AMENDMENT TO CITY CODE
Proposed Action
Staff recommends adoption of the following motion: Move to amend City Code by replacing
the title “Park Ranger” with “Community Service Officer”.
Passage of this motion will result in the city code reflecting current staff titles in use.
Overview
The job title of Park Ranger was eliminated in 2009. Community Service Officers now perform
those duties.
Staff recommends replacing the title to reflect current city titles.
Primary Issues to Consider
• Why do CSOs enforce parking laws? The police department is able to utilize staff
time for duties by utilizing CSOs for this purpose.
• Is parking a problem in city parks? During high use times, CSOs need the ability to
enforce parking laws.

CITY CODE – AS IT CURRENTLY READS:
1-4-1-1: ENFORCEMENT:
The zoning administrator, director of community & economic development director, assistant director of
community development, community service officers, park rangers, fire chief, fire marshal and chief building
official within their job descriptions or as otherwise authorized by ordinance are expressly authorized to institute in
the name of the city any appropriate actions, civil or criminal, including the issuance of a citation in lieu of arrest,
against a person, firm or corporation who violates any provision of this code. Pursuit of one remedy shall not bar
or act as a limitation on any other remedy the city may have at law. (Ord. 879, 6-6-2011)
7-1-3: MOTOR VEHICLE REGULATIONS AND RESTRICTIONS:
D. Parking Restrictions: The city council, by motion, may designate parking areas and restrict the length of time
parking shall be permitted at any place within city parks. City park rangerscommunity service officers may issue
citations for violations. Park rangersCommunity service officers are authorized and empowered to have removed
any vehicle from any park in violation of this section and to have such vehicle placed in storage. Such vehicles
shall not be recovered until reasonable costs of storing and towing the same have been paid. If any vehicle held
or stored upon which there are charges for storage or towing or both, shall not be reclaimed, there shall be
imposed upon such vehicle a possessory lien in the amount so charged and unpaid and should the owner thereof
fail to pay the same, the possessory lien may be foreclosed in the manner provided for by law. A person who is
entitled to possession of an impounded vehicle shall have the right, a postimpoundment hearing to determine
probable cause to impound the vehicle under this subsection if such person files a written demand for the hearing
within five (5) days after impounding, excluding Saturdays, Sundays, and legal holidays. The demand shall be
made to the city administrator of the city or his designee, who shall serve as the hearing officer for such
purposes. Not more than seventy two (72) hours after impoundment of a vehicle which has not been redeemed,
the city shall mail a notice to the registered owner of the vehicle, if such may be secured through the license
number, at the address provided by the motor vehicle license agency of the state or providence in which the
vehicle is registered. The notice shall contain the full particulars about the impoundment, the procedure for
redemption, and the opportunity for a hearing to test the propriety of the impoundment. If the hearing officer
determines that there is no probable cause for the impoundment under this subsection, the city shall pay the
towing and storage charges and the vehicle shall be released forthwith to the person entitled to possession. In
every other case, the vehicle shall be released only when the fees for towing and storage are paid by the person
recovering possession. (Ord. 383, sec. 1, 7-5-1989)

The city's park and recreation director is authorized to establish rules regulating conduct in city parks. Copies of
the rules shall be posted in each park. Any person who violates park rules may be ordered to cease and desist by
a police officer or park rangercommunity service officer. If the violation continues after an order to cease and
desist, a police officer or park rangercommunity service officer may order the violator to leave the park. Failure to
leave the park when ordered to do so is a misdemeanor. Citations may be issued by a park rangercommunity
service officer and/or police officer. (Ord. 384, sec. 1, 7-5-1989)

AN ORDINANCE AMENDING TITLES 1 AND 7 OF THE
LAKEVILLE CITY CODE CONCERNING ADMINISTRATION
AND PUBLIC WAYS AND PROPERTY
THE CITY COUNCIL OF THE CITY OF LAKEVILLE, MINNESOTA ORDAINS:
SECTION 1. Section 1-4-1-1 of the Lakeville City Code is amended to provide as
follows:
