HomeMy WebLinkAboutItem 03B CITY OF LAKEVILLE PLANNING COMMISSION WORK SESSION MINUTES April 7, 2016 Chair Swenson called the work session to order at 8:05 p.m. Members Present: Chair Jason Swenson, Karl Drotning, Scott Einck, Pat Kaluza, Jason Kelvie, Brooks Lillehei, and Paul Reuvers Members Absent: None Staff Present: Planning Director Daryl Morey and Associate Planner Frank Dempsey Others Present: John and Tammy Stern, 17438 Goodland Court Stern Building Setback Variance Discussion John and Tammy Stern were present and informed the Planning Commission that they are planning an addition to the back of their house located at 17438 Goodland Court. The proposed addition would need a variance of approximately seven feet from the 30 foot rear yard setback requirement due to the shallow depth of their lot, which is located at the end of a cul-de-sac street. The Sterns stated they have spoken to their neighbors about their addition and the need for a variance and none have expressed any opposition. The Planning Commission discussed the seven review criteria listed in Section 11-6-5 of the Zoning Ordinance for the consideration of variance requests. The Planning Commission stated they do not feel that Criteria C, which states that the plight of the landowner is due to circumstances unique to the property not created by the landowner, is being met. As such, they cannot support this variance request. The Planning Commission suggested the Sterns work with Planning Department staff on alternatives that would meet Zoning Ordinance setback requirements. The Sterns thanked the Planning Commission for their time and consideration. The work session was adjourned at 8:35 p.m. Respectfully submitted, Daryl Morey, Planning Director
