HomeMy WebLinkAboutItem 06.nFebruary 16, 2016 Item No.________ RESOLUTION APPROVING MASTER SUBSCRIBER AGREEMENT FOR MINNESOTA COURT DATA SERVICES Proposed Action Staff recommends adoption of the following motion: Move to approve resolution approving Master Subscriber Agreement with the State of Minnesota, Office of State Court Administration, Information Technology Division. Passage of this motion will allow the Lakeville City Attorney prosecution access to Court Data. Overview The use of Court Data Services will assist the City Attorney in the efficient performance of duties as required or authorized by law or court rule in connection with any civil, criminal, administrative or arbitral proceeding in any Federal, State or local court or agency or before any self-regulatory body. The use of Court Data Services may involve one-way or two-way transmission of information, some of which may include court information that is not accessible to the public and which may not be disclosed without prior approval of the appropriate court or record custodian. The Master Subscriber Agreement remains in effect until terminated by either party. There are no fees for this service. Supporting Information • Master Subscriber Agreement Charlene Friedges City Clerk Financial Impact: None at this time Budgeted: Source: Community Values: Good Value for Public Services and Safety Throughout the Community CITY OF LAKEVILLE RESOLUTION NO. 16-_______________ RESOLUTION APPROVING MASTER SUBSCRIBER AGREEMENT FOR MINNESOTA COURT DATA SERVICES FOR GOVERNMENT AGENCIES WHEREAS, the City of Lakeville, on behalf of its City Attorney, for the purpose of assisting in the efficient performance of its governmental duties as required or authorized by law or court rule in connection with any civil, criminal, administrative, or arbitral proceeding in any Federal, State or local court, desires to enter into a Master Subscriber Agreement for Court Data Services, to use systems and tools available from the Minnesota Judicial Branch (the Court) for which the City is eligible, including MGA (Minnesota Government Access) and court records and documents through MNCIS (Minnesota Court Information System . NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakeville, Minnesota, as follows: 1. That Master Subscriber Agreement for Minnesota Court Data Services for Governmental Agencies by and between the Court, acting through its Information Technology Division of State Court Administration, and the City of Lakeville, on behalf of its City Attorney, is hereby approved. 2. That the City Attorney, or his or her successor, is designated the Authorized Representative. The Authorized Representative is also authorized to sign any subsequent amendment or agreement that may be required by State Court Administration to maintain the City’s government access to the systems and tools offered by the Court pursuant to the Master Subscriber Agreement. 3. That the Mayor and City Clerk for the City of Lakeville are authorized to sign the Master Subscriber Agreement for Minnesota Court Data Services for Government Agencies.
