HomeMy WebLinkAboutItem 04Memorandum To: Mayor and City Councilmembers Steve Mielke, City Administrator From: Brenda Visnovec, Liquor Manager CC: Police Chief, Jeff Long Lieutenant, Jason Polinski Date: June 12, 2014 Subject: Chemical Prevention Specialist BACKGROUND: Item #4 City of Lakeville Liquor Department Lakeville Liquors has had a long and well established position of supporting chemical awareness and prevention programs within the schools. Beginning in 1984 the city began committing a portion of the liquor store profits to support DARE and Project Northland initiatives. In 1997, due to levy limits established by the State Legislature, a resolution was passed by City Council to cease any financial assistance provided for chemical awareness in the schools. In the early 2000's former Police Chief, Steve Strachan brought forward a proposal and agreement between the City of Lakeville and ISD 194 that was approved by City Council. The agreement initiated a cost share program for the salary and expenses for School/Community Prevention Specialist position within schools. The cities share was to be 33% of the employee costs, the school district pays the remaining portion. The most recent contract was approved in 2010. This provided reimbursement to the school district in the amount of $1,527 per month or $18,324 annually for the 2009/2010 school year, and $1,555 per month or $18,660 per month 2010/2011. The contract was established to automatically renew for successive annual terms unless terminated by either party, or any increase in the City's cost were to incur. The school district is now requesting an increase to $26,055 per month, a 39.6% increase over the existing terms for the 2013/2014 school year, and to $26,598 for the 2014/2015 school year. The Chemical Prevention Specialist, Judy Johnson will be on hand to provide a summary of accomplishments since the last city council review was conducted in 2011, as well as upcoming goals. Lakeville Chief of Police, Jeff Long has reviewed the proposed agreement and strongly supports the initiative. He has further assigned Police Lieutenant, Jason Polinski in overseeing and reviewing this initiative, in part to the lieutenant's familiarity and relationship with the school district. A copy of recommended changes has been reviewed by all parties and a red lined version of the agreement is attached for council review. STAFF RECOMMENDATIONS: Forward for approval the School/Community Prevention Specialist Agreement as attached to the July 7, 2014 City Council meeting. Attachments: Redlined Version of Service Agreement Breakdown of Budget and Expenses SCHOOL/COMMUNITY PREVENTION SPECIALIST AGREEMENT THIS AGREEMENT, entered into this 3rd day of June, 2014 by and between the CITY OF LAKEVILLE, a municipal corporation ("City") and the INDEPENDENT SCHOOL DISTRICT NO. 194 ("District"). RECITALS The City and District desire to join in a mutual effort to reduce chemical abuse in the entire community, especially among young people, and to formulate and communicate a strong, simple and consistent message. NOW THEREFORE, IN CONSIDERATION OF THEIR MUTUAL COVENANTS THE PARTIES AGREE AS FOLLOWS: 1. PURPOSE. Delineate the responsibilities of the respective parties to this Agreement with regards to the School/Community Prevention Specialist. 2. SCHOOL/COMMUNITY PREVENTION SPECIALIST. A. JOB DESCRIPTION. The job description for the School/Community Prevention Specialist will be developed by the District in consultation with the City. B. EMPLOYEE. The School/Community Prevention Specialist shall be a District employee. The District shall be responsible for all costs associated with the position except as specifically provided herein. 3. SELECTION. The School/Community Prevention Specialist will be selected by the District in consultation with the City. 4. SCHOOL SCHEDULE. The School/Community Prevention Specialist's performance of duties under this Agreement shall commence as determined by the School District. 5. PROGRAM REVIEW AND DIRECTION. The Districts Director of Teaching and Learning Services and the Qty's °^'*r^' hief Investigations Lieutenant of the Lakeville Police Department shall conduct annual program reviews of the School/Prevention Specialists program, and provide overall direction. 6. SUPERVISION. The School/Community Prevention Specialist shall report to the District's Director of Teaching and Learning Services. The City's Pelie Chita # Investigations Lieutenant shall provide input to performance and expectations to the Districts Director of Teaching and Learning Services and the School/Community Prevention Specialist shall lie with the District policies and procedures. The School/Community Prevention Specialist will be considered an employee of ISD 194 and be employed in accordance with the District's policies and procedures. 7. Term. This agreement shall be for a term commencing July 1, 2009 2013 through June 30, 204415. The agreement shall be automatically renewed for successive annual terms, unless terminated by either party giving the other party at least 90 days written notice of its decision to terminate the Agreement prior to the commencement of a term. 8. REUMBURSABLE COSTS. The School District agrees to pay 67% and the City agrees to pay 33% of the costs, not to exceed $152:7 $2,172 per month for 20094019 2013-2014. The School District agrees to pay 67% and the City agrees to pay 33% of the costs not to exceed =5 $2,217 per month for '^ 2014-2015. The allowable costs within the payment are enumerated below. Any increase in the City's cost for subsequent terms must be agreed by both parties no later than 90 days before the start of the term. A. Salary C. Health and Dental Insurance D. Life Insurance E. The District will bill the City for the amount provided above on a FR91qthly annual basis in the month of May of each school year. 10. INDEMNIFICATION BY DISTRICT. The District shall indemnify and hold harmless and defend the City, its elected officials and employees against any and all liability, loss, costs, damages, expenses, claims or sustain, incur or be required to pay, arising out of or by reason of any employees including the School/Community Prevention Specialist, in the execution, performance or failure to adequately perform the District's obligations pursuant to this Agreement. The City acknowledges that the District's obligations under this section are subject to, and limited by, applicacable laws and rules, including the statutes for the State of Minnesota.
