HomeMy WebLinkAboutItem 06.pJanuary 13, 2015 Item No. AN ORDINANCE AMENDING TITLE 3, CHAPTER 1 OF THE LAKEVILLE CITY CODE CONCERNING ALCOHOLIC BEVERAGES Proposed Action Staff recommends adoption of the following motion: Move to approve an ordinance amending Title 3, Chapter 1 of the Lakeville City Code Concerning Alcoholic Beverages. Passage of this motion will allow the City of Lakeville to issue the following licenses; Taproom, Brewpub, and Cocktail Room Licenses. Overview In July 2014, the City Council adopted a zoning ordinance amendment to allow brew on premises, brewery, small brewery, brewpub, distillery, micro -distillery, farm winery, tap room and tasting room uses in certain agricultural, commercial and industrial zoning districts. The City of Lakeville at this time does not have licenses established to allow for these types of businesses. This ordinance amendment would establish these licenses and allow an establishment to conduct on -sale and limited off -sale business. CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING TITLE 3, CHAPTER 1 OF THE LAKEVILLE CITY CODE CONCERNING ALCOHOLIC BEVERAGES THE CITY COUNCIL OF THE CITY OF LAKEVILLE, MINNESOTA ORDAINS: SECTION 1. Section 3-14A of the Lakeville City Code is amended by adding the following: I. "Cocktail Room License": Cocktail room licenses shall be granted only to the holder of a microdistillery licensed under Minn. Stat. § 340A.301, Subdivision 6c. A cocktail room license authorizes on -sale of distilled liquor produced by the distiller for consumption on the premises of or adjacent to one distillery location owned by the distiller. J. `Brewpub License": Brewpub licenses shall be granted only to a brewery licensed under Minn. Stat. § 340A.301, Subdivision 6, clause (c), (i), or 0). A brewpub off -sale malt liquor license may be issued, with the approval of the commissioner, to a brewer and subject to the requirement of Minn. Stat. § 340A.301, Subdivision 6. K. "Taproom License": Taproom licenses shall be granted only to a brewery licensed under Minn. Stat. § 340A.601, subdivision 6, clause (c), (i) or 0) for on - sale of malt liquor produced by the brewer for consumption on the premises of or adjacent to one brewery location owned by the brewer. SECTION 2. Section 3-1-7-1 of the Lakeville City Code is amended by adding the following: Type of License Amount of License Cocktail Room License, Brewpub License, Taproom $300.00 License 179848v1 Investigation Fees: Intoxicating Liquor, Special Club, Consumption and Display, Cocktail License, Brewpub License, Taproom License Multiple licenses for one location $500.00 A single fee equal to the highest fee for a license issued SECTION 3. This ordinance shall be effective immediately upon its passage and publication. ADOPTED this day of , 2015 by the City Council of the City of Lakeville, Minnesota.
