PIONEER PLAZA IMPROVEMENT AGREEMENTS WITH
TF CONCRETE & MASONRY LLC AND ARCHITECTURAL LANDSCAPE DESIGN, INC.
Proposed Action
Staff and the Parks, Recreation and Natural Resources Committee recommend adoption of
the following motion: Move to approve Agreements with TF Concrete & Masonry LLC and
Architectural Landscape Design, Inc. for Pioneer Plaza improvements.
The passage of this motion will result in the Mayor and City Clerk executing Agreements with
TF Concrete & Masonry LLC and Architectural Landscape Design, Inc.
Overview
During the 2015 budget review process, staff informed the Mayor and City Council that the
pavers in Pioneer Plaza have been and continue to deteriorate. Over the years, staff has
replaced the deteriorating pavers to address safety tripping hazards and liability issues in the
plaza. The Mayor and City Council approved $37,000 as part of the 2015 Parks Major
Maintenance Fund to remove and replace the existing pavers, water fountain and Spruce tree
on the west end of the plaza.
At the February 23, 2015 City Council work session, staff presented plans to the Mayor and
City Council regarding replacing the existing pavers on site with a combination of a broomed
finished concrete walkway including a stamped colored border, along with replacing the
existing fountain with a granite boulder fountain water feature. The new fountain would be
engraved with the original Pioneer Plaza train graphic and wording from the original 1990
Dedication.
Staff recently prepared bid packages and obtained quotes for the concrete walkway
improvements and the boulder rock water feature and permeable paver installation. The low
quote for the concrete walkway improvements was submitted by TF Concrete & Masonry LLC
at a cost of $24,069.00. The low quote for the boulder rock water feature and permeable
paver installation was submitted by Architectural Landscape Design, Inc. at a cost of
$17,907.23. The total for both contracts equal $42,039.23. As mentioned earlier, $37,000 was
budgeted for the project. There is sufficient funding in the Parks Major Maintenance Fund to
cover the difference of $5,039.23.
At the work session, the Mayor and City Council discussed installing something new and fresh
at the site to draw visitors to the Downtown such as a public art display. The plans call for the
installation of two 11' in diameter concrete pads on the front side of the park by Holyoke
Avenue for the display of public art. Staff has visited Edina's public art pieces and discussed
with their staff the process they have taken to obtain art pieces in their community.
Staff has also applied for and received a donation from the Lakeville Rotary to replace the
twelve existing benches in the Plaza.
The Downtown Lakeville Business Association was presented the plans in the early stages and
is in favor of the improvements. The Parks, Recreation and Natural Resources Committee
reviewed and recommended approval of the project at their June 17 meeting. The project
would commence after Pan-O-Prog and will take approximately four to five weeks to be
completed.
Primary Issues to Consider
• Will the project eliminate the existing liability issues on site along with significantly
improving and enhancing the plaza? Yes.

AGREEMENT made this 6t' day of July, 2015, between the CITY OF LAKEVILLE, a
Minnesota municipal corporation ("City"), and TF CONCRETE AND MASONRY LLC, a
corporation organized and existing under the laws of the State of Minnesota ("Contractor").
IN CONSIDERATION OF THE MUTUAL UNDERTAKINGS HEREIN
CONTAINED, THE PARTIES AGREE AS FOLLOWS:
1. CONTRACT DOCUMENTS. The following documents shall be referred to as the
"Contract Documents", all of which shall be taken together as a whole as the contract between
the parties as if the were set verbatim and in full herein:

C. Quote dated May 10, 2015
In the event of conflict among the provisions of the Contract Documents, the order in which they
are listed above shall control in resolving any such conflicts with Contract Document "A" having
the first priority and Contract Document "C" having the last priority.
2. OBLIGATIONS OF THE CONTRACTOR. The Contractor shall provide the
services and perform the work in accordance with the Contract Documents.
3. OBLIGATIONS OF THE CITY. The City shall pay the Contractor in accordance
with the Quote.
4. ASSIGNMENT. Neither party may assign, sublet or transfer any interest or
obligation in this Contract without the prior written consent of the other party, and then only upon
such terms and conditions as both parties may agree to and set forth in writing.
5. TIME OF PERFORMANCE. The Contractor shall complete its obligations by no
later than August 14, 2015.
6. PAYMENT. The City will pay the Contractor within forty-five (45) days of receiving
an invoice for work performed.

7. PROMPT PAYMENT TO SUBCONTRACTORS. Pursuant to Minnesota Statute
471.25, Subdivision 4a, the Contractor must pay any subcontractor within ten (10) days of the
Contractor's receipt of payment from the City for undisputed services provided by the
subcontractor. The Contractor must pay interest of one and one-half percent (1%2 %) per month
or any part of a month to subcontractor on any undisputed amount not paid on time to the
subcontractor. The minimum monthly interest penalty payment for an unpaid balance of
$100.00 or more is $10.00. For an unpaid balance of less than $100.00, the Contractor shall
pay the actual penalty due to the subcontractor. A subcontractor who prevails in a civil action to
collect interest penalties from the Contractor shall be awarded its costs and disbursements,
including attorney's fees, incurred in bringing the action.
8. WORKER'S COMPENSATION. The Contractor shall obtain and maintain for the
duration of this Contract, statutory Worker's Compensation Insurance and Employer's Liability
Insurance as required under the laws of the State of Minnesota.
9. COMPREHENSIVE GENERAL LIABILITY. Contractor shall obtain the following
minimum insurance coverage and maintain it at all times throughout the life of the Contract, with
the City included as an additional name insured. The Contractor shall furnish the City a
Certificate of Insurance satisfactory to the City evidencing the required coverage:
Bodily Injury: $1,000,000 each occurrence
$1,000,000 aggregate, products and
completed operations.
Property Damage: $1,000,000 each occurrence

10. DATA PRACTICES/RECORDS.
A. All data created, collected, received, maintained or disseminated for any
purpose in the course of this Contract is governed by the Minnesota
Government Data Practices Act, Minn. Stat. Ch. 13, any other applicable
state statute, or any state rules adopted to implement the act, as well as
federal regulations on data privacy.
B. All books, records, documents and accounting procedures and practices of
the Contractor and its subcontractors, if any, relative to this Contract are subject to examination
by the City.
11. INDEMNITY. The Contractor agrees to indemnify and hold the City harmless
from any claim made by third parties as a result of the services performed by it. In addition, the
Contractor shall reimburse the City for any cost of reasonable attorney's fees it may incur as a
result of any such claims.
12. WAIVER. In the particular event that either party shall at any time or times waive
any breach of this Contract by the other, such waiver shall not constitute a waiver of any other or
any succeeding breach of this Contract by either party, whether of the same or any other
covenant, condition or obligation.
13. GOVERNING LAW. The laws of the State of Minnesota govern the interpretation
of this Contract.
14. SEVERABILITY. If any provision, term or condition of this Contract is found to be
or become unenforceable or invalid, it shall not effect the remaining provisions, terms and
conditions of this Contract, unless such invalid or unenforceable provision, term or condition
renders this Contract impossible to perform. Such remaining terms and conditions of the
Contract shall continue in full force and effect and shall continue to operate as the parties' entire
contract.
15. ENTIRE AGREEMENT. This Contract represents the entire agreement of the
parties and is a final, complete and all inclusive statement of the terms thereof, and supersedes
and terminates any prior agreement(s), understandings or written or verbal representations
made between the parties with respect thereto.

Interested Contractors:
The City of Lakeville is soliciting bids for the installation of standard grey broomed concrete and colored
and stamped concrete walkway in Pioneer Plaza in Downtown Lakeville. Attached are specifications and
requirements to complete the project, bid form and plans of the sidewalks to be installed in Pioneer
Plaza. Also attached is an Agreement that the lowest responsive, responsible, qualified Bidder would be
required to execute prior starting the project.
If you are interested in providing a bid, please complete- the attached bid form and submit to John
Hennen/Park Maintenance & Operations Manager, 20195 Holyoke Avenue, Lakeville, MN 55044,
no later than Monday May, 111h at 4:00 PM. It is anticipated that this item will be brought to the City
Council for approval at the June 1s' City Council meeting. Bids may be hand delivered or mailed
including the 5% Bid Bond.
A pre-bid walk thru will be held on Monday, May 41" at 10:00 AM with staff to go over the details of the
project and to answer any questions you may have. Pioneer Plaza is located in Downtown Lakeville

Specifications and Requirements
Pioneer Plaza Walkway Improvements
Instructions to Bidders
Bids will be accepted until 4:00 PM on Friday, May 81h. Bids will be evaluated based upon the Total Bid,
and the project will be awarded on the basis of the lowest responsive, responsible, qualified Bidder for the
work. The owner reserves the right to reject any or all Bids including without limitation nonconforming,
nonresponsive, unbalanced or conditional Bids. Owner further reserves the right to reject the Bid of any
Bidder if Owner believes that it would not be in the best interest of the Project to make an award to that
Bidder. Owner also reserves the right to waive all informalities not involving price, time or changes in the
Work and to negotiate Contract terms with the successful Bidder.
Accompanying this proposal must be a contractor's bid bond, certified check or cash deposit in the
amount of 5% of the bid made payable to the City of Lakeville, Minnesota, and the same is subject to
forfeiture in the event of default on the part of the undersigned to execute the prescribed contract after
its submittal to the City of Lakeville.
It is understood that your bid may not be withdrawn for a period of thirty (30) days after submission. It is
understood that the City reserves the right to retain the certified check or bid bond as determined by the City
for a period not to exceed thirty (30) days after receipt of the proposal.

Project Scope
Owner (City) shall remove and dispose of existing paver walkway, water fountain and 10 concrete bench
pads along the walkway. Contractor shall replace the paver walkway with a new broomed concrete sidewalk
which will include a colored and stamped concrete border, install a new sidewalk segment and apply sealers
as the Base Bid.
Bid Alternate A consists of installing two 11' in diameter broomed concrete circles with colored/stamped
concrete border in the front of the plaza that will be used for the display of public art.
Bid Alternate B consists of installing four 3'X8' concrete broomed concrete bench pads west of the water
feature. Two pads will be on each side of the walkway as noted on plans.

The concrete shall be 4" thick, 4500 psi utilizing micro fiber mesll reinforcement in the broomed finished
center concrete walkway. The Owner (City) shall supply the granular base material, however; contractor
shall place, spread and compact the base granular material. The base granular material shall be a minimum
of 4" thick. Contractor shall be responsible for the excavation, removal and disposal of materials required to
meet the minimum thickness of base material and concrete.
Two #4 rebar shall be installed in all the colored stamped concrete borders. The colored stamped concrete
border shall be pinned into the broomed finished concrete walk utilizing #4 rebar not exceeding 5'on center.
The color of the stamped concrete shall be 413 Clay. Contractor shall apply a charcoal powder release to the
colored stamped concrete areas. It is the intent of the owner to leave the contractor match the color of the
stamped concrete of the sidewalks in new parking lot west of Pioneer Plaza.
Contractor shall apply a dissipating cure sealer on the broomed finished concrete material followed by an
application of a solaxine sealer 30 days after installation. A clear coat sealer shall be applied to the colored
stamped concrete border 30 days after installation.
Any damage done to turf areas outside of the construction limits shall be the responsibility of the
contractor to make the repairs at contractors cost. Construction limits shall be defined as 3' from edge of
sidewalk.
The successful contractor shall provide a two year warranty for materials and workmanship beginning at the
time of final acceptance (payment) of the project by the City of Lakeville. The contractor shall agree to
repair all failures which occur due to poor workmanship or materials within the first two years following the
final acceptance. Such repairs shall be made at no further expense to the City.
Contractor shall also be required to coordinate the work with a separate contractor under contract with the
City of Lakeville that will be constructing a boulder rock water feature and permeable pavers in the center of
the walkway/plaza area.
Proposed timeline of the project is as follows:
1. City removes pavers, 10 benches and pads and water fountain (Jule 13th -17th).
2. Landscape contractor constructs a boulder rock water feature and permeable pavers in the
center of the walkway/plaza area (Jule 20th -31").
3. Cement contractor installs standard grey broomed concrete and colored/stamped concrete
-,v-alkway (August 3rd — cement contractor to commence work).
The City is willing to discuss the flexibility of this schedule after the Landscape and Cement
Contractors have been selected.

The City of Lakeville is soliciting bids for the installation of a boulder rock water feature and permeable
pavers in Pioneer Plaza in Downtown Lakeville. Attached are specifications and requirements to
complete the project, along with a bid form and plans of the water feature and pavers to be installed in
Pioneer Plaza located in Downtown Lakeville addressed as 20801 Holyoke Avenue.
Also attached is an Agreement that the lowest responsive, responsible, qualified Bidder would be
required to execute prior to starting the project.

Instructions to Bidders
Bids will be accepted until 4:00 PM on Thursday, June 4th. Bids will be evaluated based upon the Total
Bid, and the project will be awarded on the basis of the lowest responsive, responsible, qualified Bidder for
the work. The owner reserves the right to reject any or all Bids including without limitation nonconforming,
nonresponsive, unbalanced or conditional Bids. Owner further reserves the right to reject the Bid of any
Bidder if Owner believes that it would not be in the best interest of the Project to make an award to that
Bidder. Owner also reserves the right to waive all informalities not involving price, time or changes in the
Work and to negotiate Contract terms with the successful Bidder.
Accompanying this proposal must be a contractor's bid bond, certified check or cash deposit in the
amount of 5% of the bid made payable to the City of Lakeville, Minnesota, and the same is subject to

Project Scope
The City is requesting bids to construct a unique focal point water feature in Pioneer Plaza in Downtown
Lakeville. The engraved stone (boulder) water feature is intended to be functional, captivating, and artistic.
The City has provided the following specifications that are intended to guide the contractor to understand the
City's vision and construction design. The engraved stone water feature will be a custom fabricated and
designed system.
Contractor shall install a granite boulder which shall be engraved on two sides that includes a water feature.
The water feature will include a recirculating pump system which allows the water to cascade over both sides
of the engraved boulder covering a minimum of 70% of both faces of the stone. The engraved boulder will
be placed on a permeable paver system to allow the recirculation of the water to be utilized for the water
feature. (See attached plans for details/dimensions.)

Boulder Specifications
The following are the main components required for the boulder feature which shall be approved by owner
prior to the engraving of the stone:
• Type of stone: Glacial Granite
• Color: To be approved by owner so it is compatible with colored stamped concrete
border which will be a 413 Clay color by Solomon Colors.
• Size of stone: Minimum 3 ft. tall and 4 ft. wide and maximum 4 ft. tall and 5 ft. wide
• Elevated: 1 ft.
• Metal Framing System: Stainless steel framing connecting two slabs of glacial granite.
Contractor shall not use footings for the elevated engraved boulder frame. The elevated frame and
stand shall be buried in the base of the permeable pavers and constructed in a way to withstand park,
patron (i.e. climbing), and weather (i.e. high winds) related activities. The stainless steel framing
shall be recessed between the two slabs of glacial granite whereby covering the plumbing apparatus.
• Lettering: Engrave two sides of stone based on the 3' x 4' size stone as follows
(adjust dimensions for actual stone size):
➢ Side 1 facing East
o PIONEER PLAZA (6" high lettering)
o Train graphic (12" high x 36" long)
➢ Side 2 facing West
o PIONEER PLAZA (6" high lettering)
o Dedication wording (3" high lettering)
➢ Contractor shall provide the owner a proof of the engraving showing size and
layout of lettering and train graphic prior to the actual engraving of the stone.
Water Feature Specifications
The following are the main components of the water feature:
• Goulds PE41 pump
• Filtrific T40sp side pod
• Filtrific T75F filter tank
• 3" overflow pipe
• Heat ring
All plumbing to be sleeved under permeable pavers and future concrete sidewalk. Sleeving shall be sized to
allow pipe and fittings to slide easily within. All piping to be Schedule 40 PVC with solvent welded joints.
The existing irrigation system on site will be used as a water service for the water feature. Owner shall
connect the existing irrigation system as an autofill for the water feature; however, contractor shall install a
minimum 12" long stub fill line including a manual ball valve.
Contractor shall hire a licensed electrician to extend the existing electrical source to new pump location. All
wiring shall be sleeved under concrete walkway and permeable pavers.

Contractor shall connect the tank overflow to the existing storm sewer on site.
Permeable Paver Specifications
The following are the main components required of the 12 foot diameter circle of permeable pavers:
• Brand: Borgert Aqua Brick Permeable Pavers
• Color: Autumn Blend
• Size: 5" x 10" x 3 1/8"
• Pattern: Herringbone with soldier course
• Paver infill/openings: ASTM #8, #89 or #9
The cross section of the permeable paver system shall be as follows:
• Compacted virgin soil, sloped to outlet drain/return pipe location.
• The following 4 basin liner components shall cover the entire excavation area including the sides up
to but not extending past the bottom of the permeable pavers.
o Woven Geotextile laid directly on compacted and sloped virgin soil.
o 6 oz. boulder fabric
o 45 mil pond liner
o 6 oz. boulder fabric
• Schedule 40 PVC with perforations to allow water to be collected and returned to the water feature
pumping system. At exit point from permeable paver basin, pond liner and fabric layers shall be
carefully cut to allow drain/return pipe to seal to liners.
• ASTM #57 compacted base material; 14 inch minimum depth; actual depth dependent on field
elevations. Elevated metal framing system to be embedded in this layer.
• 1.5 — 2 inch bedding material composed of ASTM #8
• Permeable pavers with ASTM #8, #89 or #9 joint infill material
Contractor shall backfill and compact subgrade to eliminate settling of pavers and water feature.
Contractor shall use vertical metal edging as the paver edge restraint between the pavers and concrete
walkway.
Any damage done to turf areas outside of the construction limits shall be the responsibility of the
contractor to make the repairs at contractors cost. Construction limits shall be defined as 3' out from edge of
sidewalk.

finalize construction timeline and coordination with concrete contractor prior to commencement of project.
