ORDINANCE ADOPTING FEES
AND SUMMARY PUBLICATION OF ORDINANCE
Proposed Action
Staff recommends adoption of the following motion: Move to approve the Ordinance Adopting Fees
and summarypublication of Ordinance
Approval of the Ordinance will result in the approval of changes for Connection Charges, Planning
and Engineering fees, and Park Dedication Fees.
Overview
At its October 20th work session, the City Council discussed the proposed schedule of fees. The
proposed changes are consistent with the discussions conducted at the budget work session.
State law requires the establishment of fees to process land use applications must be established by
ordinance after a public hearing is conducted.

Connection Charges
During the "Great Recession" and in the years that followed, the City Council directed that there
be no increase to development related fees so as not to adversely affect local businesses or
potential growth. With the improvement in economic conditions, City staff proposed an
increase in fees to compensate for inflation factors in the construction industry. As such, the
fees are proposed to increase 13% based in the Construction Price Index for the period of 2009 -
2014 as published in the Engineering News Record. At its November 12 work session, the City
Council directed that the Trunk Storm Sewer Area Charge, Lateral Water main Access Charge,
Lateral Sanitary Sewer Access Charge and Sanitary Sewer Availability Charge be increased only
6.5% - rather the 13% recommended by staff. The proposed fee increases are as follows:

Escrow Future Road Upgrade Fees
Cash Escrow for Future (Road) Upgrade Residential Urban Section - based on the estimated
2015 street reconstruction adjusted for new construction and compared to new construction
other communities. The rural section and commercial sections are prorated based on the
residential urban section.

Water Connection Charges
The City collects water connection charges at the time building permits are issued. The revenues
are used to finance water infrastructure improvements such as wells, towers and water treatment
facility. The fee structure is based on the 2013 rate study. Financing water infrastructure with
connection charges enables the City of Lakeville to have one of the lowest water use rates in the
twin cities area.

Planning and Zoning Fees
Cash escrow for comp plan amendments was increased from $1,000 to $2,000.
Building Permits
There are no proposed changes to Building permit fees with the except of the new Fire Sprinkler
Fee for residential properties as a result of the building code changes which become effective
January 1, 2015. The residential sprinkler fire protection permit is $90 for new construction and
$45 for remodels.

The City Council, at the September 28 work session., directed staff to provide information relative
to the current market values of vacant land based on land sale transactions. The summary
findings of seven land transactions for a total of 565.6 acres are as follows:

The average number of single family units per acre is 2.1 based on four of the land transactions
involving 160 acres which have also received final platting approval by the City Council.

The City Council commissioned TPC in 2012 to develop a park dedication fee analysis based on
contemporary land use facts and fundamentals. Park dedication land requirements were
adjusted based on the TPC report. Single family land requirements, for example, were
established at 12%. Park Dedication fees were also reduced by 38% in 2012 as a result of the TPC
report.
Due the economic conditions and lack of reliable fair market value information on land sales, the
Council chose in 2012 and 2013 to base any annual adjustments in park dedication fees on the
annual adjustments in Assessed Valuation as determined by the Dakota County Assessor's
Office. As such, the 2014 Park Dedication Fees were reduced by another 2% for a total reduction
of 40% since 2012.
At the September 28 City Council work session, the Parks and Recreation Director
recommended to the City Council to increase the 2015 Park Dedication Fees 9.2% - consistent
with the past practices established by the City Council - based on the values established by the
Dakota County Assessor. The following are the proposed 2015 Park Dedication Fees:

Assuming an average of 2.1 dwelling units per acre as shown above, the proposed 2015 park
dedication fees will generate approximately $7,940 of revenue per acre. For the average
development, the fee represents 12% of the market value - which is consistent with the land
requirements approved by the City Council in 2012 as a result of the TPC study.

Parks & Recreation
The City Council, at its .lune 4, 2012 meeting, approved an amendment to the City Ordinance
related to Park Dedication Fees. The ordinance changed (a) the land dedication percentages
for residential land uses and (b) the cash contribution requirements for residential properties.
The basis of changes was delineated in a Park Dedication analysis dated May 15, 2012
prepared by Dan Licht, President,The Planning Company.
The Park Dedication Fees cash contributions fnr residential properties recommended In the
2012 report and subsequently approved by the City Council were based on changes In the
estimated market values as determined by the Dakota County Assessor's Office. According to
the Dakota County Assessors Fair Market Value for Taxes Payable 2015, there is a 9.2%
increase in residential values when compared to 2014. A list of the parcels and changes in
valuation are attached.
Based upon the analysis and methodology outlined in The Planning Company report, park
dedication fees in lieu of land should be increased to reflect the changes in market conditions
between 2014 and 2015. The following exhibit illustrates the current fee and proposed fee
for a single family lot, townhome and multi -family complex.

The Park Dedication Fees for residential properties are reviewed in the fail of each year. The
fees are adjusted based on the changes in estimated market values as established by the
Dakota County Assessor. It was our expectation that Park Dedication fees would increase in
2015 consistent with the improving market conditions.
Commercial and Industrial property values vary based on number of factors including but
not limited to prevailing economic conditions, location, size and zoning. As such staff
recommends park dedications fees for commercial and industrial properties be established
on an appraisal consistent with that used to establish the current fees. Staff recommends
undertaking an appraisal at such time as there appears to be changes in market conditions
and/or improvement in commercial -industrial activity.
Recommendation
Staff is recommending City Council approval of a 9.2% increase in park dedication fees in lieu
of land effective January 1, 2015 as follows:

B. Construction Plan Review

escrow may be required (if not collected through Planning and Zoning).
C. Wetland Conservation Act Administration lattin or non -platting action
Permit to fill a wetland as allowed by the Wetland Conservation Act....... $75.00
Services performed by City Personnel in administering the Wetland Conservation Act will be
billed at 2.5 times the actual payroll hourly rate. A minimum escrow of $250.00 will be required
(if not collected through Planning and Zoning actions) for: Wetland delineation/delineation
review, replacement plan review, mailings and administration, construction inspection and
annual monitoring until successful establishment of mitigation area.
In addition to the above fees, a deposit will be required to fund special studies such as
environmental assessment worksheets, transportation, drainage, noise impacts, indirect source
permits, etc. The amount of deposit to be based on the site, complexity, diversity and location of
the project.

SUMMARY OF ORDINANCE NO.
AN ORDINANCE ADOPTING A FEE SCHEDULE
This ordinance prescribes fees sufficient to defray the costs incurred by the City of Lakeville in
reviewing, investigating and administering applications for the amendment to an official control
established pursuant to Minnesota Statutes Sections 462.351 to 462.364 and applications for
permits or approvals required under an official control established pursuant to those sections.
A printed copy of the ordinance is available for inspection by any person during regular office
hours at the office of the City Clerk.
