Mayor Zaun called the meeting to order at 7:00 p.m. Cub Scout
..Pack 265 from Lake Marion Elementary School lead the pledge of
allegiance to the flag.
Rolf call was taken.- Present:. Council Members Johnson, Sindt,
Mulvihill, Luick and Mayor Zaun.

MINUTES
.The minutes of the October 2, 2000 City Council meeting and the
September 13, 2000 special Council meeting were approved as
..presented.

ATTORNEY: None
ENGINEER: Mr. Nelson presented, for Council: consideration
under New Business, a resolution authorizing the placement of
stop: signs on Lpava Avenue at the intersection of Iredell Court to
create an all-way stop intersection.

ADMINISTRATOR: Mr. Erickson asked the Council to consider,
under New Business,. setting a special. Council meeting to
approve plansand specifications and set a bid date for the
Lakeville Area Arts Center/Hart Hall renovation.
CHIEF QF POLICE: Chief Martens presented the September
Police Department monthly report.
PARKS 8v RECREATION DIRECTOR: Mr. Michaud presented the
September monthly report of the. Parks 8v .Recreation Department.

PRESENTATIONS /INTRODUCTIONS
Dakota. County Commissioner Paul Krause and Charlotte Shover,
Dakota County Environmental Education Coordinator,
recognized the City of Lakeville for participating in a Metropolitan.
Council grant program that provided funds. for educational
resources directed at learning about and reducing non-point
source pollution. Tim Brown,. Environmental Resources
Coordinator, accepting a plaque on behalf of the City of Lakeville.
Ron Mullenbach, Associate Planner, presented to the City
Council a Distinguished Planning Award for the City's
communications strategy for the Comprehensive Plan... The
award, which was presented at the. Upper Midwest Regional
Planning Conference, was. earned in -the Public Education
category.
Arlyn Grossing, Community 8v Economic Development Director,.:.
introduced Ann Flad, Economic Development Coordinator.
Mr. Grossing and Ms. Flad presented a proclamation proclaiming
October 16-22, 2000 as Minnesota Manufacturer's Week in=
Lakeville. Mark Hutzler, President of the Lakeville Area Chamber
of Commerce, accepted the proclamation.

Mayor Zaun opened the. public hearing on proposed assessments
for Districts 5 and 6 sealcoating, Improvement Project 00-1. Mr.
Nelson explained. the current City policy of assessing benefited
properties 50% of the cost of sealcoating, overlay. and patching.
The remaining one-half is paid by property tax levies...
Neighborhood streets that are designated collector roadways
would be assessed the cost. of sealcoat even though the roadway
may be milled and overlaid to accommodate higher traffic
volumes. Jacquard Avenue, a major collector between 205 and
210 streets, and 207 .Street, a minor collector east of Holiday
Avenue, were milled and overlaid due to poor conditions. The
City also finances curb and- gutter repair, as well as pedestrian
ramps and catch basin repair.
.The final. project cost came to $567,671.43.. The amount. being
assessed is $197,850.78. The single-family unit assessment is
$123.40, which includes the $4.00 per .parcel Dakota County

special assessment administration fee. Districts 5 and 6
represent completion of the City's second sealcoating cycle.
Mr. Feller stated the project costs are assessed over atwo-year
period at 7.5% interest. Property owners cane prepay .their
assessment within 30 days to avoid paying interest or
administrative costs. He further explained that the City of
Lakeville began the process. of assessing the costs for sealcoating
.about 14 years ago as a result of levy limits being instituted by
the State Legislature.. The City has now completed two seven-
year .cycles. Since the State Legislature has not re-.instituted levy
limits for taxes payable 2001, the 2001 budget proposes that
sealcoating from this point forward be financed through. property
taxes rather than special assessments.
Mr. Knutson explained that anyone who objects to the amount of
the assessment is required. to file a notice of written objection
before the :closing of tonight's public hearing.. This reserves the
property owner's right to begin the process to appeal the
assessment to District Court.

J. Beeson, representing.. George Warweg, 9649 - 202nd Street

Ms. LeNita Johnson, 9949 - 208 Street West, stated she had not
received mailed notification of the sealcoating assessment.
Mr. Erickson explained that notices were sent by the Special
Assessment/Property Data Clerk to each property owner last
spring notifying residents of the proposed sealcoating project and
estimated cost. Approximately 1500 letters were sent, and few
residents attended the public improvement hearing. If property.
owners do not feel that they benefit from the improvement or if
they feel the work was not done well, they can submit a letter of
objection and follow the process of appealing the amount of the
assessment.

Mr. Scott Stumpfl addressed the City Council. and stated that
citizens had contacted him. who were upset about not receiving
the City's notification that they were being assessed for
sealcoating. He stated he feels the City needs to look at
additional ways to notify property owners.
Mayor Zaun indicated that State Statutes govern the method by
which the City notifies residents:.
Mr.'Erickson explained that during the last seven=year
sealcoating cycle, which. would cover the entire community, there
have been less than two dozen people at the initial public
improvementhearings expressing a lack of support for keeping
up their street infrastructure... The City has been successful in
educating the community. on the value of a pavement
management program, and the City has had eight consecutive
years of the lowest tax capacity rate of any city in Dakota. County...
Residents, .for the most part, have expressed along-standing level
of support for maintaining the City's infrastructure. They would.
have, however, preferred to have it paid for through taxes rather
than special assessments, and that is now going to happen.

hearing on proposed assessments for Districts 5 and 6

Mayor Zaun opened the public hearing to consider a tax rate
increase for the 2000 tax evy collectible in 2001.
Mr. Feller explained that a new law enacted in 1999 requires that
all cities over 500 population and all counties must pass a
resolution if the levy for the subsequent year will result in a tax
rate increase. The provision. is based on a Missouri law .and was
passed by the Legislature in response to concerns that cities and
counties were claiming they were. freezing taxes when, in fact, the
levy was increasing. but being offset by tax base growth. Mr.
Feller went on to explain that. the: formula ,for calculating the levy.
certification tax rate fails to take into consideration the City's
increase in population and the State Legislature's inequitable
allocation of state: aids.. :Thus, the calculated rate is a
hypothetical calculation and not the City's actual 2000 tax
capacity rate. The most accurate and complete dissemination of
information relating to taxes and budgets is presented at the
Truth in Taxation hearings.
.Pat Harvey, 20828 Iteri Avenue, complimented the City of
Lakeville for its careful attention to financial matters, providing
.quality services to the citizens of Lakeville at the lowest tax rate
in the county.

hearing to consider a tax rate increase for the 2.000 tax. levy,
collectible in 2001.

00.179 Motion was made by Sindt, seconded by Johnson to approve
Resolution No. 2000-259. authorizing a tax rate increase for the
2000 tax. levy, collectible in .2001.

Jim Winger, representing Black 8v Veatch Corporation, presented
bid results for the Water Treatment Planf expansion,
'Improvement Project OD-3. The low bid was submitted by
Madsen-Johnson Corporation. After reviewing quotations
received from their proposed subcontractors, Madsen-Johnson
identified a mistake in the preparation of their bid and
subsequently requested that their bid be withdrawn. The second
low bid was from Rice Lake Contracting Corporation in the
amount of $5,749,400. Staff recommends awarding the contract
to Rice Lake Contracting Corporation for the lump sum bid,
which includes a 1-million gallon storage reservoir.
Mayor Zaun asked how far into the future this expansion would
take the City.
Mr. Nelson explained that when the Water. Treatment Plant was
initially constructed, it was anticipated that before this plant is
expanded, a satellite facility would be built near the Fairfield
Business. Campus. In addition, an elevated tank was to be
constructed west of I-35 and south of 205 Street. Since that
area will remain outside the MUSA for possibly another 20 years,
without the demand in that area,. it was determined to be .more
cost effective to expand the Dakota Heights plant. This
expansion should take the City to the year 2020, with the
possible exception of some additional wells and elevated storage.
Mr. Feller explained that the primary revenue source for the plant
expansion is coming from water connection charges, and there is
cash on hand to finance this entire construction. Connections
projected into the future are adequate and sufficient to meet the
debt service on the original plant.
OD.180 Motion was made by Johnson, seconded by Mulvihill to approve
Resolution No. 00-260 awarding a contract for the Water.
Treatment Plant expansion, Improvement Project- 00-3.

NEW BUSINESS
Mr. Volk presented a'resolution authorizing the. placement of stop
signs on Tpava Avenue at Iredell Court to create an all-way stop
intersection. The City's traffic consultant,. SRF Consulting
Group, conducted a traffic operation .and safety review of the
intersection.. The report concluded and recommended that,
based on the combination of limited intersection site distance,
higher speeds, traffic volume and safety considerations, an all-
way stop at that intersection is justified.

Resolution No. 00-261 authorizing the placement of stop signs on
Ipava Avenue at the intersection of Iredell Court, .creating an all-
way stop intersection.
