SPIRIT OF BRANDTJEN FARM 13th ADDITION EASEMENT VACATION
FEBRUARY 1, 2016 CITY COUNCIL MEETING
Proposed Action
Staff recommends adoption of the following motion: Move to approve a resolution vacating a
drainage and utility easement in Spirit of Brandtjen Farm 13th Addition.
Passage of this motion will vacate a boundary drainage and utility easement along the shared side lot
line of Lots 1 and 2, Block 1, Spirit of Brandtjen Farm 13th Addition to allow a lot line adjustment
between the two lots.
Overview
Robert Thomas Homes representatives are requesting the vacation of the drainage and utility
easement along the shared side lot line of Lots 1 and 2, Block 1, Spirit of Brandtjen Farm (SBF) 13th
Addition. Following approval of the easement vacation, Planning Department staff will approve an
administrative subdivision to allow the shared side lot line to be adjusted to accommodate the needs
of the existing homeowner on Lot 1. Lot 2 is currently vacant.
The Planning Commission held a public hearing on the easement vacation request at their January 21,
2016 meeting and unanimously recommended approval. There was no public comment. The utility
companies have been informed of the easement vacation request and no objections have been
received by staff. A new drainage and utility easement must be established over the new shared side
lot line prior to staff approval of the administrative permit for the lot line adjustment.

RESOLUTION VACATING PUBLIC DRAINAGE AND UTILITY EASEMENTS
WHEREAS, the Planning Commission has conducted a public hearing, preceded
by two (2) weeks published notice, to consider the following described easement
vacation, and
WHEREAS, the City Council has determined that it is in the public interest to
approve the easement vacation.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. Those particular 5.00 foot drainage and utility easements, originally dedicated
in the recorded plat of SPIRIT OF BRANDTJEN FARM 13TH ADDITION,
Dakota County, Minnesota and now to be vacated, which adjoin the east line
of Lot 1, Block 1, in said plat except the north and south 10.00 feet thereof.
2. The City Clerk is directed to file a certified copy of this resolution with the
Dakota County Recorder.

Application Action Deadline: February 8, 2016
Robert Thomas Homes representatives have submitted an application to vacate the existing drainage
and utility easement along the shared side lot line of Lots 1 and 2, Block 1, Spirit of Brandtjen Farm 13th
Addition. The reason for the request is to shift the shared lot line slighly to the east to better
accommodate the driveway for the existing house on Lot 1. This request will also require staff
approval of an administrative subdivision/lot combination. A new 10 foot wide drainage and utility
easement will be dedicated along the new shared lot line. The proposed lots and house setbacks will
comply with the SBF PUD standards.
Staff has forwarded the easement vacation documents to the utility companies for review. There are
no City utilities within the easement to be vacated. Planning staff recommends approval of the
drainage and utility easement vacation subject to any comments received from the utility companies
and the recording of a 10 foot wide boundary drainage and utility easement along the new shared lot
line as depicted on Exhibit C.
