APPROVAL OF SCHOOL/COMMUNITY PREVENTION
SPECIALISTAGREEMENT WITH ISD #194
Proposed Action
Staff recommends adoption of the following motion: Move to approve School/Community
Prevention Specialist Agreement with ISD #194.
Passage of this motion will result in a continued joint partnership between the school district
and the city. It will provide for a chemical prevention specialist in the schools as a means to
reduce and prevent alcohol and chemical abuse within the community.
Overview
According to the National Institute of Drug Abuse, as of 2012, alcohol remains the most
abused drug in the U.S., with social and economic impacts of $185 billion dollars annually.
Research has proven the programs that invest in prevention result in a dramatic savings in
alcohol treatment and abuse.
The city has had a long standing agreement with ISD #194 to provide financial support
towards chemical prevention programs in the schools. The attached agreement, while
revised in format, continues and extends this critical partnership.
Staff is recommending the approval of the agreement which reflects incremental increases
over the next three years as a means in which to provide support towards the chemical
preventions specialist's position.

• What are the revisions to the agreement?
The most recent service agreement was based on a percentage of the position with the city's
portion being $18,660. Because of changes in the schools union contracts and level of
benefits issued to this position, the city's proposed portion was to increase from $18,660 to
$24,516, or 31% for the 2013/2014 without notice and beyond what the agreement provided.
While the city strongly affirms that increases in the contract are necessary, they felt that the
city could not absorb this full amount without more advance noticed. Also, to ensure that
there is an established value to use for city budgeting purposes, the agreement has been
amended to be a flat annual rate, rather than a percentage of the position's salary.
The increases per the agreement are as follows:
2013/2014 School Year - $20,000
2014/2015 School Year - $21,500
2015/2016 School Year - $23,000
2015/2016 School years through 2018/2019 School Years - $25,000
How is the effectiveness of this program monitored by the city?
Changes under the agreement will place the Investigations Lieutenant, Jason Polinski in
charge of providing input to the performance and expectations to the School District's
Director of Teaching and Learning Services. Lieutenant Polinski is a good candidate for
overseeing this program due to his long term knowledge and relationship with the schools
chemical prevention specialist and program.
SCHOOL/COMMUNITY PREVENTION SPECIALIST AGREEMENT
THIS AGREEMENT, entered into this 18th day of August, 2014 by and
between the CITY OF LAKEVILLE, a municipal corporation ("City") and the
INDEPENDENT SCHOOL DISTRICT NO. 194 ("District").
RECITALS
The City and District desire to join in a mutual effort to reduce chemical
abuse in the entire community, especially among young people, and to formulate
and communicate a strong, simple and consistent message.
NOW THEREFORE, IN CONSIDERATION OF THEIR MUTUAL COVENANTS
THE PARTIES AGREE AS FOLLOWS:
1. PURPOSE. Delineate the responsibilities of the respective parties to this
Agreement with regards to the School/Community Prevention Specialist.
2. SCHOOL/COMMUNITY PREVENTION SPECIALIST.
A. JOB DESCRIPTION. The job description for the School/Community
Prevention Specialist will be developed by the District in consultation
with the City.
B. EMPLOYEE. The School/Community Prevention Specialist shall be a
District employee. The District shall be responsible for all costs
associated with the position except as specifically provided herein.
3. SELECTION. The School/Community Prevention Specialist will be selected
by the District in consultation with the City.
4. SCHOOL SCHEDULE. The School/Community Prevention Specialist's
performance of duties under this Agreement shall commence as
determined by the School District.
5. PROGRAM REVIEW AND DIRECTION. The District's Director of Teaching
and Learning Services and the Investigations Lieutenant of the Lakeville
Police Department shall conduct annual program reviews of the
School/Prevention Specialist's program, and provide overall direction.
6. SUPERVISION. The School/Community Prevention Specialist shall report to
the District's Director of Teaching and Learning Services. The Investigations
Lieutenant shall provide performance and expectation feedback to the
District's Director of Teaching and Learning Services. The
School/Community Prevention Specialist shall comply with the District
policies and procedures. The School/Community Prevention Specialist will
be considered an employee of ISD 194 and be employed in accordance with
the District's policies and procedures.
7. Term. This agreement shall be for a term commencing, 2014 through June
30, 19. The agreement shall be automatically renewed for successive
annual terms, unless terminated by either party giving the other party at
least 90 days written notice of its decision to terminate the Agreement
prior to the commencement of a term.
8. REUMBURSABLE COSTS. The City agrees to pay fixed costs of $20,000 for
the 2013-2014 school year, $21,500 for the 2014/2015 school year, $23,000
for the 2015/2016 school year and then $25,000 annually through the
through the 2018-2019 school years.
9. BILLING. The District will bill the City for the amount provided above on an
annual basis in the month of May of each school year.
10. INDEMNIFICATION BY DISTRICT. The District shall indemnify and hold
harmless and defend the City, its elected officials and employees against
any and all liability, loss, costs, damages, expenses, claims or sustain, incur
or be required to pay, arising out of or by reason of any employees
including the School/Community Prevention Specialist, in the execution,
performance or failure to adequately perform the District's obligations
pursuant to this Agreement. The City acknowledges that the District's
obligations under this section are subject to, and limited by, applicable laws
and rules, including the statutes for the State of Minnesota.
IN WITNESS WHEREOF, the parties have caused this instrument to be
executed by the respective officers thereof and the respective seals to be
affixed thereto.
