2014/2015 Liquor License Renewals

Proposed Action
Staff recommends adoption of the following motion: Move to grant on -sale liquor, club liquor,
wine and 3.2% malt liquor licenses effective July 1, 2014 to Tune 30, 2015
Passage of this motion will allow the establishments listed on the attached spreadsheet to continue
the sale of liquor, wine, and 3.2 beer from July 1, 2014 to June 30, 2015.
Overview
All liquor licenses expire on June 30th. Renewal application packets and invoices for the annual
license fee were mailed to each license holder. Applications were reviewed by the City Clerk and
Police Department, and a spreadsheet documenting pertinent information is attached. Several
businesses have obtained a caterer's permit from the State of Minnesota, Alcohol & Gambling
Enforcement Division. This permit allows them to cater alcoholic beverages, along with food, to an
off-site event. Three establishments, Babe's, Brunswick and Carbone's, currently have the optional 2
a.m. closing license from the State of Minnesota. There are 12 establishments with outdoor patios.
Also attached is a letter from Alejandro Castro, the owner of El Patio Mexican Restaurant. He is
asking the City Council to allow him to make two partial payments toward the license renewal fee of
$5,700.

Analysis of Primary Issues
The City Code states, "The annual license fee for the renewal of an existing license shall be paid
prior to the expiration of the existing license." Up until 2008, the City Code did allow for partial
payments of liquor license fees; however that practice was discontinued by ordinance.
Recommendation: City Council approval of the on -sale liquor license for El Patio Mexican
Restaurant. The issue of whether or not to accept partial payments will be brought forward at a
future City Council work session.

City Council,
All of the applications for liquor licenses renewals have been reviewed at this time. The Police
Department looked into each establishment for the past 12 months and found nothing that would
hinder any establishments in receiving a renewal. The Police Department recommends approval
for all applicants based upon these background investigations.

Honorable Citgo Council of Lakeville,
The purpose of this letter is to request the city council to consider our petition of making two partial
payments towards the Liquor licenses renewal fees. We took the liberty to submit half of the payment
with the application, and if approved, we will be sending the remaining balance in December 31,2014.
The reasoning behind our request is base on two reasons:
1.- El Patio Mex- hest is considering to close this location. This decision will be base on the restaurant's
performance in the following months.
2.- El Patio Mex -Rest is short on cash flow, at this moment.
El Patio's last year liquor sales were $95,611. This amount is approximately 23% of Total Sales. If we
compare the Total Liquor sales with the Liquor license fees, you will learn that we are paying
approximately 5.96% of liquor sales towards our liquor license fees only.
Now, you may ask, why is it still open? This is possible thanks to our Landlord & employee's
understanding of our situation. They have been more than willing to sacrifice time and money in order
to keep this location open, based in the belief that one day our economy will turn around, and that we
will experience new business and housing around the area.
Even though the restaurant is not profitable, I believe that it would be a shame to close this restaurant.
Throughout all this years, God has giving me the opportunity and the blessing to meet a lot of great
people in this community. Therefore, the toughs of closing this location, it seems to me that I am not
only letting down my landlord & employee's generosity but our customer's support as well.
In conclusion, I am asking the city counsel to consider my petition and encourage them to find ways how
liquor licenses fees will not be a burden to small businesses in this community.
