BACKGROUND:
City of Lakeville

City Council reviewed the Chemical Prevention Specialist Service Agreement at the June 23, 2014
Council Work Session. The entire council was on board and solid in their belief that this program is
extremely beneficial to the community; however, there was debate surrounding the increased
costs within the agreement. The rate increase as proposed was primarily due to a benefit package
being extended to the employee. Council Member Anderson requested that this value be
reviewed one final time to be accurate. Council Member LaBeau suggested that this become a
fixed dollar amount so that the City would not be affected by increases or changes to benefits that
are often difficult to predict a year in advance. Council Member Swecker also recognizes the value
of the program, but was wondering if Pure Performance could be modified to become more
impactful. Mayor Little questioned if enough was being done to address the growth of heroin.
Needless to say, this meeting led to more questions than answers. After taking some time to
reflect, the Liquor Department staff would like to revise their recommendation to approve the
agreement in the manner that it was previously presented.
According to NIDA (National Institute of Drug Abuse), as of 2012, alcohol remains the most abused
drug in the United States with social and economic impacts of $185 billion dollars per year.
Alcohol alone has a larger impact on the population than does marijuana, cocaine, meth,
prescription drugs, inhalants, bath salts and heroin combined.
The NIDA also provides 16 core principles for chemical prevention programs of which it can be
strongly stated that the school's chemical awareness program meets or exceeds. But the most
impactful statement that the NIDH made was that recent research shows that for each dollar
invested in prevention, a savings of up to $10 in treatment for alcohol or other substance abuse
can be seen (Aos et al. 2001; Hawkins et al. 1999; Pentz 1998; Spoth et al. 2002a; Jones et al. 2008;
Foster et al. 2007; Miller and Hendrie 2009).
HISTORY:
In 1983 the Lakeville City Council approved a resolution stating that 10% of all net liquor income
should be issued to all three school districts (based on student resident capita percentage) for
chemical prevention.
This continued for 14 years until 1997 at which time it was determined that because of changes in
levy limits, the city could no longer support this endeavor. The final check issued to the schools for
the program totaled $40,870.
In 2006, Police Chief Steve Strachan reestablished the program in a manner that the city would pay
33% of the Chemical Prevention Specialists position, while the school district pays 66%. These
fees were a total of $8,856 in 2006, which was for half of the school year. From 2007 through 12
the annual payment was $18,660.
In the 2011-12 school year, the school provided the city an invoice for a higher value than the
contract term allowed. In speaking with administration and finance employees in the school, it
was agreed that the portion paid for by the City would need to remain intact until such time they
could provide an updated contract proposal.
The City's current portion per the agreement is 33% of the salary not to exceed $18,660 annually.
The school district's original request was for $26,056 for the 2013-14 school year, and $26,598 for
the 2014-15 school year.
Per Council Member Anderson's request, the school district verified the information and
discovered that the cost for 2014/2015 was accurate, but that 2013/2014 would only be $24,516.
STAFF RECOMMENDATIONS:
Liquor Department staff recommends that we redesign the service agreement with the school
district paying a set value of $25,000. This contract would run through the 2018-19 school year
unless either party provides the other a 30 -day notice of cancelation, prior to the beginning of the
school year.
While $25,000 is slightly higher than proposed estimates provided by the school district for the
2013-14 school year, it is less than they were requesting for 2014-15. By establishing the fixed
value, it prevents the City from being vulnerable to escalating health care costs, of which we have
no control over.
This topic and contract have been reviewed with Police Chief Jeff Long who agrees with the
recommendations with the stipulations as noted.

SCHOOL/COMMUNITY PREVENTION SPECIALIST AGREEMENT
THIS AGREEMENT, entered into this day of August, 2014 by and
between the CITY OF LAKEVILLE, a municipal corporation ("City") and the
INDEPENDENT SCHOOL DISTRICT NO. 194 ("District").
RECITALS
The City and District desire to join in a mutual effort to reduce chemical
abuse in the entire community, especially among young people, and to formulate
and communicate a strong, simple and consistent message.
NOW THEREFORE, IN CONSIDERATION OF THEIR MUTUAL COVENANTS
THE PARTIES AGREE AS FOLLOWS:
1. PURPOSE. Delineate the responsibilities of the respective parties to this
Agreement with regards to the School/Community Prevention Specialist.
2. SCHOOL/COMMUNITY PREVENTION SPECIALIST.
A. JOB DESCRIPTION. The job description for the School/Community
Prevention Specialist will be developed by the District in consultation
with the City.
B. EMPLOYEE. The School/Community Prevention Specialist shall be a
District employee. The District shall be responsible for all costs
associated with the position except as specifically provided herein.
3. SELECTION. The School/Community Prevention Specialist will be selected
by the District in consultation with the City.
4. SCHOOL SCHEDULE. The School/Community Prevention Specialist's
performance of duties under this Agreement shall commence as
determined by the School District.
5. PROGRAM REVIEW AND DIRECTION. The Districts Director of Teaching
and Learning Services and the City's o^'ie-e Chief Investigations Lieutenant
of the Lakeville Police Department shall conduct semi annu annual
program reviews of the School/Prevention Specialists program, and provide
overall direction.
6. SUPERVISION. The School/Community Prevention Specialist shall report to
the District's Director of Teaching and Learning Services. The City's o^Iic
Ch+e# Investigations Lieutenant shall provide input to performance and
expectations to the Districts Director of Teaching and Learning Services and
the School/Community Prevention Specialist shall lie with the District
policies and procedures. The School/Community Prevention Specialist will
be considered an employee of ISD 194 and be employed in accordance with
the District's policies and procedures.
7. Term. This agreement shall be for a term commencing, 2009 2014 through
June 30, 20441.9. The agreement shall be automatically renewed for
successive annual terms, unless terminated by either party giving the other
party at least 90 days written notice of its decision to terminate the
Agreement prior to the commencement of a term.

harmless and defend the City, its elected officials and employees against
any and all liability, loss, costs, damages, expenses, claims or sustain, incur
or be required to pay, arising out of or by reason of any employees
including the School/Community Prevention Specialist, in the execution,
performance or failure to adequately perform the District's obligations
pursuant to this Agreement. The City acknowledges that the District's
obligations under this section are subject to, and limited by, appliEacable
laws and rules, including the statutes for the State of Minnesota.
IN WITNESS WHEREOF, the parties have caused this instrument to be
executed by the respective officers thereof and the respective seals to be
affixed thereto.
