HomeMy WebLinkAbout15-090(Reserved for Recording Data) CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 15-90 RESOLUTION APPROVING THE CONVEYANCE OF REAL PROPERTY WHEREAS, SBF Development Corp., ("SBF Development") is the owner of certain property within the City of Lakeville to be platted as Spirit of Brandtjen Farm Commercial 2nd Addition, Dakota County, Minnesota ("SBF Commercial 2nd Plat"); WHEREAS, SBF Development applied to the City for a vacation of a portion of Eagleview Drive originally platted within the Spirit of Brandtjen Farm Plat, which is included within the SBF Commercial 2nd Plat, and is legally described as follows: That part of the vacated Eagleview Drive, as dedicated per plat of SPIRIT OF BRANDTJEN FARM, according to the recorded plat thereof, Dakota County, Minnesota, lying northeasterly of the following described line and its northwesterly and southeasterly extensions: Beginning at the most easterly corner of Lot 1, Block 12, said SPIRIT OF BRANDTJEN FARM; thence southeasterly to the most northerly corner of Lot 1, Block 4, SPIRIT OF BRANDTJEN FARM 8TH ADDITION, according to the recorded plat thereof, Dakota County, Minnesota and said line there terminating. ("Vacated ROW"); WHEREAS, the Lakeville City Council approved the vacation on March 16, 2015, by City of Lakeville Resolution No. 15-27; 182481v1 WHEREAS, the City is the owner of Outlot TT, Spirit of Brandtjen Farm, Dakota soCounty Minnesota ("City Property') that abuts the Vacated ROW and holds an interest in the Vacated ROW; and WHEREAS, SBF Development has requested that the City convey its interest in the Vacated ROW to SBF Development to resolve title issues that prevent the recording of the SBF Commercial 2nd Plat; WHEREAS, in exchange for the conveyance of the Vacated ROW, some of the areas within the Vacated ROW will be included in outlots within the SBF Commercial 2nd Plat to be deeded to the City as required under the terms of the development contract for the SBF Commercial 2nd Plat; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakeville: 1. The City Council finds that conveyance of the Vacated ROW has no relationship to the comprehensive municipal plan. The requirements of Minn. Stat. §462.356 are hereby dispensed with. 2. The Mayor and City Clerk are hereby authorized to execute and deliver a quit claim deed from the City to SBF Development for the Vacated ROW upon simultaneous recording of the SBF Commercial 2nd Plat and conveyance of outlots to the City as required in the development contract for the SBF Commercial 2nd Plat.
