HomeMy WebLinkAboutItem 08October 29, 2015 Item No._______ AVONLEA 2ND ADDITION FINAL PLAT NOVEMBER 2, 2015 CITY COUNCIL MEETING Proposed Action Staff recommends adoption of the following motion: Move to approve: 1) a resolution approving the final plat of Avonlea 2nd Addition; and 2) a resolution vacating public drainage and utility easements. Passage of this motion will re-plat a portion of the row townhome unit lots in the first phase of the Avonlea planned unit development (PUD) to allow the buildings to meet the setback requirements. Overview Mattamy Homes representatives have submitted final plat and easement vacation applications for Avonlea 2nd Addition, which is a re-plat of the unit lots for four row townhome buildings and one HOA outlot to correct an error in the layout of the row townhomes located on the east side of Cedar Avenue (CSAH 23) and south of 181st Street. The error occurred when the row townhome layout on the Avonlea final plat did not take into account modifications to the width of the row townhomes approved with the Avonlea preliminary plat/PUD. The specific changes incorporated into this re-plat are identified in the attached application narrative dated October 5, 2015. The City Council approved the Avonlea preliminary plat, Comprehensive Plan amendment, and an ordinance establishing the Avonlea PUD at their April 6, 2015 meeting, and the Avonlea final plat at a June 29, 2015 special meeting. One row model townhome building is currently under construction in this area of the Avonlea PUD. Primary Issues to Consider Why is the City Council holding the public hearing for the easement vacation? The City Attorney has advised staff that the City Council can hold public hearings for easement vacation applications. This will save the developer two weeks of time to process their applications. NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council: 1. The final plat of Avonlea 2nd Addition is hereby approved. 2. NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council: 1. The following drainage and utility easements are hereby vacated: The drainage and utility easements as dedicated on the plat of AVONLEA as delineated on Lot 1 and Lot 4, Block 15, Lot 5, Block 16, Lot 5, Block 17, Lot 8, Block 18 and Outlot Q, AVONLEA, according to the recorded plat thereof, Dakota County, Minnesota. 2. The plat is adjacent to CSAH 23, and is therefore subject to the Dakota County Contiguous Plat Ordinance. This is a replat of a recently recorded plat on September 14, 2015, which includes only some minor lot changes. The Plat Commission has approved the preliminary and final plat and will recommend approval to the County Board of Commissioners when the plat is submitted in signed mylar form. Mylars should be submitted to the County Board within one year of the Plat Commission’s final approval. Traffic volumes on CSAH 23 are 17,800 ADT and are anticipated to be 33,000 ADT by the year 2030. These traffic volumes indicate that current Minnesota noise standards for residential units could be exceeded for the proposed plat. Residential developments along County highways commonly result in noise complaints. In order for noise levels from the highway to meet acceptable levels for adjacent residential units, substantial building setbacks, buffer areas, and other noise mitigation elements should be incorporated into this development. No work shall commence in the County right of way until a permit is obtained from the County Transportation Department and no permit will be issued until the plat has been filed with the County Recorder’s Office. The Plat Commission does not review or approve the actual engineering design of proposed accesses or other improvements to be made in the right of way. Nothing herein is intended to restrict or limit Dakota County’s rights with regards to Dakota County rights of way or property. The Plat Commission highly recommends early contact with the Transportation Department to discuss the permitting process which reviews the design and may require construction of highway improvements, including, but not limited to, turn lanes, drainage features, limitations on intersecting street widths, medians, etc. Please contact Gordon McConnell regarding permitting questions at (952) 891-7115 or Todd Tollefson regarding Plat Commission or Plat Ordinance questions at (952) 891-7070.
