The pledge of allegiance to the flag was given. Citizen Comments None 4. Additional Agenda Information None 5. Presentations/Introductions Chief Meyer presented the Fire Department 2014 Annual Report. Chris Petree presented the February Public Works Department monthly report. Consent Agenda Motion was made by Anderson, seconded by Davis to approve the following consent agenda items: a. Claims for payment b. Minutes of the February 17, 2015 City Council meeting c. Resolution No. 15-22 calling a public hearing on the certification of delinquent utilities d. America's Best Communities letter of support e. Release of Development Contract for Outlot A, First Park Lakeville f. Purchase Agreement with George W. Warweg for 5.99 acres of property located adjacent to Antlers Park i. Public Hearing to Amend Annual Liquor License Fees Mayor Little opened the public hearing to consider an amendment to Section 3-1-7-1 of the Lakeville City Code related to annual liquor license fees. The City Clerk presented the proposed ordinance, stating the Council members and staff reviewed the City's liquor license fees at last year's budget work sessions. The current fee structure for on -sale liquor licenses has been in place since 2006. Wine and 3.2% malt liquor license fees have been in place since 1998. After extensive review of the costs incurred for license issuance and enforcement, the finance and police departments are recommending a rate increase for on -sale liquor licenses ($5,500/$6,500 to $6,250/$7,000), off -sale 3.2% malt liquor licenses ($75 to $300), and wine licenses ($500 to $800). The investigation fee would increase from $300/$500 to $700. Council Member Anderson stated the City Council received a request from Bob Gillen, owner of Porterhouse Steak & Seafood Grill, to look at liquor license fees from an occupancy standpoint, taking into account property taxes. Mr. Gillen feels Lakeville's fees are high based on his per customer calculation. Anderson stated that while he supports the proposed fee increase, he suggested the Council consider alternative methods of calculating license fees in the future. Council Member Davis pointed out that the City does not determine property values. However, he would support taking a different approach to determining license fees in the future. City Council Meeting Minutes, March 2, 2015 Page 3 Council Member LaBeau stated she received comments from several license holders who felt that liquor license fees should be based on food vs. alcohol sales. Stanley DeBough, owner of Goodfellas Pizza Bar & Grill, asked if the Council would consider phasing the fee increase over a three year period. Mayor Little stated that, while a final decision has not been made, the Council had discussed an additional fee increase in 2016, so the recommendation at this time does represent a phased approach. Motion was made by Davis, seconded by Swecker to close the public hearing. Roll call was taken on the motion. Ayes - Davis, Little, Swecker, Anderson, LaBeau Motion by Davis, seconded by Swecker to adopt Ordinance No. 935 amending Title 3, Chapter 1 of the Lakeville City Code concerning liquor license fees.
