HomeMy WebLinkAboutItem 06.iLake June 10, 2015 Item No. SBF COMMERCIAL 2ND ADDITION FINAL PLAT EXTENSION JUNE 15, 2015 CITY COUNCIL MEETING Proposed Action Staff recommends adoption of the following motion: Move to approve a 100 day extension for recording the Spirit of Brandtjen Farm Commercial 2nd Addition final plat. Passage of this motion will give SBF Development Corp. an additional 100 days to clear up title issues and record the final plat of Spirit of Brandtjen Farm (SBF) Commercial 2nd Addition. Overview SBF Development Corp. (a/k/a Tradition Development) is requesting a 100 day extension for recording the SBF Commercial -2nd Addition final plat, which consists of 13 outlots for the construction of public streets and utilities to serve the commercial area of the SBF PUD located south of 160th Street (CSAH 46) and east of Pilot Knob Road (CSAH 31). The SBF Commercial 2nd Addition final plat was approved by the City Council on March 16, 2015. Tradition Development is working with Dakota County to clear up some Torrens property title issues and they need additional time for this to occur in order for the final plat to be recorded. Planning Department staff recommends the City Council grant the 100 day extension request for recording the SBF Commercial 2nd Addition final plat to October 2, 2015. Primary Issue to Consider • What will happen if the final plat extension request is not approved? City Council approval of the SBF Commercial 2 nd Addition final plat would become null and void, thus requiring submittal of a new final plat application. SBF Development Corp. is working on getting this plat recorded with the County but has not been able to get the plat finalized due to the fact that some of the property is in Torrens. We continue to work with the County Surveyors office and the County Examiner of Titles to replat, vacate and rewrite the various title certificates affected by the replating we propose. We kindly ask the City for a 100 day extension in order to allow us enough time to clear up then necessary Torrens certificates and finalize the mylars for recording. We appreciate the City considering this extension request for Spirit of Brandtjen Farm Commercial 2nd addition. Thank you for your help and consideration regarding this plat.
