Subject: Review of Possible Participation in County Road Turn Lane Improvements
Required by New Developments
In the past year, the City has approved two industrial park development projects that are
adjacent to County Road 70. The first was the FedEx Freight project located at Co. Rd. 70 and
Dodd Blvd. and the second was the NPL Project located at Co. Rd. 70 and Heath Avenue. (See
attached location map). The FedEx project required approval of a preliminary and final plat.
The NPL project is being constructed on a previously platted lot that was administratively
subdivided. Both projects required approval of a new access to Co. Rd. 70 in conjunction with
their developments.
As part of the County's review of the FedEx and NPL requests for new accesses on to Co. Rd.
70, County staff determined that because both of these new access locations would now
become four -legged intersections, that both right and left turn lane improvements on County
Road 70 would be required. The developers of both the FedEx and NPL projects have
expressed concerns about whether funding both right and left turn lane improvements is a
reasonable and equitable request since both sides of the County road will benefit from the
improvements. Attached is a letter from APPRO Development, developer of the NPL project
that conveys their concerns. Representatives of APPRO will be in attendance at Monday's
Work Session.
Attached is a memo to the Dakota County Administration Finance Policy Committee that
discussed this issue at a May 5, 2015 meeting. In that memo, County staff is recommending
that the County participate in 55% of one half of the costs of left turn lane improvements in
both directions. County Transportation staff will be present at the May 11th City Council Work
Session to provide more information on this issue. County staff is indicating that turn lane
improvements can range from $100,000 to $350,000 depending on the design elements for
each location. Based on the 55% of one half of the cost of the turn lane costs, the County's
share could range from $25,000 to $100,000. The consensus of the County Board members
at the May 5th Committee Meeting was to amend the County's policy to allow for the County
to participate in 55% of one half of the required left turn lane improvement costs.
The policy question for the City Council to consider is whether the City should also participate
in the cost of required left turn lane improvements on County Roads in conjunction with
development projects and if so what type of projects would be appropriate to participate in a
cost share. As Council is aware, the typical City cost share on County Road project is 45%.
However, given that these types of improvements are development driven, it would be
difficult for the City to budget for projects. The City would likely have to budget a lump sum
amount each year in anticipation that there may be a project or two in the coming year that
may necessitate City participation in left turn lane improvements to a County Road as a result
of a new development. The estimated City cost of 45% of one half of the left turn lane
improvements for these projects would be between $45,000 and $55,000 per intersection.
Requested Action:
Provide City staff with direction as to whether the City Council wishes to consider amending
the City's practice and policy regarding participating in the costs associated with left turn lane
improvements for projects adjacent to County Roads. If Council wishes to amend the City's
policy and practice regarding these types of improvements to County roads and apply it to
include the FedEx and NPL projects, staff would attempt to identify possible sources of
funding.

Informational update on County Cost Participation for Left Turn Lane Improvements with Access Permits.
SUMMARY
To provide a safe and efficient transportation system, Dakota County manages the placement of new access to the
County highway system by requiring an Access Permit, consistent with Minn. Stat. § 160.18, and the requirements
defined in Dakota County Ordinance No. 126, Management of the Public Right -of -Way. Through the Access Permit
approval process, the County Engineer may impose reasonable conditions upon the issuance of the permit and the
performance of the applicant thereunder to protect the health, safety and welfare or, when necessary, to protect the
right of way and its current and future use. This includes the installation of tum lanes on the County highway when
necessary to maintain the safety of the traveling public and to mitigate the impact of the new access. Historic
practice has been for the applicant to bear the costs for the turn lanes. There have been 15 access permits over
the past 10 years where left turn lanes have been required as part of an Access Permit approval.
Over the past few months, staff has been in discussions with two developers requesting to construct new accesses
to County State Aid Highway (CSAH) 70 in Lakeville to serve new industrial developments (Attachment A —
Location Map). In both situations, the access is connecting to an existing intersection along CSAH 70 across from
a public road on the other side of CSAH 70 (Humboldt Court and Heath Avenue). The intersections do not
currently have left turn lanes on CSAH 70, and under Dakota County and Minnesota Department of Transportation
(Mn/DOT) design practice, left turn lanes should be constructed once the fourth leg of an intersection is
constructed. In both cases, the developer questioned whether construction of left turn lanes along CSAH 70 was a
reasonable requirement of the access permit, considering the left turn lanes will also benefit property owners on the
other side of CSAH 70.
Staff will present to the Committee for discussion an approach to constructing intersection improvements (as a
County practice) for these situations that reasonably shares the costs for the necessary intersection improvements.
This approach has been discussed with the City of Lakeville and the two developers along CSAH 70. It has also
been discussed informally with staff from other cities with general support. This approach includes:
• County participation of 55% (consistent with County policy) of half of the costs for construction of left tum lanes
in both directions. This is based on the County participating in the left turn lane that would serve existing
development.
• Cost shares and roles/responsibilities of all parties involved would be addressed through agreement.
Engineering and construction administration of the improvements could be led by the County, City, or
developer.
If the Committee is supportive of this approach on May 5, it will allow the Lakeville City Council to discuss their role
in the two CSAH 70 intersections on May 11. Staff plans to request authorization to enter into an agreement
regarding the CSAH 70 and Humboldt intersection on May 19. Staff will also discuss with the Committee an
approach with new intersection access permits that will allow for full left turn lane costs to be shared between the
two parties applying for access permits (one on each side) when the driveways/roadways intersecting the County
highway are constructed at different times.
RECOMMENDATION
None; information only.
EXPLANATION OF FISCAUFTE IMPACTS
Installation of left turn lanes can range from $100,000 to $350,000, depending on the design elements specific to
each location. This would result in an expected County contribution ranging from $25,000 to $100,000. The
County's share of intersection improvement costs could be funded through the Safety and Management Projects
setaside in the Transportation Capital Improvement Program (CIP), if funds are available. If funds are not available
in the current CIP, the County could consider including funds through the typical CIP development process.

RE: County Road 70 Improvements at Driveway to NPL Site

Gentlemen, thank you very much for taking the time to meet with us regarding the issue
of County Road 70 improvements requested, in reference to our driveway permit to the
NPL 5 acre site. NPL Construction Co. is a 25 plus year Lakeville business that is
relocating from their current location along 35W.
The driveway permit request is to allow for NPL to utilize a previously installed
culvert/drive access approved as part of the Acorn Tappe plat in approximately 2001.
The driveway lies directly south of Heath Avenue — a city street. The driveway access
will serve the new NPL site. The facility will serve NPL Construction's operations, which
consist of:
15,000 sq. ft. office / warehouse building
Storage / parking yard for materials
Traffic volume — average approximately 30-50/day
Initial review by County staff suggested the following County Road 70 upgrades:
• South lane improvements to facilitate right in / right out movements near NPL site.
• Center lane — to facilitate left turn movement into NPL site (south) and Heath
Avenue to the north.
• North lane improvements to improve right in / right out access to Heath Ave.
These improvements would facilitate a full intersection for all movements for the time
being. It is understood by our client — NPL — that ultimate plans for County Road 70 are 4
lanes divided with movement at this intersection limited to right in / right out at that time.
The net effect is a reconstruction of approximately 1,500 LF of County Road 70.
The burden of these requirements to our client seem extremely excessive, especially
when you consider their traffic volumes, the long term plans for Highway 70 and the fact
that the improvements requested benefit regional traffic, local traffic and neighboring
businesses to the north of this site.

We are grateful you are trying to help find funding sources to lessen the burden to this
small industrial development. Initial engineers' estimates have put the costs in excess of
$280,000.00. Our client — NPL — anticipated participating in some improvement costs,
specifically the right in / right out access with deceleration and acceleration lanes.
We understand you are meeting with the Mayor and City Council on May 11, 2015, to
discuss this situation and we would be available to come to the meeting and / or have
representative of NPL there as well.
We sincerely appreciate any consideration to appropriately allocate / share funding to
accomplish these desired County Road 70 improvements.
