RESOLUTION ACCEPTING BIDS AND AWARDING CONTRACT FOR
KING PARK PLAYGROUND SURFACING - CITY IMPROVEMENT PROJECT #14-15
AND PLAYGROUND EQUIPMENT
Proposed Action
Staff recommends adoption of the following motion: Move to authorize Mayor and City
Council to execute an agreement with Flagship Recreation. LLC for the installation of
playground surfacing at King Park and authorize City staff to execute a purchase order with
Flagship Recreation LLC for the purchase of the playground equipment
Overview
Over the past year, staff and South Metro Miracle League representatives have been in
discussions and planning phase for the construction of a universal playground at King Park. A
universally accessible playground is a play environment specifically created to be accessible
to all children including those with disabilities.
At the April 28, 2014 City Council Work Session, staff presented a proposed playground
design and surfacing options with the Mayor and City Council. At that time, the Mayor and
City Council directed staff to move forward in obtaining bids for the Poured -in -Place surfacing
option which provides a fully accessible unitary surface that would be installed within the
playground container. Bids were accepted until 4:00 PM on Tuesday, May 27th. One bid was
received from Flagship Recreation, LLC at a cost of $90,415.00.
At this time, staff is recommending approval of an agreement with Flagship Recreation, LLC
for the installation of the Poured -in -Place playground surfacing at King Park in the amount of
$90,415.00. Staff is also recommending the Mayor and City Council authorize City staff to
execute a purchase order with Flagship Recreation, LLC in the amount of $85,418.00 for the
playground equipment to be purchased off the State's Cooperative Purchasing Venture
Program.

The difference between the revenues versus expenditures is $22,593. The remaining $22,593
will come from the Park Dedication Fund and/or additional donations and fundraising efforts
as discussed at the April 28, 2014 City Council Work Session.

WHEREAS, the City of Lakeville has planned for the construction of a universal
playground at King Park; and
WHEREAS, plans and specifications were created for King Park playground surfacing;
and
WHEREAS, specifications were sent to vendors on the State's Cooperative Purchasing
Venture Program that provide Poured -in -Place safety surfacing; and
WHEREAS, bids were accepted until 4:00 PM on Tuesday, May 271h; and
WHEREAS, the lowest responsible bidder for the installation of the Poured -in -Place
safety surfacing at King Park is Flagship Recreation, LLC with a bid of $90,415.00; and
WHEREAS, staff is also proposing to purchase the playground equipment through the
State's Cooperative Purchasing Venture Program with Flagship Recreation, LLC at a cost of
$85,418.00.
NOW, THEREFORE, BE IT RESOLVED, that the bid is accepted and a contract is
awarded to Flagship Recreation, LLC for the installation of the Poured -in -Place safety
surfacing in the amount of $90,415.00 along with the execution of a purchase order for the
playground equipment with Flagship Recreation, LLC at a cost of $85,418.00.

AGREEMENT BETWEEN OWNER AND CONTRACTOR
This AGREEMENT made and entered into as of June 2, 2014, by and between the City of Lakeville, MN,
hereinafter referred to as the OWNER and Flagship Recreation, LLC, hereinafter referred to as the
CONTRACTOR.

The OWNER and CONTRACTOR, in consideration of the mutual covenants hereinafter set forth, agree as
follows:
ARTICLE 1. CONTRACT DOCUMENTS
The Contract Documents consist of this Agreement, the Conditions of the Contract (General, Supplementary and
other Conditions), the Drawings, the Specifications, all Addenda issued prior to and all Modifications issued after
execution of this Agreement. These form the Contract, and all are as fully a part of the Contract as if attached to
this Agreement or repeated herein.
ARTICLE 2. THE WORK
The Contractor shall perform all the Work required by the Contract Documents for the King Park Playground
Surfacing including, but not limited to, all specific work described on the BID FORM 00500.
ARTICLE 3. TIME OF COMMENCEMENT AND SUBSTANTIAL COMPLETION
The Work to be performed under this Contract shall be completed as follows:
All work shall start upon acceptance and notification by the Owner and shall be 100% complete on or
before August 22, 2014.
ARTICLE 4. CONTRACT SUM
The OWNER shall pay the CONTRACTOR in current funds for the performance of the Work, subject to
additions and deductions by Change Orders as provided in the Contract Documents, the Total Contract Sum of
Ninety Thousand Four Hundred Fifteen Dollars and Zero Cents ($90,415.00).
ARTICLE 5. PAYMENT
Payment, constituting the Contract Sum, shall be paid by the OWNER to the CONTRACTOR when the Work has
been completed, the Contract fully performed, and a final Application for Payment has been submitted by the
CONTRACTOR.
