Passage of this motion will result in compensation changes effective December 29, 2015. Overview The attached Employment Agreement includes changes to the prior terms of employment including salary, performance evaluation, paid time off, and discontinues the annual automobile allowance. The Personnel Committee has reviewed the agreement and is recommending its approval. City Attorney Roger Knutson has reviewed and approved the language. Miller ("Employee"). The parties agree as follows: 1. EMPLOYMENT AGREEMENT. The parties previously entered into an Employment Agreement dated November 17, 2014 (“Agreement”). The Agreement shall remain in full force and effect except as specifically amended by this First Amendment. 2. SALARY. Effective December 29, 2015 Employer shall pay Employee an annual salary of $148,500, payable in regular installments according to the Employer’s normal payroll practices and subject to appropriate withholdings. Except as otherwise provided herein, Employer will review Employee’s compensation on an annual basis during the term of this Agreement and the Agreement shall be amended to reflect any salary adjustments that are provided or required by the Employer’s compensation policies. 3. PAID TIME OFF (PTO). PTO of the Employee shall continue to accrue at the rate of 20 days per year based on the 5th year of employment in accordance with the City’s policy. In addition to normal accruals, Employee will be credited with 40 hours of PTO on January 1, 2016 and annually thereafter. The administration and use of PTO by the Employee shall be consistent with the City’s Personnel Policy. 4. AUTOMOBILE. Employee will not receive an automobile allowance. Employee will be entitled to reimbursement of qualified automobile expenses at the appropriate IRS determined rate. EMPLOYER – City of Lakeville EMPLOYEE ___________________________ Mayor Justin J.
