TO REPAIR DRAIN TILE ALONG JAGUAR PLACE Proposed Action Staff recommends adoption of the following motion: Move to approve a contract with G.F. Jedlicki Inc. for the repair of drain tile along Jaguar Place. Approval of this agreement enables the repair of a segment of drain tile on Jaguar Place to correct drainage problems. Overview Drain tile was installed along the sides of the property at 16781 Jaguar Place and extends through neighboring properties until it connects with a City owned storm sewer. The drain tile does not appear to be functioning properly and resulted in the property owner experiencing dampness and water intrusion. Based on standing water in the vicinity and the property owner's concerns, the drain tile is thought to be clogged or otherwise blocked as it passes through a property to the north. The solution is to restore the functionality of the drain tile on the north and south sides of the property. The City solicited repair proposals from eight companies with expertise in the installation and repair of drain tile. Only one company responded with a proposal; the seven others either indicated they were too busy to take on additional work or were not responsive. The single proposal was from G.F. Jedlicki Inc. in the amount of $37,625.00. Staff has reviewed the proposal and recommends approval of this contract. Primary Issues to Consider • Is the repair necessary? Yes, the City is bound by a settlement agreement established through the courts to proceed with the repair based on project costs. Petree Public Works Director Financial Impact: $37,625 Related Documents (CIP, ERP, etc.): Notes: Budgeted: No Source: Municipal Reserve Fund CONTRACT FOR CONSTRUCTION THIS AGREEMENT, made and entered into as of the 16th day of June, 2014, by and between the City of Lakeville, a municipal corporation under the laws of the State of Minnesota, hereinafter called the "Owner." and G.F. Jedlicki, Inc., hereinafter called the "Contractor." WITNESSETH: That in consideration of their mutual covenants and agreements as hereinafter set forth, the Owner for itself and the Contractor for itself, its successors, and assigns, covenants and agrees as follows, to wit: The Contractor agrees to furnish all the necessary materials, labor, use of tools, equipment, plant and every other thing necessary to perform the work designated and referred to in this Contract, including all Contractor's superintendence, and to furnish everything necessary for the completion of the improvement which is the subject of this Contract (except such things as the Owner has specifically agreed to provide, according to the Contract Documents); and agrees to the amount of Thirty -Seven Thousand Six Hundred Twenty -Five and 00/100 Dollars ($37,625.00) to perform and complete the work shown in the plans and drawings, entitled "Jaguar Place Draintile," prepared by WSB & Associates, Inc. and dated May, 2014. The Contractor agrees that performance shall be in accordance with the terms, requirements and conditions of this instrument, and laws of the State of Minnesota, and the following documents. REQUESTS FOR QUOTES for said Jaguar Place Draintile Improvements for the Owner. PROPOSAL by the Contractor, presented to the Council of the Owner on June 5, 2014, and accepted by the Owner on June 16, 2014. PLANS AND DRAWINGS for said Jaguar Place Draintile Improvements as identified in a preceding paragraph of this Contract and which are dated May, 2014. ANY ADDENDA to the plans, drawings, general conditions and specifications for said Jaguar Place Draintile Improvements which addenda were prepared by WSB & Associates, Inc. PUBLIC CONTRACTOR'S SURETY BOND in the principal sum of the amount bid. Each and all of the aforementioned Contract Documents are hereby incorporated into this Contract by specific reference and the terms and provisions thereof are and constitute a part of this Contract as though attached hereto or fully set forth herein. The Owner agrees to pay the Contractor for the performance of this Contract and the Contractor agrees to accept in full compensation therefor, the sums set forth within the aforementioned proposal of the Contractor for each unit and each type of unit of work to be performed. It is understood and agreed that the said proposal is for the construction of said Jaguar Place Draintile Improvements on a unit price basis in accordance with the said proposal, and that sum of $37,625.00 as set out in said proposal, is the sum of the unit prices, multiplied by the estimated quantities of the respective units of work listed therein. Eight (8) area contractors were contacted with a request for quotes. One (1) quote was received. Three of the contractors contacted indicated they were too busy to provide quotes for additional work; one contractor indicated they could not complete the work without subs; and the three remaining contractors did not supply quotes despite multiple attempts to solicit estimates for the work. The quote received was checked for mathematical accuracy and tabulated. Please find enclosed the bid tabulation indicating the low bid as submitted by G.F. Jedlicki, Inc. of Eden Prairie, MN, in the amount of $37,625.00. We recommend that the City Council consider this quote and award a contract in the amount of $37,625.00 to G.F.
