PLANNING COMMISSION MEETING MINUTES
September 18, 2014
Chair Lillehei called the meeting to order at 6:00 p.m. in the Council Chambers at City
Hall. The pledge of allegiance to the flag was given.
Members Present: Chair Brooks Lillehei, Vice Chair Bob Boerschel, Linda Maguire,
Jason Swenson, Karl Drotning, Paul Reuvers, ex -officio member Nic Stevens

3. Approval of the Meeting Minutes
The September 4, 2014 Planning Commission meeting minutes were approved as
presented.
4. Announcements
Mr. Morey stated that the following items were distributed to the Planning
Commission prior to tonight's meeting.
1. September 17, 2014 Parks, Recreation and Natural Resources Committee draft
minutes regarding the Feldman Heights and FedEx Lakeville preliminary plats.
2. Revised site plan for Parkview Elementary School.
Mr. Morey commented that new Planning Commissioner Pat Kaluza is attending
tonight's meeting as an observer and will be sworn in at the October 2nd meeting.
Mr. Morey reminded the Planning Commission of the work session immediately
following tonight's meeting.
5. Independent School District 196
Chair Lillehei opened the public hearing to consider the application of ISD 196 for a
Conditional Use Permit amendment to allow the construction of an addition to the
Parkview Elementary School building, located at 6795 Gerdine Path.
Shane Butler, Project Manager with Bossardt Corporation and Dave Ray, Civil
Engineer for the project were in attendance at tonight's meeting. Mr. Ray presented
a brief overview of the request.

Associate Planner Kris Jenson presented the planning report. Ms. Jenson stated
that the proposed expansion to the Parkview Elementary School building will include
a 13,300 square foot expansion to the north side of the building over the existing
playground area. She indicated that the project also includes a remodeling of the
kitchen and multi-purpose room on the east side of the building, but there are no
changes to the exterior wall.
Ms. Jenson stated that with the proposed building addition, the capacity of the
school will increase to 1,000 students, requiring 31 additional parking spaces. The
entire site will include 149 vehicle spaces and nine bus parking spaces, which
exceeds Zoning Ordinance requirements.
Ms. Jenson indicated that the existing playground will be relocated to the south and
west of its current location due to the proposed building addition. She indicated
where new trail and sidewalk connections will be provided and commented that they
will be shifted closer to the school and the drop-off/pick-up areas.
Ms. Jenson described the proposed exterior building materials for the addition,
which are described in detail in the September 9, 2014 planning report. She
indicated that the proposed materials will match the existing building and will meet
the requirements of the Zoning Ordinance.
Ms. Jenson stated that Stipulation 4 regarding staffs recommendation for additional
plantings between the proposed building addition and the north property line in an
effort to provide screening of the building from the single family homes to the north
has been satisfied prior to tonight's meeting with revised plans dated September 17,
2014.
Ms. Jenson stated that staff recommends approval of the Parkview Elementary
School CUP subject to the remaining 4 stipulations listed in the September 9, 2014
planning report.
Chair Lillehei opened the hearing to the public for comment.
There were no comments from the audience.
Motion was made by Boerschel, seconded by Maguire to close the public
hearing at 6:10 p.m.

Chair Lillehei asked for comments from the Planning Commission. There was no
discussion by the Planning Commission.
Motion was made by Maguire, seconded by Drotning to recommend to City
Council approval of the Parkview Elementary School Conditional Use Permit
amendment to allow an expansion to the Parkview Elementary School building,
subject to the following four stipulations:

1. The site plan and building addition shall be developed in accordance with the
plans approved by the City Council.
2. The construction shall be completed in accordance with the approval of the
Fire Marshal.
3. A building permit is required prior to commencing construction.
4. Any new building or parking lot lighting shall meet the requirements of the
Zoning Ordinance and must be consistent with the lighting currently on site.
A photometric plan must be approved by the Planning Department and
electrical permits issued prior to installation of any additional lighting on the
site.

6. Feldman Heights
Chair Lillehei opened the public hearing to consider the application of JAFCO, LLC
for a preliminary plat of 25 single family residential Tots to be known as Feldman
Heights, located east of Dodd Boulevard (CSAH 9) and north of 190th Street.
Randy Hedlund, Civil Engineer for Feldman Heights presented a brief overview of
their request.
Associate Planner Kris Jenson presented the planning report. Ms. Jenson indicated
that all of the lots in the Feldman Heights preliminary plat meet the lot area
requirements of the RST -2 District and the proposed house pads have adequate
building pad areas that meet setback requirements for principal structures. She
stated that two lots abutting Dodd Boulevard (CSAH 9) require increased buffer yard
lot depth and setbacks. The landscape plan includes the installation of 32 trees
within the Dodd Boulevard buffer yard area.
Ms. Jenson stated that there is one outlot in the Feldman Heights preliminary plat.
Outlot A consists of a stormwater management basin and a greenway corridor trail
that will be deeded to the City with the final plat. Ms. Jenson indicated that a
bituminous trail will be extended from the existing trail in Outlot A, Chokecherry Hill
2nd Addition to 187th Street in Feldman Heights.
Ms. Jenson reviewed the proposed streets in the Feldman Heights preliminary plat.
She indicated that the developer must install a barricade and future street extension
sign at the north end of Iden Avenue to notify the owners of lots adjacent to this
street that the street will be extended with the future development of the adjacent
property to the north.
Ms. Jenson stated that there is an easement shown on the boundary survey in the
City's favor but is for a Dakota County roadway (Dodd Boulevard) so staff is working
with the County to determine what steps need to be taken to vacate the easement.

Ms. Jenson indicated that the developer has submitted a ghost plat showing single
family Tots and the future extension of roads to the north on the adjacent property,
along with the eastern extension of 185th Street (CSAH 60).
Ms. Jenson stated that staff recommends approval of the Feldman Heights
preliminary plat subject to the 12 stipulations listed in the September 10, 2014
planning report.
Chair Lillehei opened the hearing to the public for comment.
There were no comments from the audience.
Motion was made by Drotning, seconded by Swenson to close the public
hearing at 6:17 p.m.

Chair Lillehei asked for comments from the Planning Commission. Discussion
points included:
• Commissioner Drotning discussed the challenge of designing a subdivision
on this property, given that no access is allowed to Dodd Boulevard (CSAH
9), and the reasoning behind the proposed cul-de-sacs. This is not a typical
design for a single family development.
• Commissioner Maguire asked why out of the 67 significant trees listed, none
of them were being saved. Ms. Jenson explained that the trees are located
primarily around the existing home on the site. With the grading proposed for
the site, the developer determined it was not feasible to keep any of the trees.
• Commissioner Boerschel questioned the odd point at which the trail on the
east end of the plat is terminating. Mr. Jenson explained that there is an
option that the trail could be extended into the wooded area to the east of the
plat in the future.
Motion was made by Drotning, seconded by Swenson to recommend to City
Council approval of the Feldman Heights preliminary plat of 25 single family
residential lots, located east of Dodd Boulevard (CSAH 9) and north of 190th Street,
subject to the following 12 stipulations:
1. Implementation of the recommendations listed in the September 11, 2014
engineering report.
2. The recommendation of the Parks, Recreation, and Natural Resources
Committee.
3. All houses shall meet the following minimum setback requirements of the
RST -2 District:
Front Yard — 20 feet to the principal building; and 25 feet to the face of the
garage.
Rear Yard — 30 feet
Buffer Yard — 50 feet

Side Yards:
Interior — 7 feet
Corner — 20 feet
4. All new local utilities and any existing overhead service utilities shall be
placed underground.
5. Park dedication shall be satisfied through a combination of land dedication
and cash contribution with the final plat.
6. The developer shall construct a 5 foot wide concrete sidewalk along the west
side of Iden Avenue and shall construct a bituminous trail from the existing
trail in Outlot A, Chokecherry 2nd Addition to 187th Street. The developer shall
submit a cash escrow with the final plat for future trail construction on the east
side of Dodd Boulevard.
7. Demolition of the exiting home and accessory building shall require a
demolition permit from the City Building Official prior to removal.
8. The existing septic system and wells within the plat area shall be
removed/abandoned in compliance with state and local requirements.
9. Outlot A shall be deeded to the City with the final plat.
10. Buffer yard landscaping shall be installed according to the approved
landscape plan. A security for the buffer yard landscaping and sodding shall
be submitted with the final plat.
11.Any subdivision signs must be located within an outlot owned and maintained
by a homeowners association.
12. The developer shall install a barricade and "Future Street Extension" sign at
the north extension of Iden Avenue.

7. FedEx Lakeville
Chair Lillehei opened the public hearing to consider the application of Design
Structures, LLC, representing FedEx Freight, for the following, located south of 215th
Street (CSAH 70) and east of Dodd Boulevard (CSAH 9):
A. Preliminary plat of one lot and two outlots to be known as FedEx Lakeville.
B. Conditional Use Permit to allow an exception to the industrial district exterior
material provisions.
Rob Sangdahl, Fred and Brett Setzer from Setzer Properties, Mike Kevich from
FedEx Freight, Kevin Teppen from Westwood, Brad Koning from Shulfer Architects
and Jim Anderson from Design Structures were in attendance at tonight's meeting.
Mr. Sangdahl presented a brief overview of their request. He indicated that Setzer
Properties is the owner and developer of this project and FedEx Freight will be the
tenant. He explained that they were requesting a CUP for an exception to the
industrial district exterior building material requirements. They are requesting this
due to the uniqueness and design/function of the warehouse building. Mr. Sangdahl
indicated that they are proposing the use of prefinished, textured, insulated metal
panels that can just be unbolted and replaced much easier than the exterior material

listed in the Zoning Ordinance if they are damaged. The panels will also be used on
the warehouse building on the north and east sides to allow for the removal of the
wall for the future expansion.
Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey
stated that Setzer Properties has submitted applications and plans for the
preliminary plat of one lot and two outlots to be known as FedEx Lakeville and a
conditional use permit to allow an exception to the industrial district exterior building
material provisions of the Zoning Ordinance. Mr. Dempsey stated that the project
proposes a two phase development that will include the initial construction and a
future expansion of the trans -load dock facility and vehicle parking areas.
Mr. Dempsey explained that Fed Ex Freight provides delivery services for large
freight which is delivered to and trans -loaded at this dock facility for delivery to other
businesses.
Mr. Dempsey stated that the preliminary plat of FedEx Lakeville includes the
proposed construction of Humboldt Road between 217th Street and 215th Street
(CSAH 70). Humboldt Road is the final road segment to be constructed in the
preliminary and final plat of First Park Lakeville approved in 2008. He indicated that
the existing roads that provide access to Interstate 35 and Cedar Avenue are
capable of accommodating the anticipated traffic generated by this facility. This
determination is supported by the 2013 Update to the 2008 AUAR for the First Park
Lakeville development.
Mr. Dempsey stated that the landscaping and screening plan was designed to
maximize screening of the FedEx property from public right-of-way, while also
accommodating the restrictive maximum height and setback standards set by Great
River Energy for the 115kV electric transmission power line easement along 215th
Street. Landscaping will not be installed within road right-of-way. He described the
proposed landscaping, which is detailed in the September 12, 2014 planning report.
Mr. Dempsey stated that the FedEx buildings will include office, warehouse and a
maintenance shop. A total of 178 parking spaces are proposed to meet the required
minimum of 122 parking spaces in accordance with the Zoning Ordinance. He
indicated that the proposed parking lot design, spaces and drive aisle dimensions
and configurations meet the requirements of the Zoning Ordinance.
Mr. Dempsey indicated that a fuel depot with an overhead canopy and underground
fuel storage will be located 120 feet north and east of the maintenance shop. This
depot will provide fuel for FedEx vehicles only.
Mr. Dempsey stated that a photometric and overall lighting plan has been submitted.
The plans show lighting to be at or less than 1 foot-candle at the property lines as
required by the Zoning Ordinance. All parking lot lights will be downcast type
fixtures. He indicated that lights on the dock building will be flood or similar lights to
illuminate the exterior of the dock facility, which must be downcast to minimize
visibility of the light source from the property line.

Mr. Dempsey stated that the driveways and interior layout provides adequate width
and turning radii to accommodate truck turning movements and emergency vehicle
access.
Mr. Dempsey stated that regarding the Conditional Use Permit request, as Mr.
Sangdahl stated during his review of their request, an alternate exterior building
material is being proposed for the warehouse/trans-load building. He described
what is being proposed and indicated that staff supports the proposed insulated
metal panel construction on the warehouse/trans-load building as a suitable building
material due to the unique characteristics of the building.
Mr. Dempsey stated that staff recommends approval of the FedEx Lakeville
preliminary plat and conditional use permit subject to the 19 stipulations listed in the
September 12, 2014 planning report.
Chair Lillehei opened the hearing to the public for comment.

Motion was made by Reuvers, seconded by Drotning to close the public
hearing at 6:47 p.m.

Chair Lillehei asked for comments from the Planning Commission. Discussion
points included:
• Commissioner Boerschel indicated that he overlooks the subject property
from his home. Commissioner Boerschel asked that the picture he brought
with him to tonight's meeting be shown on the screens in the Council
Chambers for him to reference. He stated that he is concerned about the
amount of landscaping on the north side of the property and suggested a few
possibilities where landscaping could be added, such as the islands east of
the fuel station or further back into the site, to screen the site for his house
and his neighbor's houses. Mr. Sangdahl stated that these locations would
not be feasible from a maneuvering standpoint. They would be navigating
trailers through these areas and it would not be safe having landscaping
within the parking lot. He stated that they need to keep the parking lot and
fuel station area clear of obstructions.
• Mike Kevich from FedEx Freight reiterated to Commissioner Boerschel that
they need to avoid installing trees within the parking area, but FedEx will do
what they can in other areas to help screen the property.
• Commissioner Boerschel asked about the hours of operation. Mr. Kevich
explained that FedEx Freight provides business to business delivery service.
There is no residential delivery proposed from this facility. Their hours of
operation are 24 hours a day, five days a week. Employment with the initial
phase will bring 125 jobs to Lakeville. FedEx Freight is relocating from

Roseville so those employees would be offered jobs first. Mr. Kevich stated
that they are growing rapidly in the Minnesota market. This is their first
opportunity for long term growth. Mr. Kevich stated that FedEx will reexamine
their proposed landscaping and will attempt to address the concerns raised
by Commissioner Boerschel as best they can.
• Commissioner Boerschel asked about truck traffic on County Road 70. Mr.
Dempsey stated that the FedEx Freight facility will produce approximately 444
total vehicle trips per day which is anticipated to include 176 truck trips and
268 employee vehicle trips per 24 hour period. He indicated that this facility
will not add a significant amount of extra traffic to the streets serving the
property.
• Ex -officio member Nic Stevens asked about crime at their facilities and about
FedEx's security system. Mr. Kevich stated that very little crime is typical.
FedEx has an in-house security system and has a security officer on site.
People entering/exiting the site must use a tum -style type system.
• Chair Lillehei asked FedEx to talk again about the exterior building materials
they are proposing. Mr. Sangdahl showed the Planning Commission a
sample of what they are proposing to use for the warehouse/trans-load
building and why they consider this to be a better option.
• Confirmed that there will be an underground oil/water separator for the fuel
depot.
• Commissioner Boerschel asked if back-up alarms on the vehicles will be
used. Mr. Sangdahl indicated that they have to use the back-up alarms for
safety reasons and to meet OSHA requirements.
Motion was made by Swenson, seconded by Maguire to recommend to City
Council approval of the FedEx Lakeville preliminary plat of one lot and two outlots
and conditional use permit to allow an exception to the industrial district exterior
material provisions, subject to the following 19 stipulations:
1. Implementation of the recommendations listed in the September 12, 2014
engineering report.
2. Implementation of the recommendations of the Parks, Recreation and Natural
Resources Committee.
3. Implementation of the recommendations of the Dakota County Plat
Commission.
4. The site and buildings shall be developed in compliance with the plans as
approved by the City Council and in accordance with Zoning Ordinance
requirements.
5. The insulated metal panels on the future expansion walls of the warehouse
trans -load building shall be considered temporary until such time as the
building is expanded, whereby, the permanent walls shall meet the
requirements of the Zoning Ordinance at the time of construction.
6. The developer shall remove the electric power transmission line pole from the
Humboldt Road and 215th Street (CSAH 70) intersection right-of-way prior to
or in conjunction with the Humboldt Road intersection and turn -lane
construction.

7. Building exterior materials shall be integral colored masonry only unless
otherwise allowed by the conditional use permit. Painted building exteriors
are not permitted.
8. Any roof -mounted mechanical equipment shall be screened from view of
public right-of-way by an adequate parapet or other similar structure as
required by the Zoning Ordinance.
9. A written cost estimate for the landscape materials and installation shall be
submitted with the final plat. The landscape escrow shall be submitted prior
to release of the final plat mylars. All landscaped areas shall be irrigated with
in -ground irrigation as noted on the landscape plan. Any dead landscaping
shall be promptly replaced to maintain the integrity of the screening and
landscape plan approved by the City Council. Landscaping shall not be
planted in street boulevards. Landscaping greater than 3 feet in height shall
not be placed within the site visibility triangle as described in Zoning
Ordinance Chapter 11-16-15.
10.Outlot B shall be deeded to the City with the final plat.
11.AII signs shall comply with the Zoning Ordinance requirements for the 1-1
District. A sign permit shall be issued by the Planning Department prior to the
installation of any signs.
12.The chain-link security fence shall be installed on the building side of the
landscaping away from the public right-of-way. Barbed wire or concertina
wire fencing is not permitted.
13. Snow storage shall not take place in required parking spaces. If there is not
adequate space to store snow on site, snow must be hauled from the site.
14. Site and building lighting shall be installed consistent with the approved
lighting plan and in compliance with Zoning Ordinance requirements.
15. The building permit plans and site plans must include outdoor trash enclosure
details that comply with Zoning Ordinance requirements. The trash
enclosures shall match the exterior materials of the principal buildings and
shall include maintenance free gates.
16. The maintenance wash bay shall be connected to City sanitary sewer.
17.A sanitary sewer unit determination shall be submitted to the City in
compliance with Metropolitan Council Environmental Services requirements
prior to the issuance of a building permit.
18.The fuel depot must meet building and fire code requirements.
19.The developer shall contact the Federal Aviation Administration (FAA) at least
45 days prior to commencing building construction to determine if a permit is
required for any crane of similar construction equipment on the property.

Nays: Boerschel. He is in favor of the Conditional Use Permit, but has
concerns regarding the screening that is being proposed.
There being no further business, the meeting was adjourned at 7:24 p.m.
The Planning Commissioners immediately went into a work session.
