HomeMy WebLinkAboutItem 06.gFebruary 4, 2016 Item No.________ ORDINANCE AMENDING TITLE 3, CHAPTER 1 OF THE LAKEVILLE CITY CODE Proposed Action Staff recommends adoption of the following motion: Move to adopt an ordinance amending Title 3, Chapter 1 of the Lakeville City Code concerning alcoholic beverages. Passage of this motion adds the off-sale brewpub license and small brewer off-sale malt liquor license in accordance with Minnesota statutes 340A. It also amends the fee schedule with respect to cocktail room, brewpub and taproom licenses. Overview The proposed ordinance provides clarification on the types of licenses allowed by state statute and establishes fees for those licenses. An applicant for a cocktail room, brewpub or taproom license would not be required to pay the additional $300 fee if that applicant has also applied for a full on-sale liquor license. The current language related to multiple licenses for one location was not specific to cocktail rooms, brewpubs and taprooms, which was the original intent. The annual off-sale fee is being established at $50. Brewpubs and small brewers are only allowed to sell malt liquor produced and packaged on the licensed premise at off-sale. Section 3-1-4(J) of the Lakeville City Code is amended to provide to provide as follows: J. “On-Sale Brewpub License”: On-sale brewpub licenses shall be issued only in accordance with Minnesota Statutes 340A. SECTION 2. Section 3-1-4 of the Lakeville City Code is amended by adding the following: L. “Off-Sale Brewpub License”: Off-sale brewpub licenses shall be issued only in accordance with Minnesota Statutes 340A. M. “Small Brewer Off-Sale Malt Liquor License”: Small brewer off-sale malt liquor licenses shall be issued only in accordance with Minnesota Statutes 340A. SECTION 3.
