APPROVE AN AMENDMENT TO JOINT POWERS AGREEMENT WITH VERMILLION
RIVER WATERSHED JOINT POWERS ORGANIZATION FOR WATER QUALITY
IMPROVEMENTS ALONG HAMBURG AVENUE
Proposed Action
Staff recommends adoption of the following motion: Move to approve an amendment to Joint
Powers Agreement (JPA) with Vermillion River Watershed Joint Powers Organization (VRWJPO)
for water quality improvements along Hamburg Avenue, in conjunction with City Project 15-12.
Passage of this motion will amend the timeline for completion associated with the water quality
improvement project.
Overview
At its August 3, 2015 meeting, the Lakeville City Council approved a Joint Powers Agreement
(JPA) with the Vermillion River Watershed District Joint Powers Organization (VRWJPO) and a
Cost Share Contract Dakota County Soil and Water Conservation District (DCSWCD), for the
Hamburg Avenue Water Quality Improvement Project, City Improvement Project 15-12.
At its September 8, 2015 meeting, the Lakeville City Council approved an amendment to the
Joint Powers Agreement (JPA) with the with the Vermillion River Watershed District Joint Powers
Organization (VRWJPO) to reflects up to $140,000 in VRWJPO and up to $30,000 in City of
Lakeville funding after bids were received for the project.
Construction began in the fall of 2015, and due to frost depths encountered during the month
of November; final restoration of the ditch could not be completed. Final grading work and turf
establishment will take place in the spring of 2016. As such, the JPA has been amended to
remain in effect until August 31, 2016 to allow sufficient time for final restoration and payment
to the contractor under the terms of the JPA.
Primary Issues to Consider
When will all work on the project be completed? It is expected all work will be
completed by June, 2016.
