HomeMy WebLinkAboutItem 06.cOctober 14, 2015 Item No.________ CALL A PUBLIC HEARING TO ASSESS CITY CODE VIOLATIONS OCTOBER 19, 2015 CITY COUNCIL MEETING Proposed Action Staff recommends adoption of the following motion: Move to call a public hearing November 16, 2015 for City Code violations in 2015. Passage of this motion will result in a public hearing on the proposed assessments. Overview Notices were sent out to property owners who were in violation of various City Codes. Staff performed inspections of numerous violations, including circumstances that created hazardous environments and blight. Staff authorized the contractual mowing of grass, removal of weeds, and property maintenance on properties where the property owners had failed to correct the violation. Staff requests that the City Council call a public hearing to be conducted on November 16, 2015 to assess the cost of code enforcement on the properties listed on the attached assessment summary. The procedure of assessing code enforcement actions is in accordance with Minnesota Statutes, Chapter 429.061. The affected parcels will each be assessed the actual contractual cost incurred, in addition to $90.00 for the administrative fee, $55.00 prorated to each property owner for publication of the legal notice, 18% interest from the date of the public hearing, $4.15 for the Dakota County Special Assessment fee, plus the re-inspection fees consistent with the fee schedule and City policy. The City Clerk is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing. The Notice shall state the total cost of the code violation correction. Notice will also be mailed to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearing. The areas to be assessed are within the City of Lakeville. The total amount to be specially assessed against the properties is $1,270.00. The proposed assessment roll is on file for public inspection at the City Clerk’s office. Written or oral objections will be considered at the City Council meeting. No appeal may be taken as to the amount of the assessment unless a signed written objection is filed with the City Clerk prior to the hearing or presented to the presiding officer at the hearing. An owner may appeal an assessment to District Court pursuant to Minnesota Statutes 429.081, by serving notice of the appeal upon the Mayor or City Clerk of the City within thirty (30) days after the adoption of the assessment and filing such notice with the District Court within ten (10) days after service upon the Mayor or City Clerk.
