Proposed Action
Staff recommends adoption of the following motion: Move to adopt a resolution approving the
Update of First Park Lakeville Alternative Urban Areawide Review (AUAR) for the site located at the
southeast corner of Co. Rd. 9 (Dodd Blvd.). and CSAH 70.
Passage of this motion will result in the approval of First Park Lakeville AUAR Update. Notice of this
decision will be provided to the review agencies and to the Minnesota Environmental Quality Board.
Overview
A final Alternative Urban Areawide Review (AUAR) was approved for this 140 acre industrial
development in April of 2008. This type of environmental review was required under Minnesota Rules
because of the size of the overall development. The 2014 Update is required by Minnesota Rules
because more than five years have passed since the City adopted the original AUAR and Mitigation
Plan and the site has not yet been fully developed. Trammel Crow Company is the current developer
of First Park and the current master plan for the development of the remaining land is consistent with
the 2008 approvals in terms of building square footage, land use and off-site improvements.
The City is the Responsible Government Unit (RGU) in the preparation of the proposed AUAR Update.
City staff and staff at WSB Engineering and SRF have coordinated with Trammel Crow's consultant,
Westwood on the preparation of the Draft AUAR Update. The City Council authorized the Draft AURA
Update to be distributed for review and comment on March 3, 2014, Comments were received from
four review agencies and are attached. Responses to the comments have been prepared and are also
attached.
Staff recommends adoption of the resolution approving the AUAR Update.

ALTERNATIVE AREAWIDE REVIEW (AUAR) 2013 UPDATE
WHEREAS, an AUAR 2013 Update has been completed for the project pursuant to Minnesota
Rules 4410 and identifies and assesses the environmental impacts and mitigation measures associated
with the First Park Lakeville area.
WHEREAS, the First Park Lakeville area is located at the southeast quadrant of CSAH 70 and
County Road 9 as shown in the AUAR 2013 Update;
WHEREAS, the AUAR 2013 Update was updated pursuant to Minnesota Rules 4410.3610;
WHEREAS, the AUAR 2013 Update was distributed for the required 10 -day comment period;
WHEREAS, comments received on the AUAR 2013 Update have generated information
adequate to determine mitigation measures associated with the potential development in this area;
WHEREAS, the comments received and the City's responses to these comments are included
in the public record for the AUAR 2013 Update;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakeville:
The City of Lakeville adopts the First Park Lakeville AUAR 2013 Update dated February 28,
2014.

Dear Mr. Dempsey:
We have received the document entitled "2013 Update to the 2008 Alternative Urban
Areawide Review (AUAR), First Park Lakeville — Lakeville, Minnesota" dated February 28",
2014. The document proposes an industrial/warehouse development along with the associated
parking and infrastructure on an approximately 136 acre site in Lakeville. Currently there is no
proposal to impact the 7.37 acres of wetlands in the southern portion of the site; according to the
Updated AUAR, the wetlands have been preserved, and protected with a buffer constructed in
2008 as part of the original site infrastructure construction. The project is located in Sections 31
and 32, Township 114N., Range 20W., Dakota County, Minnesota.
The Updated AUAR document indicates no impacts to wetlands or other aquatic
resources are proposed for the approximately 136 -acre First Park Lakeville site shown on Figure
5.2 WPS in the Updated AUAR document. Thus, a Corps permit would not be required for this
project. However, the Updated AUAR document provides a figure titled "First Park — Lakeville
— Potential Future Developments" (Figure 21-1 WPS). These potential future development sites
may contain aquatic resources that would be regulated by the Corps of Engineers. For planning
for these potential future development sites, please consider the following general information
concerning our regulatory program that may apply to the proposed sites.
If the proposal involves activity in navigable waters of the United States, it may be
subject to the Corps of Engineers' jurisdiction under Section 10 of the Rivers and Harbors Act of
1899 (Section 10). Section 10 prohibits the construction, excavation, or deposition of materials
in, over, or under navigable waters of the United States, or any work that would affect the
course, location, condition, or capacity of those waters, unless the work has been authorized by a
Department of the Army permit.
If the proposal involves discharge of dredged or fill material into waters of the United
States, it may be subject to the Corps of Engineers' jurisdiction under Section 404 of the Clean
Water Act (CWA Section 404). Waters of the United States include navigable waters, their
tributaries, and adjacent wetlands (33 CFR § 328.3). CWA Section 301(a) prohibits discharges
of dredged or fill material into waters of the United States, unless the work has been authorized
by a Department of the Army permit under Section 404. Information about the Corps permitting

The Corps' evaluation of a Section 10 and/or a Section 404 permit application involves
multiple analyses, including (1) evaluating the proposal's impacts in accordance with the
National Environmental Policy Act (NEPA) (33 CFR part 325), (2) determining whether the
proposal is contrary to the public interest (33 CFR § 320.4), and (3) in the case of a Section 404
permit, determining whether the proposal complies with the Section 404(bXl) Guidelines
(Guidelines) (40 CFR part 230).
If the proposal requires a Section 404 permit application, the Guidelines specifically
require that "no discharge of dredged or fill material shall be permitted if there is a practicable
alternative to the proposed discharge which would have less adverse impact on the aquatic
ecosystem, so long as the alternative does not have other significant adverse environmental
consequences" (40 CFR § 230.10(a)). Time and money spent on the proposal prior to applying
for a Section 404 permit cannot be factored into the Corps' decision whether there is a less
damaging practicable alternative to the proposal.
If an application for a Corps permit has not yet been submitted, the project proposer may
request a pre -application consultation meeting with the Corps to obtain information regarding the
data, studies or other information that will be necessary for the permit evaluation process. A pre -
application consultation meeting is strongly recommended if the proposal has substantial impacts
to waters of the United States, or if it is a large or controversial project.

Office of Planning reviewed the document and offer the following comments for your consideration:

Wells: The AUAR indicates that all wells on the property have been sealed. Staff
Transportation
reviewed the records and confirmed that there are sealing records for all known
Highways
wells (two old domestic farm wells and two more recent dewatering wells) on the
Surveyor's Office
property.
Transit Office
Hazardous Materials: No records of hazardous materials were identified for these
parcels.
Historic Releases: No records of releases were identified for these parcels.
Waste Sites and Generators: There are two records of waste sites and several past
and current hazardous waste generators within %Z mile of this site. Information
relating to these sites is included in Attachments 1 and 2.
Transportation
County staff appreciates the efforts of the City and developer in working on the
development of the transportation/traffic section of this AUAR. While the streets
within the proposed development appear to meet the County's access spacing
guidelines for CSAH 9 and CSAH 70, some of the specifics related to the
transportation comments (access issues, local street connections) will be discussed
and addressed through the plat approval process. County staff looks forward to
working with the City and developer at that time.

The City of Lakeville and Dakota County have discussed the potential of designating CSAR 70 as a
principal arterial in the future. This could impact the type of access provided to CSAH 70 on the
north end of the property. It is very important the internal street system provide good connections
to other roads. The internal street system shown in the AUAR makes good connections to the north
and west. There are no street connections to the south and east. County staff recognizes that the
land to the south is outside of the Lakeville city limits, but it is recommended that a local street
connection be added to accommodate future development and reduce direct access to CSAH
9. Similarly, there are no local streets to the east, probably because this is airport property now and
for the foreseeable future. Please consider reserving right of way for a street connection to the east
should plans at the airport change or there becomes an opportunity to make local street connections
to the commercial/industrial land uses just west of the railroad tracks. Another option could include
dedication of right of way across the entire southern boundary of the property along the municipal
boundary.
Transportation staff understand that the proposed office and warehouse buildings will generate
substantial traffic and raise the issue of the need for traffic signals. The AUAR states that traffic
control signals are proposed to be installed when warranted. As a point of clarification, meeting
traffic warrants alone does not automatically indicate signals should be installed. The County will use
an Intersection Control Evaluation (ICE) process to look at various Intersection design and traffic
controls to determine the appropriate measure to be taken. The County Engineer will determine
whether or not a signal is appropriate after a traffic study/ICE process and based on consultation with
County staff. Given the large traffic volumes that could be generated by this development, the
preferred location for a signal on CSAH 9 may be on the municipal boundary % mile south of the
CSAH 9 and CSAH 70 intersection. Given that this may be the future signal location, it is strongly
recommend that the dotted line street connection shown between the cul-de-sacs on the property
be completed as a local street connection.

Metropolitan Council staff completed its review of the First Park Lakeville Alternative Urban Areawide
Review (AUAR) to determine its accuracy and completeness in addressing regional concerns. Staff
concludes that the AUAR is complete and accurate with respect to regional concerns and raises no major
issues of consistency with Council policies. However, staff offers the following comments for your
consideration:
Item 17 — Water Quality: Surface Water Runoff
The National Weather Service's Hydrometeorological Design Studies Center released new
precipitation frequency estimates in June of 2013 for many of the Midwestern states, including
Minnesota, in a publication termed the NOAA Atlas 14 Point Precipitation Frequency Estimates.
(See http://www.dnr.state.mn.us/climate/noaa atlas 14.html and
http://bdsc.nws.noaa.,gov/hdsc/pfds/pfds_map cont.html?bkmrk=mn ) These data supersede the
TP40 data that have been used to predict rainfall distributions in the US since 1961.
The new estimates result in generally higher projected rainfall events for the average 50- and 100 -
year recurrence intervals in the Twin Cities Metropolitan Area. The AUAR documents do not
indicate what 24-hour duration rainfall accumulation was utilized for the 100 -year (average
recurrence interval) event to design the stormwater management system that serves this development
site. The new Atlas 14 precipitation frequency data estimates indicate that future 100 -year rainfall
recurrence interval events should now be estimated to be approximately 7.38". These new data
should be utilized by the City, Watershed, and project proposer in the recalculation of runoff from the
development site to insure that the proposed project's stormwater conveyance, treatment, and
infiltration facilities will be properly sized to accommodate future runoff events.
Item 25 — Nearby Resources
In the time period between the issuance of the AUAR in 2008 and the update to the AUAR in 2013,
the Metropolitan Council approved Dakota County's master plan for the Lake Marion Regional
Trail. The regional trail will travel parallel to the stream on the north side of CSAH 70 and will be
located approximately 0.1 mile north of the AUAR site. The proposed development is not anticipated
to impact the regional trail corridor. The AUAR indicates that the City is considering future trails
along CSAH 70 and CSAH 9, which will improve access to the regional trail corridor.

Dear Mr. Dempsey:
The Minnesota Department of Transportation (MnDOT) has reviewed the above Alternative
Urban Areawide Review ("AUAR"). Please note that MnDOT's review of this AUAR does not
constitute approval of a regional traffic analysis and is not specific approval for access or new
roadway improvements. As plans are refined, we would like the opportunity to meet with our
partners and review the updated information. Before any further development, please address the
following issues:
Traffic:
The AUAR update includes the I-35/CSAH 70 ramps, but does not look at I-35 mainline
operations. The I-35 mainline needs an operational analysis.
The AUAR states that dual westbound right turn lanes on CSAH 70 could be needed for traffic
entering northbound I-35. Dual rights are a safety concern for pedestrians crossing the right
turning movement. The dual right will still need to merge before entering I-35 and may have
limited benefit. Mainline operations will need to be evaluated to measure the benefit of this
proposal, and will also require an IAR from FHWA.
MnDOT also requests request Synchro files for review. Please direct any questions concerning

Review Submittal Options:
MnDOT's goal is to complete the review of plans within 30 days. Submittals sent electronically
can usually be turned around faster. Submit one of the following:

provided that each e-mail is less than 20 megabytes.
2. Three sets of full size plans. Submitting seven sets of full size plans will expedite the review

On the 2013 Update to the 2008 Alternative Urban Areawide Review
First Park Lakeville - Lakeville, Minnesota
This Response to Comments is a component of the 2013 Update to the 2008 Alternative Urban
Areawide Review prepared by the City of Lakeville, for the First Park Lakeville site to be
developed by the Trammell Crow Company. The 2013 AUAR Update reviews updated potential
impacts to result from the development planned for the 140+ acre geographic area covered by the
AUAR. This Response to Comments addresses the comments received during the 10 -day agency
review period from March 17'h, 2014 through March 28`", 2014.
Complete copies of the comment letters are included in Attachment D of the 2013 Update; the
comments are summarized within this Response to Comments section and are shown in bold
italicized text. Section Il of this Response to Comments has been arranged to individually
respond to each commenter. Comments were received from the following five agencies:

1.0 Army} Corps of Engineers March 25h, 2014
1.1 If the proposal involves activity in navigable waters of the United States, it may be subject to
the Corps of Engineers' jurisdiction under Section 10 of the Rivers and Harbors Act of 1899
(Section 10). Section 10 prohibits the construction, excavation, or deposition of materials in,
over, or under navigable waters of the United States, or any work that would affect the
course, location, condition, or capacity of those waters, unless the work has been authorized by a
Department of the Army permit
Comment noted. No work is anticipated in navigable waters.
1.2 If the proposal involves discharge of dredged or fill material into waters of the United States, it
may be subject to the Corps of Engineers' jurisdiction under Section 404 of the Clean Water
Act (CWA Section 404).

2.1 The City of Lakeville and Dakota County have discussed the potential of designating CSAH
70 as a principal arterial in the future. This could impact the type of access provided to
CSAH 70 on the north end of the property. It is very important the internal street system
provide good connections to other roads. The internal street system shown in the AUAR
makes good connections to the north and west. There are no street connections to the
south and east. County staff recognizes that the land to the south is outside of the Lakeville
city limits, but it is recommended that a local street connection be added to accommodate
future development and reduce direct access to CSAH 9. Similarly, there are no local
streets to the east, probably because this is airport property now and for the foreseeable
future. Please consider reserving right of way for a street connection to the east should
plans at the airport change or there becomes an opportunity to make local street
connections to the commerciaUindustrial land uses just west of the railroad tracks. Another
option could include dedication of right of way across the entire southern boundary of the
property along the municipal boundary.
The proposed masterplan of First Park continues to plan for a connected internal street system that
connects to the County road system in two locations on Dodd Boulevard and County Road 70.
There currently is no planned access connection to the south into Eureka Township. Any such
connection would involve discussion and coordination between the two jurisdictions. There is
currently a 50 drainage and utility easement on the south property line that might be used in the
future for a public road extension. Any such extension would potentially impact the existing ponds
and wetlands associated with the industrial park and would require significant coordination and
permitting with multiple water governing units including MCPA, DNR, Vermillion Watershed and
the Army Corp of Engineers.
There are no streets to the east of the park due to the ownership of land by the Metro Airport
Commission. This land is within the MNDOT Safety Zone B, and as such is not contemplated for
development. A public road ROW was dedicated to the City as part of the development of the
DMAC Real Estate property located directly east of the industrial park. This public road easement
was recorded with the County in 2010 and the document is attached for reference. This easement
is also generally depicted on Figure GAWPS — AUAR Update to Concept Masterplan and is also
attached.
2.2 Transportation staff understands that the proposed office and warehouse buildings will
generate substantial traffic and raise the issue of the need for traffic signals. The AUAR
states that traffic control signals are proposed to be installed when warranted. As a
point of clarification, meeting traffic warrants alone does not automatically indicate
signals should be installed. The County will use an Intersection Control Evaluation (ICE)
process to look at various intersection design and traffic controls to determine the
appropriate measure to be taken. The County Engineer will determine whether or not a
signal is appropriate after a traffic studylICE process and based on consultation with County
staff. Given the large traffic volumes that could be generated by this development, the
preferred location for a signal on CSAH 9 may be on the municipal boundary 1/2 mile south
of the CSAH 9 and CSAH 70 intersection. Given that this may be the future signal location, it
is strongly recommend that the dotted line street connection shown between the cul-de-sacs
on the property be completed as a local street connection.
The cul-de-sac on 217`h Street West and the previous cul-de-sac on 220`h Street West have been
connected as part of a construction project completed in 2012. This public road connection
(Humboldt Road) is generally depicted on Figure 6AWPS — AUAR Update to Concept
Masterplan (attached) as well as the rest of the updated Figures.

3.0 Metropolitan Council March 25h, 2014
3.1 The new Atlas 14 precipitation frequency data estimates indicate that future 100 year rainfall
recurrence interval events should now be estimated to be approximately 7.38'% These new
data should be utilized by the City, Watershed, and project proposer in the recalculation of runoff
from the development site to insure that the proposed project's stormwater conveyance,
treatment, and infiltration facilities will be properly sized to accommodate future runoff events.
Noted. The City will comply with all current state stormwater statutes as additional development
occurs.
3.2 In the time period between the issuance of the AUAR in 2008 and the update to the AUAR in
2013, the Metropolitan Council approved Dakota County's master plan for the Lake
Marion Regional Trail. The regional trail will travel parallel to the stream on the north side
of CSAH 70 and will be located approximately 0.1 mile north of the AUAR site. The
proposed development is not anticipated to impact the regional trail corridor. The AUAR
indicates that the City is considering future trails along CSAR 70 and CSAH 9, which will
improve access to the regional trail corridor.

4.0 Minnesota Department of Transportation March 25"', 2014
4.1 The AUAR update includes the I-35/CSAR 70 ramps, but does not look at 1-35 mainline
operations. The 1-35 mainline needs an operational analysis.
Analysis of Traffic Appendix Figure 10 shows I-35 trips generated by the site to be minimal
during the AM and PM Peak hours. Specifically, in the AM Peak Hour, the trips generated
by the site are:
• To NB I-35 — 42 trips;
• To SB I-35 —14 trips;
• From NB 1-35 — 35 trips;
• From SB I-35 —109 trips.
In the PM Peak Hour, the trips generated by the site are:
• To NB I-35 — 96 trips;
• To SB 1-35 — 31 trips;
• From NB 1-35 — 9 trips;
• From SB 1-35 — 27 trips.
The level of magnitude of these trips in comparison to the overall daily volume of traffic
along I-35 recorded in 2012 as 64,000 vehicle/day, is minimal. Therefore, this requirement
is excessive and beyond the scope of this AUAR Update.
4.2 The AUAR states that dual westbound right turn lanes on CSAH 70 could be needed for traffic
entering northbound 1-35. Dual rights are a safety concern for pedestrians crossing the right
turning movement The dual right will still need to merge before entering 1-35 and may have
limited benefit Mainline operations will need to be evaluated to measure the benefit of this
proposa4 and will also require an LAR from FHWA.
Comment noted. The 2008 First Park AUAR carried a similar recommendation. There was
discussion of dual right turn lane control at the NOTE Intersection Traffic Control

Committee Meeting on 02/04/09, in which MnDOT and other agency and traffic c
professionals attended. MnDOT officials indicated that they would pursue discussion of the
dual right turn operation at internal TEO meetings.
Since then, MnDOT has allowed the use of dual right turn lanes at several locations
throughout the state. One example of such location is at TH 23 & CSAH 75 in Monticello.
In addition, at the northbound off ramp from I494 to eastbound MN 62 (Crosstown Hwy),
traffic utilizes free right turn lane as a de facto dual right turn lane because some drivers
yield in order to cross over all eastbound lanes to get into the left turn lanes, while some
drivers pass on the right side to proceed eastbound. In each case, a crosswalk is provided.
