The attached Report provides fee history, comparison with other cities (or other entities if appropriate), recommendations, potential budget impact and other relevant information. Utility fees will be presented to the City Council in the coming weeks. If the Council concurs with the proposed fee schedule, staff would recommend an implementation plan that provides public notification as shown below • Council deliberation of fee structure September 22 and 29 • Public information initiatives October and November • Approval of fee schedule December 1. The two -tier structure was first established in 1997 as follows: Annual sales of $375,000 or less of alcoholic beverages $3,600 Annual sales of more than $375,000 of alcoholic beverages $4,500 In 2006, the fees were raised as follows: Annual sales of $375,000 or less of alcoholic beverages $5,500 Annual sales of more than $375,000 of alcoholic beverages $6,500 In order to qualify for the lower fee, license holders must submit a copy of their Minnesota State Sales Tax Report for the previous 12 -month period. The following establishments qualify for the lower fee: • Chart House • Copper River • Crystal Lake Golf • El Patio • Goodfella's • Lakeville Family Bowl • Sawa Japan Steakhouse 21 Based on the reports submitted, annual liquor sales from these seven establishments ranged from $309,378 to $68,501. The City Code also states, "On -Sale Liquor License ": "On- sale" intoxicating liquor license shall be issued only to restaurants whose gross food and beverage receipts of the restaurant are at least fifty percent (50 %) attributable to the sale of food. This requirement pertains to those restaurants receiving an initial license on or after January 1, 2005, and shall be regulated as follows: This requirement applies to the following establishments: • Brunswick Zone XL- Lakeville • Buffalo Wild Wings • El Patio Mexican Restaurant • Goodfellas Bar & Grill • Copper River • Porter House Steak & Seafood • Rudy's Redeye Grill • Sawa Japan Steakhouse & Sushi Based on the reports submitted, annual liquor sales from these eight establishments range from $690,164 to $68,501. Recommendation: Amend the City Code to provide a three -tier fee structure for on -sale liquor licenses.
