) of the minimum 2:1
replacement ratio on-site. It is assumed that the City of Lakeville will facilitate purchase of
any necessary wetland banking credits needed to construct the project.
6. Plan Review and Approval
WSB will submit the final plans, specifications, engineer's cost opinion, and other required
design data to MnDOT Federal Aid for their review and approval. WSB will make
appropriate changes based on Federal Aid review.
7. Specifications
Special provisions will be written for unique items not covered adequately in the "MnDOT
Standard Specification for Construction." Each provision will contain a description,
materials, construction requirements, method of measurement, and basis of payment for each
item. Deletions from and additions to standard specifications will be written and included as
necessary.
WSB will prepare the bidding documents which will include, but not be limited to, special
provision bidding instructions, sub -soil investigation report, bid proposal, and appropriate
MnDOT attachments. WSB will provide the City with reduced size (11" x 17") reproducible
plan sets along with the original bid proposal. WSB can provide additional copies of the plan
which would be billed to the County at our cost.
8. Permits
WSB will prepare the permit applications identified for the City's signature. The City will be
responsible for all permit fees necessary for the construction of the project. This task
includes the development of a Storm Water Pollution Prevention Plan (SWPPP) in
conjunction with the NPDES permit application. The following list is our understanding of
potential local, state, and federal permits and approvals required:
1. Wetland Conservation Act (30-60 days depending on proposed activity, administered by
the City of Lakeville)
2. Army Corp of Engineers Permit
3. Section 404 of the Federal Clean Water Act (60-90 days)
4. NPDES Construction Stormwater Permit (7 days)

Additional Optional Services
1. Bidding
At the City's request, WSB will prepare the bid proposal and contract documents in
preparation for bidding of the proposed improvements. WSB will provide services for this
task on an hourly rate basis WSB will prepare the advertisement for bids, and submit it to the
required publications. In addition, WSB will answer all bidders' questions and issue any
addendums as required for the project. Following opening of bids, WSB will tabulate the
bids, verify the bid calculation, and certify the low bidder for the City.
2. Construction Services
WSB can provide the City with assistance during the construction phase of the project. WSB
will provide services for this task on an hourly rate basis. Services provided by WSB &
Associates, Inc. for this task will be at the request of the City and may include design
services for plan modifications, acting as the City's representative on the project site,
conducting on-site observations of the work, interpreting the requirements of the contract
documents, preparing and maintaining all required contract administration documentation,
coordination of construction activities, and shop drawing review.
City Responsibilities
The City's responsibilities on this project will include the following:

Estimated Cost of Services
The Estimate of Cost for the final design of plan preparation on the following page shows the
estimated hours for each task by general employee classification.
We will bill the City based on an hourly billing rate shown in the Estimate of Cost up to the
estimated contract amount of $40,303 for the preliminary design and $78,850 for the final design
and construction plans preparation, for a total fee of $119,153. We understand that the City has
$100,000 budgeted for the design in 2014. We will work with the City to refine the limit the
design work completed in 2014, and will not exceed $100,000 in 2014 without prior written
consent from the City.
