HomeMy WebLinkAboutItem 06.l June 9, 2015 Item No. ______ PARTIAL RELEASE OF DEVELOPMENT CONTRACTS AND PUD AGREEMENTS JUNE 15, 2015 CITY COUNCIL MEETING PROPOSED ACTION Staff recommends adoption of the following motion: Move to approve the partial release of the development contracts and planned unit development agreements recorded against the plats of Timbercrest at Lakeville and Timbercrest at Lakeville 4th Addition. Adoption of this motion will release the property owner of Lot 1, Block 1, Timbecrest at Lakeville 7th Addition (SuperAmerica) from the development contract and planned unit development agreement recorded against the property title for Timbercrest at Lakeville and Timbercrest at Lakeville 4th Addition. OVERVIEW The purchaser and developer of Timbercrest at Lakeville 7th Addition is requesting the release of the development contracts and planned unit development agreements recorded the title of the subject property. Staff has determined that the developer has met all requirements and obligations of the contracts and agreements approved in 2001 and 2006 for Timbercrest at Lakeville and Timbecrest at Lakeville 4th Addition. The City Attorney has drafted the partial release forms. The City Council approved the preliminary and final plat of Timbercrest at Lakeville 7th Addition and a conditional use permit for a SuperAmerica convenience store and car wash on April 20, 2015. PRIMARY ISSUES TO CONSIDER How will the release of development contract affect the remaining undeveloped parcels in Timbercrest at Lakeville 4th Addition? Timbercrest at Lakeville 4th Addition re-platted Outlot F, Timbercrest at Lakeville. The remaining Outlot within Timbercrest at Lakeville 4th Addition will remain in full force and effect of the Timbercrest at Lakeville 4th Addition development contract and planned unit development agreement.
