Presentations/Introductions Randy Sparling and Colleen LaBeau, representing Lakeville Rotary, and Liquor Director Brenda Visnovec provided an overview of the upcoming Taste of Lakeville event. Chief Meyer presented the Fire Department First Quarter Report. Chris Petree presented the April Public Works Department monthly report. 6. Consent Agenda Council members removed Item 6g from the consent agenda and moved Item 9 to the consent agenda. Motion was made by Anderson, seconded by LaBeau to approve the consent agenda items as follows: a. Claims for payment b. Minutes of the April 21, 2014 City Council meeting c. Engineering Services Agreement with Short Elliott Hendrickson, Inc. for design and construction of a new water tower d. Agreement with InTech Software Solutions, Inc. for Modus Elections Manager City Council Meeting Minutes, May 5, 2014 Page 2 e. Temporary on -sale liquor license for the Lakeville Lions f. Proposal from WSB & Associates for design and engineering of the North Creek Greenway g. (Removed from consent agenda) h. Proposal from WSB & Associates to provide zoning enforcement services Voice vote was taken on the motion. Ayes - unanimous Item 6g Mr. Mielke explained that an over -abundance of Canadian geese at Antlers Park has become a nuisance for park users, and the droppings create a water quality issue. Several goose management options have been researched and/or attempted; however, they were not successful. A number of other cities throughout the Metro area utilize the services of Canada Goose Management with successful results. Ken LaBoone, 20072 Italy Avenue, stated he is concerned about the method proposed for removing and disposing of the geese and goslings and asked the City Council to consider seeking alternative methods. He questioned whether Canada Goose Management follows federal and state guidelines and has the appropriate permits to take the geese. Mr. Altergott stated Canada Goose Management operates under a permit through the Minnesota Fish and Wildlife Service. He stated that other methods of removing the geese were not effective, and he pointed out that chasing the geese away only works for a period of time, as they do come back. Motion was made by Swecker, seconded by Davis to authorize staff to proceed with capture and removal of geese at Antlers Park with Canada Goose Management, Inc. Roll call was taken on the motion. Silvarum Preliminary Plat Dave Zweber, Encore Development, requested Council approval of the Silvarum preliminary plat, which consists of eight large wooded single-family lots and one outlot on 4.45 acres of land located west of Judicial Road and north of 167h Street. City Council Meeting Minutes, May 5, 2014 Page 3 Mr. Morey provided an overview of the Silvarum preliminary plat. The property is zoned RS -1, Single Family Residential District. The existing home and outbuilding located on the subject property, along with the well and septic system, will be removed with this plat. Mr. Morey explained that Linch Path is an existing gravel road on the west side of the proposed plat. The developer will upgrade Linch Path adjacent to the plat. Linch Path will be constructed as a paved street with curb and gutter on the east side, and the west side will remain a rural section. All eight lots will be custom graded. The developer will submit a custom grading plan and a custom tree preservation plan for each building permit. The plat has been designed to meet the City's zoning and subdivision ordinance standards, as well as the City's comprehensive plan. Mr. Morey explained that the City Administrator and City Engineer met with neighboring property owners, Mike and Karen Jackson, who felt that their concerns regarding the development had not been addressed at the Planning Commission meeting. As a result, staff recommends adding two additional stipulations to the 11 stipulations approved by the Planning Commission. These are outlined in Kris Jenson's planning report dated May 2, 2014. Staff recommends approval of the Silvarum preliminary plat subject to 13 stipulations. Mike Gillen, 16600 Judicial Road, stated he feels this plat will have a negative impact on the character of the neighborhood. He questioned whether the proposed holding pond would be adequate for storm water runoff, and he stated that a possible ground contamination matter on the property had not been addressed. City Engineer Zach Johnson stated the developer's engineer submitted calculations that indicate the holding pond is adequate and meets the criteria in the City's ordinance. Nick Polta of Pioneer Engineering explained the design of the holding pond, which will direct water in two directions, reducing the flow to the 1671 Street culvert and reducing the impact to the Gillen property. He explained that there is very little flow from this development to the northwest. The individual rain gardens on four of the lots will also help mitigate the storm water flows. Mr. Zweber stated he was not aware of any soil contamination issues on this property. He stated soil borings were not done on the property. With respect to the character of the neighborhood, Mr. Zweber explained that custom grading each lot will save as many trees as possible and preserve the natural amenities of the property. Mr. Mielke pointed out that the City's zoning and comprehensive plan have anticipated this development for a long time. It does meet the City's requirements, and the developer has a City Council Meeting Minutes, May 5, 2014 Page 4 right to develop the property. He further pointed out that the developer had considered other layouts for the plat, which would have resulted in more trees being removed. Doug Torseth, 16601 Linch Path, stated that due to the steep grade and drainage problems on Linch Path, he feels it should have curb and gutter on both sides. He asked if sewer and water hook-up is mandatory. Mr. Morey stated that once sewer and water becomes available, property owners have two years to hook up. Mr. Johnson explained that final locations of sanitary sewer and watermain will be determined prior to approval of the final plat. Mr. Mielke stated engineering will look at the depth of the sewer on Linch Path and lower it to the point that it can serve all properties in the RS -1 zoning district, if it is feasible. Council Member LaBeau suggested that the property owners on the west side of Linch Path might possibly agree to an assessment for curb and gutter, given the current drainage issues. Michael Jackson, 16562 Linch Path, thanked City staff for meeting with him and his wife to address their concerns. He indicated he would work with the City and developer to provide the necessary easement for a temporary cul-de-sac on Linch Path near the northwest corner of the plat. Mr. Gillen stated there is, apparently, a large rock on the property and he asked how it would be removed. He also asked whether the property owners would be allowed to bury the rain gardens at a future point in time, if they choose to. Mr. Zweber stated the rain gardens need to be preserved and maintained by the property owners. With respect to removal of the large rock, if necessary, Mr. Mielke stated the City would assure that it is done correctly and according to regulations. Mr. Jackson requested an additional stipulation with the final plat related to drainage in the northwest corner of the plat and additional screening of the swale area. Mr. Mielke stated this matter will be addressed under Stipulation 12. Council Member Anderson asked staff to further review the feasibility of placing curb and gutter on both sides of Linch Path and to communicate to the residents the options that are available. Utility and Street Construction Standard Specifications -2014 Update Monica Heil of WSB & Associates presented the City of Lakeville Utility and Street Construction Standard Specifications, highlighting the 2014 Update. She stated the City has implemented many of the changes on recent municipal improvement projects. The proposed changes benefit and preserve the integrity of the City's infrastructure system. Motion was made by Anderson, seconded by LaBeau to approve the City of Lakeville Utility and Street Construction Standard Specifications - 2014 Update. Roll call was taken on the motion. Ayes - Swecker, Anderson, LaBeau, Davis, Little 10. Minnesota Teamsters Local No. 320 Human Resources Manager Cindi Joosten presented the Labor Agreement between the City of Lakeville and Minnesota Teamsters Local No. 320 for the public works employees. The two year agreement provides a wage increase of 1.75% for each year of the agreement. In addition to the increase, each member of the bargaining unit will receive $400 in both 2014 and 2015. This settlement is recommended to achieve agreement with the union and to work toward bringing the wage closer to the average of comparable cities. The 2014 health insurance premiums are identical to those established for the sergeants and non-union employees. Motion was made by Swecker, seconded by Davis to approve the Labor Agreement between the City of Lakeville and Minnesota Teamsters Public & Law Enforcement Employees Union, Local No. 320. Roll call was taken on the motion.
