HomeMy WebLinkAboutItem 06.dJune 11, 2015 Item No.________ ORDINANCE AMENDING TITLE 3, CHAPTER 1 OF THE LAKEVILLE CITY CODE Proposed Action Staff recommends adoption of the following motion: Move to adopt an ordinance amending Title 3, Chapter 1 of the Lakeville City Code concerning alcoholic beverages. Passage of this motion amends the taproom license to include off-sale, adopts State Statute by reference with respect to hours of sale and allows the sale of growlers on Sunday after 8:00 a.m. Overview The proposed amendments are consistent with recent action by the State Legislature related to brewer taproom licenses and Sunday sales. A small brewer may sell 64-ounce containers commonly known as “growlers” on Sunday. The hours of sale must be established by the licensing jurisdiction. The Legislature also passed a law, effective immediately, amending the Sunday on-sale hours from 10 a.m. to 8 a.m. The proposed ordinance adopts State Statute by reference with respect to hours of sale. Primary Issues to Consider It is recommended that the City Council adopt State Statute by reference so that if the legislature makes additional changes in the future, another ordinance amendment would not be needed, assuming the City Council agrees with the changes and does not want to be more restrictive. Section 3-1-4 (D), (I), (J) and (K) of the Lakeville City Code are amended to provide as follows: D. “On-Sale Sunday Liquor Sale License": On-sale Sunday liquor sale licenses may be issued to establishments holding an on-sale liquor license hereunder. Such license shall permit the sale of liquor to be consumed on the premises between the hours of ten o'clock (10:00) A.M. on Sunday and one o'clock (1:00) A.M. on Monday in conjunction with the serving of food. A separate application for such license shall be made to the city in the same manner as applications for other licenses to sell intoxicating liquor are made hereunder. I. “Cocktail Room License”: Cocktail room licenses shall be issued only in accordance with Minnesota Statues 340A. 301, subdivision 6c. A cocktail room license authorizes on-sale of distilled liquor produced by the distiller for consumption on the premises of or adjacent to one distillery location owned by the distiller. J. “Brewpub License”: Brewpub licenses shall be issued only in accordance with Minnesota Statues 340A. 301, subdivision 6, clause (c), (i), or (j). A brewpub off- sale malt liquor license may be issued, with the approval of the commissioner, to a brewer and subject to the requirement of Minnesota statutes section 340A.301, subdivision 6. K. “Taproom License” Taproom Licenses shall be issued only in accordance with Minnesota Statues 340A. 301, subdivision 6, clause (c), (i) or (j) for on-sale of malt liquor produced by the brewer for consumption on the premises of or adjacent to one brewery location owned by the brewer. SECTION 2. Section 3-1-8-5 of the Lakeville City Code is amended to provide as follows: 2 181669v1 3-1-8-5: HOURS OF OPERATION: The provisions of Minnesota Statutes § 340A.504 with reference to the hours of sale are hereby adopted and made a part of this chapter as if fully set out herein. Malt liquor in growlers may also be sold at off-sale on Sunday after 8:00 A.M. Persons other than employees of the licensee may not be in the premises from thirty (30) minutes after the sale of malt liquor or intoxicating liquor is prohibited until thirty (30) minutes before the sale is permitted. SECTION 3. This ordinance shall be effective immediately upon its passage and publication.
