RESOLUTION NO. __________
RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT
OF WARWEG ADDITION
WHEREAS, the owner of the plat described as Warweg Addition has requested
preliminary and final plat approval; and
WHEREAS, the preliminary and final plat was reviewed by the Planning
Commission and the Parks, Recreation and Natural Resources Committee; and
WHEREAS, the preliminary and final plat are acceptable to the City.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. The preliminary and final plat for Warweg Addition is hereby approved
subject to the terms of the purchase agreement dated March 2, 2015 and
amended on November 16, 2015.
2. The Mayor and City Clerk are hereby directed to sign the final plat mylars.
3. The City Clerk is directed to file a certified copy of this resolution with the
Dakota County Recorder.
ADOPTED by the Lakeville City Council this 7th day of December, 2015.

RESOLUTION NO. 15-___
RESOLUTION VACATING PUBLIC STREET AND ALLEY RIGHT-OF-WAY
WHEREAS, the Planning Commission has conducted a public hearing, preceded
by two (2) weeks published notice, to consider the following described easement and
right-of-way vacation, and
WHEREAS, the City Council has determined that it is in the public interest to
approve the right-of-way vacation.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. The following public street and alley right-of-way hereby vacated:
a. Vacate Taft Avenue: That part of Taft Avenue lying northerly of Block 3
and Lots 9 through 12, Block 4 and southerly of Lot F and Lot G.
b. Vacate Alley: Adjacent to Lots 5-12, Block 4, Lenihan’s Lots Antler’s
Park.
c. Vacate 3rd Street: That part of 3rd Street Lying south of Taft Avenue,
easterly of Block 4, and westerly of Block 3, except the easterly ½ of said
3rd Street adjacent to Lot 1, Block 3 and the southerly half of the alley
adjacent to Block 3, all in Lenihan’s Lots Antlers Park.
d. Vacate Alley: The Northerly ½ of the alley adjacent to Lots 17-24, Block
3, Lenihan’s Lots Antlers Park.
e. Vacate Alley: Lying north of Lot 36, Block 8, Lenihan’s Lots Antlers Park.
f. Vacate Alleys: All of the alleys within Block 9, Lenihan’s Lots Antlers
Park.
g. Vacate Nicollet Avenue: All of Nicollet Avenue lying south of Block 9, east
of Lakeview Avenue and Southwesterly of Summit Avenie, Lenihan’s Lots
Antlers Park.
h. Vacate Street: Lying east of Block 8 and lying west of Block 7, Lenihan’s
Lots Antlers Park.
i. Vacate Summit Avenue: Lying westerly of Ipava Avenue and northerly of

j. Vacate Short Avenue: That part lying south of the Minneapolis, Northfield
and Southern Railroad right-of-way and north of the south line of Block
29, Lenihan’s Lots Antlers Park.
k. Vacate a portion of Elm Avenue: The west 30 feet of Elm Avenue lying
south of a line described as follows: Commencing at said south west
corner of Lot 4, Block 28; thence north along the east line of said Lot 4 a
distance of 126.0 feet to the point of beginning of the line to be
described; thence east at a right angle to the east line of said Elm
Avenue and said line there terminating, in Lenihan’s Lots Antlers Park.
l. Vacate Dakota Boulevard: That part of Dakota Boulevard lying
southeasterly of Ipava Avenue and lying northeasterly of the
northwesterly extension of the southwesterly line of the following
described parcel: Beginning at the intersection of the east right of way of
Dakota oulevard and the southerly right-of-way of the Minneapolis,
Northfield and Southern Railroad; thence southeasterly along said
southerly right-of-way a distance of 277.00 feet; thence deflecting
87°32'40" to the right a distance of 119.4 feet; thence deflecting 80°25' to
the right a distance of 200.0 feet to the said east right-of-way of Dakota
Boulevard; thence northeasterly along said east right-of-way a distance of
183.1 feet to the point of beginning, all in Block 6, Lenihan's Lots, Antlers
Park.
2. The City Clerk is directed to file a certified copy of this resolution with the
Dakota County Recorder.

Re: WARWEG ADDITION
The Dakota County Plat Commission met on November 30, 2015, to consider the final plat of the above
referenced plat. The plat is adjacent to CSAH 50, and is therefore subject to the Dakota County Contiguous
Plat Ordinance.
The proposed plat includes existing platted property to be combined into five outlots and existing dedicated
roadways to be vacated. The right of way needs for a four-lane divided roadway are 75 feet of half right of
way. The plat shows 75 feet of half right of way along Outlot A from the existing centerline of CSAH 50
(Kenwood Trail). CSAH 50 is planned to be reconstructed into a four-lane divided roadway in 2017. With the
existing railroad track that parallels CSAH 50 on the southerly right of way, the future centerline alignment
will be required to move northerly. Therefore, additional right of way will be needed from Outlot A in the
future to accommodate the future reconstruction project (CP 50-19).
This plat is located south of the Jaguar neighborhood, which has over 250 residences with only one access to
the public roadway system (via Jaguar Avenue at CSAH 50). The County Highway 50 Corridor Study identified
the need for another connection to the public roadway system for this neighborhood. Such a connection
would need to happen through this property. This is also a connection that will be necessary to provide
convenient access for the neighborhood during the upcoming CP 50-19 reconstruction project. The proposed
plat allows for a connection to Italy Avenue from 199th Street or from Itasca Avenue to accomplish this
second access for the Jaguar neighborhood. If this is not the intended location for such a connection, then
the plat should be revised to reflect the preferred location.
The Plat Commission has approved the final plat provided that the described conditions are met and will
recommend approval to the County Board of Commissioners when the plat is submitted in signed mylar
form. Mylars should be submitted to the County Board within one year of the Plat Commission’s final
approval.
Traffic volumes on CSAH 50 are 13,800 ADT and are anticipated to be 19,000 ADT by the year 2030. These
traffic volumes indicate that current Minnesota noise standards for residential units could be exceeded for
the proposed plat. Residential developments along County highways commonly result in noise complaints.
In order for noise levels from the highway to meet acceptable levels for adjacent residential units, substantial
building setbacks, buffer areas, and other noise mitigation elements should be incorporated into this
development.
No work shall commence in the County right of way until a permit is obtained from the County
Transportation Department and no permit will be issued until the plat has been filed with the County
Recorder’s Office. The Plat Commission does not review or approve the actual engineering design of
proposed accesses or other improvements to be made in the right of way. Nothing herein is intended to
restrict or limit Dakota County’s rights with regards to Dakota County rights of way or property. The Plat
Commission highly recommends early contact with the Transportation Department to discuss the permitting
process which reviews the design and may require construction of highway improvements, including, but not
limited to, turn lanes, drainage features, limitations on intersecting street widths, medians, etc. Please

Re: WARWEG ADDITION
The Dakota County Plat Commission met on October 19, 2015, to consider the preliminary plat of the above
referenced plat. The plat is adjacent to CSAH 50, and is therefore subject to the Dakota County Contiguous
Plat Ordinance.
The proposed plat includes existing platted property with roads to be vacated that will be replatted into
outlots. The right of way needs for a four-lane divided roadway is 75 feet of half right of way. Outlot A,
located north along CSAH 50, should dedicate 75 feet of half right of way. Restricted access should be shown
along all of CSAH 50 with future access to the site being along Ipava Avenue. A quit claim deed to the County
for restricted access is required at the time of recording the plat mylars.
The Plat Commission has approved the preliminary plat provided that the described conditions are met. The
Ordinance requires submittal of a final plat for review by the Plat Commission before a recommendation is
made to the County Board of Commissioners.

building setbacks, buffer areas, and other noise mitigation elements should be incorporated into this
development.
No work shall commence in the County right of way until a permit is obtained from the County
Transportation Department and no permit will be issued until the plat has been filed with the County
Recorder’s Office. The Plat Commission does not review or approve the actual engineering design of
proposed accesses or other improvements to be made in the right of way. Nothing herein is intended to
restrict or limit Dakota County’s rights with regards to Dakota County rights of way or property. The Plat
Commission highly recommends early contact with the Transportation Department to discuss the permitting
process which reviews the design and may require construction of highway improvements, including, but not
limited to, turn lanes, drainage features, limitations on intersecting street widths, medians, etc. Please
