HomeMy WebLinkAboutItem 09November 12, 2015 Item No.________ PUBLIC HEARING 2015 CITY CODE VIOLATIONS November 16, 2015 City Council Meeting Proposed Action Staff recommends adoption of the following motion: Move to approve a resolution adopting the assessment of City Code violations for 2015. Passage of this motion will result in the levy of special assessments for expenses incurred by the City in 2015 for City Code violations. Overview Notice of Special Assessment letters were mailed on October 20, 2015 to property owners who were in violation of various provisions of the City Code including Title 4-1-3 (Length of Weeds and Grass), Title 6-2-10 (Exterior Storage), Title 11-19-11 (Off-Street Parking), and Title 11-16-29 (Waste). During the past year, staff performed inspections and authorized the contractual mowing of grass, removal of weeds, exterior storage, and junk car violations where the property owners had failed to correct the violations. The total amount proposed to be assessed to the parcels is $1,270.00, including 18% interest through 2016. Staff has not received any written objections from the owners of the properties being assessed for the City Code violations. Primary Issues to Consider None Supporting Information • Resolution • Special Assessment Roll Daryl Morey, Planning Director Financial Impact: $1,270.00 Budgeted: N/A Source: N/A___________________________ Related Documents (CIP, ERP, etc.): ______________________________________________ Community Values: Good Value for Public Services__________________________________ CITY OF LAKEVILLE RESOLUTION NO._________ RESOLUTION ADOPTING ASSESSMENT OF CITY CODE VIOLATIONS FOR 2015 WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met, heard and passed upon all objections to the proposed special assessment of City Code violations in 2015. NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakeville, Minnesota: 1. Such proposed Assessment No. 1332 in the amount of $1,270.00 is hereby accepted and shall constitute the special assessment against the land named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. The Special Assessment was calculated as follows: Contractual mowing, property maintenance $ 90.00 Inspection Fee 420.00 Special Assessment Administrative Fee 450.00 Invoice Late Fees 22.60 Legal Notice Publication 55.00 Dakota County Special Assessment Fee 20.75 Interest 211.65 Total Proposed Special Assessment $ 1,270.00 2. Such assessments shall be considered payable and collected with the taxes payable in 2016 and shall bear interest at the rate of 18% per annum from the date of the adoption of this assessment resolution to December 31, 2016. 3. The owner of the property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution. The owner may, at any time following certification, pay to the City Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. 4. The City Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes.
