PARKS & RECREATION DIRECTOR: Mr. Michaud presented the July monthly report of the Parks & Recreation Department. PRESENTATIONS/INTRODUCTIONS • CITY OF LAKEVILLE COUNCIL MEETING AUGUST 20, 2001. Mr. Erickson announced that the Lakeville Cable Department was recently awarded a Telly Award and a Videographer Award of Distinction for its Lakeville Kids & Government program. Mr. Erickson recognized Cable Department staff members Jim Schiffman, Chris Vogt and Jeff Lueders. CITIZENS' COMMENTS. None CONSENT AGENDA 01.102. ITEM 8 Mr. Michaud provided an overview of the Klamath Trail trail project. He explained that the City completed two phases of the trail corridor in 1998 and. 1999. Phase IIT of the Klamath Trail project was not completed due to other pending priorities • and funding. availability. City staff, along with SRF Consulting Group, recently held a neighborhood meeting to discuss the status of the Phase III trail project. The residents expressed a desire to proceed with Phase III as soon as possible. SRF Consulting Group has submitted a proposal to update the 1998/99 feasibility study. Mr. Michaud pointed out that Phase III offers some specific design challenges including steep slopes, overhead utilities, vegetation removal and potential `.wetland impacts. He stated staff will continue to communicate with interested residents regarding. the status of the Phase. TII trail. project. 01.10.3 Motion was made by Luick, seconded by Bellows to authorize SRF Consulting Group, Inc. to review and update the Phase III portion of the Klamath -Trail Feasibility Study, Orchard Lake Elementary School to County Road 5. Ayes, Johnson, Mulvihill, Rieb, Luick, Bellows.- • .CITY OF LAKEVILLE COUNCIL MEETING AUGUST 20, 2001 PAGE 4 • ITEM 9 Herb Weissmann of Weissmann Homes .requested Council approval of the preliminary plat of Village Creek. He stated he feels strongly that 207t" Street needs to be connected to the Village Creek development so that these new residents do .not feel. isolated from the community and downtown area. Terry Weissmann outlined the review process and. emphasized their. willingness to work with the existing residents to address their concerns regarding .traffic and the 207t" Street connection to the existing neighborhood. He stated they have agreed, along with the City, to make curb and gutter and sidewalk improvements on 2071h Street, as well as Upper 206t" Street. They have also agreed to pave Hamburg Avenue from 2D2"d .Street to 21Ot" Street to encourage traffic to utilize Hamburg Avenue and reduce the number of trips on 207t" Street. City Planner Ron Mullenbach presented the planning report for Village Creek. The proposal includes a preliminary plat of 119 • single-family lots and 126 townhouse lots, an ordinance rezoning three lots from RS-3 to RS-CBD and an ordinance rezoning two outlots from RM-1 to RS-3. Also included is a conditional use permit.. for right-of-way width of 50 feet in the RM-1 District and a street crossing in the Floodway District. The property is located east of downtown Lakeville within the Central Business District. Mr. Mul{enbach explained that the developer is ,proposing to rezone three single-family lots proposed on the west side of the creek, adjacent. to the existing downtown neighborhoods. These three lots would be rezoned to RS-CBD, Singie Family Residential District -Central Business District, consistent with the existing homes. The proposed single family lots in the RM- 1 District adjacent to the existing single-family homes to the north would be rezoned to the RS-3 District. Both are consistent with the policies of the 1998 Comprehensive Plan Update. The proposed preliminary plat includes a street connection across the. creek channel to existing 207t" Street, which is • designated as a minor collector in the City's Transportation Plan. The Zoning Ordinance allows street construction within CITY OF LAKEVILLE COUNCIL MEETING AUGUST 20, 2001 PAGE 5 the Floodway District by conditional use permit. The Zoning Ordinance also allows a public street with a 50-foot right-of- way width in the RM-1 District by conditional use permit. Staff is recommending approval of a conditional use permit to allow the reduced street width on the local streets serving the townhouse portion of the preliminary plat. Mr. Mullenbach stated School District 194 supports the proposed preliminary plat of Village Creek. The district also supports the 207t" Street connection, as it would provide more options for efficient busing services to the children who will be living in the new development. Three neighborhood meetings were held by Wensmann Realty. A number of concerns were raised at the neighborhood meetings, the main issue being the 207t" Street connection. Mr. Mullenbach explained that the 2071" Street connection is supported by the policies of the, Comprehensive Land Use Plan and the Transportation Plan. While the 2D7t" Street crossing is still proposed, the developer has made several .revisions to the. initial plan, including the elimination of a street connection to existing Holiday Avenue. Staff also recommended that barricades be placed on 207t" Street to keep construction traffic off of the existing street. The barricades would remain in place for. three years, or until 100 lots are developed,. whichever occurs first. The Planning Commission held a public hearing on the Village Creek preliminary plat and heard considerable opposition to the 207th Street connection. Planning and engineering staff recommends approval of the 2071" Street connection, Mr. Mullenbach explained, in order to provide an interconnection between neighborhoods and preserve the integrity of the ...community's higher functional classification streets. Good local P and minor collector street connections reduce the need for shorter trips to utilize major collector and arterial streets, such as 202"d Street, County.Road 50 and 210t" Street. The need for an east/west connection between the central business district and Hamburg Avenue, he pointed out, has long been .identified in the City's Transportation Plan and other planning documents including: CITY OF LAKEVILLE COUNCIL MEETING AUGUST 20, 2001 PAGE 6 n ~J ^ 1976 Central Business District (CBD) Concept Plan ^ 1980 Comprehensive Policy Plan/Development Framework ^ 1985 CBD Concept Plan Update ^ 1988 Comprehensive Plan and ^ 1999 Comprehensive Plan Update Mr. Mullenbach further stated that the Village Creek preliminary plat implements specific recommendations of Planning District 7 of the 1999. Comprehensive Plan Update. One of those recommendations is to establish a hierarchy: of streets to improve traffic circulation throughout Planning District 7, pursuing the extension of 207t" Street east to Hamburg Avenue. as a minor collector street. Staff recommends approval of the Village Creek preliminary plat, rezoning and conditional use permit, subject to 24 stipulations recommended by the staff and Planning Commission. • Nick Polta of Pioneer Engineering explained that the bridge is proposed to be an "old style" design with sidewalks on both sides and decorative street lighting. He stated the City's engineering department will design the necessary box culvert for the bridge. Mayor Johnson opened the meeting to questions and comments from the audience. He asked the residents to limit their comments to issues that were not raised at the Planning Commission meeting.. He indicated that the Council members have all reviewed the four hour video tape recording of the August 2"d Planning Commission public hearing and are welt aware of the issues raised at that meeting.. Dan Laun, 8675 206t" Street West, presented a letter requesting the City Council carefully consider the fragility of the historic downtown against the need to open 207t" Street. He also asked that the Council consider the safeguards that can be put in place to eliminate/minimize the increased traffic to the existing residents. • .Randy Lattu, 8675 Upper 206t" Street, stated he opposes the 2071h Street connection. Mayor Johnson recessed the meeting at 8:17 p.m. and reconvened at 8:25 p.m. Christine Mondus, Executive Director of the Downtown Lakeville Business Association (DLBA), read a letter from Scott Erickson of Ben Franklin dated August 20, 2001. Ms. Mondus also read a Position Statement by the DLBA in support of direct access between the Village Creek development and the downtown. commercial district. Ed Mako, 8455 207t" Street, stated he objects to school busses using 207t" Street to get to the Village Creek neighborhood. He pointed out that the City's plans and ordinances are not written in stone and-,are subject to change. He stated he feels. that the four block section of 207t" Street east of Holyoke .Avenue does not fit the criteria for a minor collector street, • given the existing setbacks.. He suggested that those four blocks of 207t" Street, along with other streets within the Village Creek development, should be removed from minor collector designation. in the City's Transportation Plan. Linda Turpening, 20670 Holt Avenue, stated she and her husband are concerned with safety and aesthetics and are opposed to the extension of 207t" Street. She showed a drawing, prepared by her husband, depicting a possible traffic- calming scenario for 207t" Street and a drawing that showed an alternate four-lane parkway system. She presented written information to the City Council. Todd Bornhauser, Exexutive Director of the. Lakeville Area Chamber of Commerce, read the Chamber's Policy Statement, which supports the road connection through the Village Creek project. Ms. Turpening asked about the east/west connection of bike trails through the Wensmann development. Mayor Johnson. asked Lieutenant Style and Chief Barth for their comments on the 207t" Street connection from a public safety CITY OF LAKEVILLE COUNCIL MEETING AUGUST 20, 2001 PAGE 8 r~ ~J standpoint. Lieutenant Style stated the 207t" Street area is currently not a high accident area.. Fire. Chief Barth encouraged the connection of 207t" Street for emergency access. David Licht, who served as the City's consulting planner for over 25 years, explained that from a planning standpoint, he would consider the property east of the drainage way to literally be a part of the CBD neighborhood. These sub- neighborhoods are simply being interconnected. In reference to this street connection being included in the City's Comprehensive Plan, Mr. Licht explained that. one of the policies of the Comprehensive Plan is to create a hierarchy of streets. Mr. Licht presented a drawing from the 1976 CBD Concept Plan, which shows two access points to the east from downtown. One is 205t" Street and the other is 206t" Street. In 1980 there was a mandated update of the City's entire Comprehensive Plana As part of that, the Gity approved a document that referenced the 1976 plan as being the direction that was to take place for the downtown area. The 1985 CBD Concept Plan shows 2061h Street as the connection to the east. The 1985 plan also includes the area east of the drainage way as part of the Central Business District area. The 1999/2000 plan references 207t" Street as being the likely connection to the east, thus it has been along-standing objective of the City to .connect these two neighborhoods. Mr. Licht pointed out that all of these planning studies have been presented in detail to city officials and to the neighborhoods throughout the past 25 or 26 years. Council Member Bellows asked what would be done with the utility lines on 207t" Street when. the sidewalk, curb and gutter are installed. Mr. Nelson stated they would be relocated within the boulevard between the sidewalk and the curb. Mr. Erickson indicated that, as stated at the neighborhood meetings, the residents would be contacted with respect to the design process prior to construction of the curb, gutter and sidewalk. Council Member Rieb asked about ro'ected traffic atterns. p J p CITY OF LAKEVILLE COUNCIL MEETING AUGUST 20, 2001 PAGE 9 Jeff Bednar of SRF Consulting Group explained that a computer. traffic assignment model was used to developtraffic forecasts for the proposed subdivision. A review was also completed to determine the increase in daily traffic volumes on the adjacent residential streets east of Holt Avenue associated with the proposed development. Based on the analysis, it is concluded that primary access from the proposed development would be on Hamburg Avenue. Secondary access would be on 207tH Street, which is classified as a minor collector. Forecast traffic volumes on this roadway are typical of neighborhood streets. Council Member Rieb asked if the traffic study took into account the fact that 207t" Street would be barricaded for the first three years.. Mr. Bednar stated. that stipulation will help the new neighborhood residents establish their traffic patterns for approximately the first three years. Based on the traffic study, approximately 90% of the trips will have origin destinations other than downtown and will not use 207t" Street... Council. Member Mulvihill stated in .her opinion traffic going downtown from Village Creek would be destination oriented. She feels that the increase in traffic on 207ti" Street will not be as high as some .people think it might be. Council Member Luick asked Mr. Bednar to respond to Mr. Turpening's sketch regarding traffic calming techniques for 207t" Steet. Mr. Bednar explained that this sketch involves a street narrowing, or intersection choker, .which can provide very aesthetically pleasing streetscape. However, based on research and data collection, they have little to no affect on traffic volume and vehicle speed changes. Council Member Luick asked about the original design and the decrease in density. Mr. Mullenbach explained that the original plan contained 265 total dwelling units.. Of those, 103 were single-family. The current plan has 36 single family units. The previous plan showed 162 detached and attached townhomes, • and the current plan has 126. CITY OF LAKEVILLE COUNCIL MEETING AUGUST 20, 2001 PAGE 10 • CounciF Member Luick stated he would feel even more. supportive of this project with the 206t" Street connection for improved public: safety. Council Member Luick asked staff to address the concern by Ms. Turpening regarding the east/west bike corridor. Mr. Mullenbach explained that a sidewalk system on both sides of Street 1 will provide pedestrian access through the entire subdivision to Hamburg Avenue. 01.104 Motion was made by Luick, seconded by Rieb to approve the following with respect to Village Creek: ^ Preliminary plat of 119 single-family lots and 126 townhouse lots ^ Ordinance No. 690 rezoning property from RM-1 to RS-3 ^ Ordinance No. 691 rezoning property from RS-3 to RS-CBD ^ Conditional Use Permit for right of way width of 50 feet in the RM-1 District and construction of a street crossing in the Floodway District Roil call was taken on the motion. Ayes, Mulvihill, Rieb, Luick, Johnson. Nay, Bellows. Council Member Bellows stated he feels the 207th Street connection is being pursued for convenience. He stated he values privacy, and that sense of privacy is going to be cherished more and more as the City grows. He stated 207tH Street is a substandard street, and. he is concerned about snow removal and busses. ITEM 10 Mr. Grossing presented the final plat of The Oaks of Lakevilla, which consists of 29 single-family. lots, 22 single-family detached townhouse lots and six outlots. The subject property is located west of Kenyon Avenue,. north of 1791h Street and east of Keokuk Avenue. The Oaks of Lakevilla preliminary plat. and rezoning were approved by the City Council on July 2, 2001. The final plat is consistent with the approved preliminary plat. In conjunction with the final plat and consistent with past practice, the developer and City staff are requesting the vacation of an existing ponding, drainage and utility easement located within the final plat boundaries. The Planning Commission unanimously recommended approval of the final plat and easement vacation. 01.106 Motion was made by Luick, seconded by Bellows to approve Resolution No. 01-129 approving the final plat of The Oaks of Lakevilla; and Resolution No. 01-130 vacating a public ponding, drainage and utility easement. ITEM 11 Warren Isrealson, representing Progress Land Company, • requested Council approval of the preliminary plat of Wild Meadow Villas. CITY OF LAKEVILLE COUNCIL MEETING AUGUST 20, 2001 PAGE 12 • Mr. Dempsey presented the planning report for Wild Meadow Villas, which consists of 128 single-family detached townhome lots on land located west of Dodd Boulevard and north of 215t" Street. The subject .property is zoned RST-2, Single and Two- Family Residential .District. Mr. Dempsey exp aired that two different builders, Keyland Homes and M.W. ]ohnson Construction, will operate under two separate homeowners' associations. The homeowners' associations will be responsible for maintaining yards, sidewalks, driveways and building exteriors. The Planning Commission recommended approval of the Wild Meadow Villas preliminary plat subject to 12 stipulations. 01.107 Motion was made by Luick, seconded by Mulvihill to approve the preliminary plat of Wild Meadow Villas. Roll call was taken on the motion. Ayes, Bellows, Johnson, Mulvihill, Rieb, Luick. ITEM 12 Bob Weigert of Paramount Engineering requested Council approval of-the preliminary plat of Spring Hill. Mr. Grussing presented the planning report for Spring Hill, which consists of 84 single-family lots and four outlots on .approximately 40 acres of land located south of 185t" Street and west of Ipava Avenue. Spring Hill is located in the Central Area Planned Unit Development, immediately north of the greenway corridor. The project will be developed in two phases.. The first phase of 17 lots reflects the relatively short Length of time between the start of site grading and the end of the 2001 construction season. Phase two will consist of the remaining 67 lots. Mr. Grussing explained that the developer will utilize existing vegetation as much as possible to obtain the required buffer along the lots that abut 185t" Street and Ipava Avenue. The developer will construct a 10-foot wide bituminous .trail on the west side of Ipava Avenue adjacent to the preliminary plat. The segment of the trail located between • Street A and 1851h Street will be constructed with the Phase One development. The trail on the south side of 185th Street CITY OF LAKEVILLE COUNCIL MEETING AUGUST 20, 2001 PAGE 13 • will be constructed when 185t" Street is upgraded to an urban section at a future date. The developer is proposing to construct a greenway corridor trail within: Outlots A and B, which will. be deeded to the City for park dedication purposes. The Planning Commission recommended approval of the Spring Hill preliminary plat subject to 13 stipulations. 01.108:Motion was made by Rieb, seconded by Luick to approve the preliminary plat of Spring Hill.
