HomeMy WebLinkAboutItem 06.c July 20, 2015 Item No.______ CHANGES TO POLICE DEPARTMENT POLICY MANUAL Proposed Action Staff recommends adoption of the following motion: Move to approve changes to Police Department Policy and Procedure Manual. Approval of the motion will result in changes to department manual. Overview Peace Officer Standards and Training (POST), State Law, Department organization and changes in practice all require updates and revisions to the police department policy and procedure manual. The proposed changes are attached. Primary Issues to Consider  Changes and updates are needed to comply with state law, POST mandate, and to remain current in practices.  All policies were presented to and discussed with the Public Safety Committee  Council Approval is required Supporting Information  Description of each policy modified, changed, or added. Budget – None Related Documents (CIP, ERP, etc.): _______________________________________ Community Values: Safety Throughout the Community Policy 100, Authority (New Policy) Notes how policy is changed, change in POST mandates, state law, or other government rule does not require approval by council. Policy 108, Retired Officer Concealed Firearms and LEOSA Act Created a policy that provides guidance on issuance of Retired cards to former LPD Officers Issuance of card is at the discretion of the Chief of Police Policy 204, Communications and Devices- Policy modified with language added for “smart phones”. Work expectations added regarding off-duty checking of E-mail, Devices will be kept in Department issued case, loss shall be reported immediately. Policy 221, Uniforms and Appearance- Policy changed to include ALL uniformed personnel, established color of uniform for each division, and ALL members issued a vest will wear ballistic vest when on patrol. Policy 301, Search and Seizure- removed out dated language regarding opposite sex pat- down and searching. Modernized language for tow sheet completion via E-mail Policy 303, Motor vehicle pursuits- Format change to mirror model policy. This makes it easier to insure we are following state law in regard to this policy. Eliminated out dated wording no longer used regarding “bumping and ramming”. Added definition for pursuit termination Policy 308, Missing and endangered persons- Model policy from the state copied due to changes in law. Policy 309, Domestic Abuse- State model policy copied due to changes in the law. Policy 311, Use of Police Vehicles- modernized policy to reflect current practice, defined marked, subdued marked, unmarked, and civilian appearance unmarked. Policy 312, Accident Investigation- LPD will now investigate city vehicle accidents unless there is injury or criminal behavior. Other language changed to reflect state law. Policy 315, Opticoms (EVP)- Change in terminology to Emergency Vehicle Preemption (EVP) is only change. Policy 325, Forfeitures- State Model Policy changes adopted Policy 326, Impartial Policing- State Model Policy changes adopted Policy 401, Field Training- Reference to 16 weeks removed Policy 408, Holding Cells- Opposite sex search policy brought up to date Policy 410, Blood Draws- Change to reflect that ALF and paramedics do not draw blood for LPD anymore Policy 415, Transporting Prisoners- Language regarding opposite sex transports removed. Policy 501, Reserve Unit- Creates a policy for reserve unit. This includes reserves into the entire policy manual instead of operating under by-laws that conflicted with other city policy. Policy 502, Reserve Unit Activation- Describes conditions when reserve unit should be utilized.
