HomeMy WebLinkAboutItem 10.dNovember 17, 2014 Item No. ORDINANCE ADOPTING FEES AND SUMMARY PUBLICATION OF ORDINANCE Proposed Action Staff recommends adoption of the following motion: Move to approve the Ordinance Adopting Fees and summarypublication of Ordinance Approval of the Ordinance will result in the approval of changes for Connection Charges, Planning and Engineering fees, and Park Dedication Fees. Overview At its October 20th work session, the City Council discussed the proposed schedule of fees. The proposed changes are consistent with the discussions conducted at the budget work session. State law requires the establishment of fees to process land use applications must be established by ordinance after a public hearing is conducted. With the improvement in economic conditions, City staff proposed an increase in fees to compensate for inflation factors in the construction industry. As such, the fees are proposed to increase 13% based in the Construction Price Index for the period of 2009 - 2014 as published in the Engineering News Record. At its November 12 work session, the City Council directed that the Trunk Storm Sewer Area Charge, Lateral Water main Access Charge, Lateral Sanitary Sewer Access Charge and Sanitary Sewer Availability Charge be increased only 6.5% - rather the 13% recommended by staff. The revenues are used to finance water infrastructure improvements such as wells, towers and water treatment facility. The fee structure is based on the 2013 rate study. Financing water infrastructure with connection charges enables the City of Lakeville to have one of the lowest water use rates in the twin cities area. Details regarding the proposed Park Dedication Fees were presented at the October 141hwork session. These details can be found on the following pages. Planning and Zoning Fees Cash escrow for comp plan amendments was increased from $1,000 to $2,000. Building Permits There are no proposed changes to Building permit fees with the except of the new Fire Sprinkler Fee for residential properties as a result of the building code changes which become effective January 1, 2015. The residential sprinkler fire protection permit is $90 for new construction and $45 for remodels. Memorandum To: Mayor and Council From: Dennis Feller, Finance Director Date: October 14, 2014 Subject: Park Dedication Fees City of Lakeville Finance Department The City Council, at the September 28 work session., directed staff to provide information relative to the current market values of vacant land based on land sale transactions. The summary findings of seven land transactions for a total of 565.6 acres are as follows: Market Value Per Acre High $ 78,655 Average (Mean) $ 65,001 Median $ 64,925 Low $ 49,156 The average number of single family units per acre is 2.1 based on four of the land transactions involving 160 acres which have also received final platting approval by the City Council. Park dedication land requirements were adjusted based on the TPC report. Single family land requirements, for example, were established at 12%. Park Dedication fees were also reduced by 38% in 2012 as a result of the TPC report. Due the economic conditions and lack of reliable fair market value information on land sales, the Council chose in 2012 and 2013 to base any annual adjustments in park dedication fees on the annual adjustments in Assessed Valuation as determined by the Dakota County Assessor's Office. As such, the 2014 Park Dedication Fees were reduced by another 2% for a total reduction of 40% since 2012. At the September 28 City Council work session, the Parks and Recreation Director recommended to the City Council to increase the 2015 Park Dedication Fees 9.2% - consistent with the past practices established by the City Council - based on the values established by the Dakota County Assessor. The following are the proposed 2015 Park Dedication Fees: Proposed 2015 Park Dedication Fee Increase Single family $ 3,781 $ 319 Townhouse $ 2,572 $ 217 Multifamily $ 1,952 $ 164 Assuming an average of 2.1 dwelling units per acre as shown above, the proposed 2015 park dedication fees will generate approximately $7,940 of revenue per acre. For the average development, the fee represents 12% of the market value - which is consistent with the land requirements approved by the City Council in 2012 as a result of the TPC study. The ordinance changed (a) the land dedication percentages for residential land uses and (b) the cash contribution requirements for residential properties. The basis of changes was delineated in a Park Dedication analysis dated May 15, 2012 prepared by Dan Licht, President,The Planning Company. The Park Dedication Fees cash contributions fnr residential properties recommended In the 2012 report and subsequently approved by the City Council were based on changes In the estimated market values as determined by the Dakota County Assessor's Office.
