CITY COUNCIL MEETING MINUTES
September 8, 2015
Mayor Little called the meeting to order at 7:00 p.m. in the Council Chambers at City Hall. The
pledge of allegiance to the flag was given.
Members Present: Mayor Little, Council Members Davis, Swecker, Anderson and LaBeau
Staff Present: Justin Miller, City Administrator; Elliott Knetsch, City Attorney; Jeff Long,
Police Chief; Chris Petree, Public Works Director; David Olson, Community & Economic

5. Presentations/Introductions
Jay Young, representing the Rotary Club of Lakeville, presented a check in the amount of
$12,000 to be used toward the purchase of benches at Pioneer Plaza.
Chief Meyer presented the Fire Department 2nd Quarter report.
Chris Petree presented the August Public Works Department monthly report.
Consent Agenda
Motion was made by Anderson, seconded by LaBeau, to approve the following consent agenda
items:
a. Claims for payment
b. Minutes of the August 17, 2015 City Council meeting
c. Minutes of the August 24, 2015 Council work session
d. Set a budget work session to be held on September 14 at 6:00 p.m.
e. Reschedule the September 281 Council work session to September 21" at 5:30 p.m.

f. Amendment to the Joint Powers Agreement with Vermillion River Watershed Joint Powers
Organization for water quality improvements along Hamburg Avenue

h. Resolution No. 15-102 approving off-site gambling for the Lakeville Lions

7. Eric Schraeder Interim Use Permit
Mr. Schraeder requested Council approval of an interim use permit that would allow him to
keep up to two red tailed hawks for the purpose of falconry in an accessory structure at the
home he is constructing at 18855 Iden Way. The raptors, Mr. Schraeder stated, are used for
hunting.
Mr. Morey explained that red tailed hawks are not listed as a permitted animal in Lakeville's
zoning ordinance. However, a provision does exist in the zoning ordinance that would allow
other birds not listed as either household pets or farm animals by interim use permit. In
reviewing this request, the focus for City staff was on criteria pertaining to compatibility with
the surrounding uses.
Mr. Morey stated that Mr. Schraeder has a falconry license issued by the Minnesota DNR, and
the interim use permit requires that he maintain his DNR license. The permit also stipulates
that there shall be no hunting from the property.

The Planning Commission recommended approval of the interim use permit on a 4-3 vote.
Commission members who voted against the permit supported the use; however, they had
concerns with the ordinance language and lack of specific performance standards related to this
type of use. The Planning Commission directed staff to bring this matter back to a future work
session for further clarification. Mr. Morey stated this will occur this winter when the zoning
ordinance is reviewed for potential updates. Staff recommends approval of the interim use
permit subject to six conditions.
Council Member Swecker stated she feels performance standards need to be in place prior to
allowing a use to occur. Because there are no specific performance standards for this type of
use, she does not believe an interim use permit is appropriate for this request.
Mayor Little asked how this use compares to the raising of chickens.
Mr. Morey stated that chickens are defined as farm animals in the zoning ordinance.
Motion was made by Swecker, seconded by Anderson, to approve findings of fact and an
interim use permit for Eric Schraeder to allow the keeping of raptors at 18855 Iden Way.
Roll call was taken on the motion. Ayes — Davis, Little, Anderson, LaBeau
Swecker voted nay.
