HomeMy WebLinkAboutItem 06.t Date: Item No. RESOLUTION AWARDING CONTRACT FOR 2016 MISCELLANEOUS ROADWAY REPAIRS AND OVERLAYS AND APPROVE CHANGE ORDER NO. 1 Proposed Action Staff recommends adoption of the following motion: Move to award the contract for 2016 Miscellaneous Roadway Repairs and Overlays, City Project 16-01 to Northwest Asphalt, Inc. with a bid in the amount of $998,841.97 and approve Change Order No. 1 for the project. Overview At its February 16, 2016 meeting, the Lakeville City Council approved plans and specifications for City Project 16-01. On Friday, March 25, 2016 at 10:00 a.m. the City received four bids for City Project 16-01. The bids ranged from a low bid of $998,841.97 submitted by Northwest Asphalt, Inc. to a high bid of $1,308,368.85. The trail improvements bid with the project came in higher than was budgeted, and so Change Order No. 1 for the project reflects the removal of Schedules E and F for the project, which are the Dakota Heights Trail and Casperson Park improvements, respectively. Deletion of these schedules will result in a reduction of $34,881.53 from the original contract price and a scope of work that meets the 2016 budget. It is proposed that the Dakota Heights Trail and Casperson Park will be budgeted for improvements in 2017. A summary of the budgeted and actual project costs, which reflects the net after Schedules E and F are removed from the scope of the project with approval of Change Order No. 1, is attached. CITY OF LAKEVILLE RESOLUTION NO._________ RESOLUTION AWARDING CONTRACT FOR 2016 MISCELLANEOUS ROADWAY REPAIRS AND OVERLAYS City Improvement Project 16-01 WHEREAS, the City of Lakeville received sealed bids on Friday, March 25, 2016 at 10:00 a.m. for the 2016 Miscellaneous Roadway Repairs and Overlays, City Project 16-01; and WHEREAS, the lowest responsible bid was from Northwest Asphalt, Inc. NOW, THEREFORE, LET IT BE RESOLVED that the City Council of the City of Lakeville, Minnesota: Hereby awards the contract to the lowest responsible bidder that meets all the bid requirements, Northwest Asphalt, Inc., with a bid in the amount of $998,841.97. The construction is proposed to be completed as specified in the contract documents. ADOPTED by the Lakeville City Council this 18 th day of April, 2016. D A T E _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ M o n i c a H e i l , P E O p e r a t i o n s a n d M a i n t e n a n c e E n g i n e e r 2016 MISCELLANEOUS ROADWAY REPAIRS AND OVERLAYS CONTRACT FOR CONSTRUCTION CITY IMPROVEMENT PROJECT NO. 16-01 CONTRACT FOR CONSTRUCTION THIS AGREEMENT, made and entered into as of the 18th day of April, 2016, by and between the City of Lakeville, a municipal corporation under the laws of the State of Minnesota, hereinafter called the “Owner,” and Northwest Asphalt, Inc., hereinafter called the “Contractor.” WITNESSETH: That in consideration of their mutual covenants and agreements as hereinafter set forth, the Owner for itself and the Contractor for itself, its successors, and assigns, covenants and agrees as follows, to wit: 1. The Contractor agrees to furnish all the necessary materials, labor, use of tools, equipment, plant and every other thing necessary to perform the work designated and referred to in this Contract, including all Contractor’s superintendence, and to furnish everything necessary for the completion of the improvement which is the subject of this Contract (except such things as the Owner has specifically agreed to provide, according to the Contract Documents); and agrees under penalty of a public contractor’s corporate surety bond in the amount of Nine Hundred Ninety-Eight Thousand Eight Hundred Forty-One and 97/100 Dollars ($998,841.97) to perform and complete the work shown in the plans and drawings, entitled “2016 Miscellaneous Roadway Repair and Overlays,” prepared by the City of Lakeville and dated February 16, 2016, and to conform in all respects with the provisions and requirements of the General Conditions, Supplementary General Conditions and Specifications for said improvement, which is entitled “2016 Miscellaneous Roadway Repairs and Overlays”. 2. The Contractor agrees that performance shall be in accordance with the terms, requirements and conditions of this instrument, and laws of the State of Minnesota, and the following documents. ADVERTISEMENT FOR BIDS for said 2016 Miscellaneous Roadway Repairs and Overlays for the Owner. PROPOSAL by the Contractor, presented to the Council of the Owner on March 25, 2016, and accepted by the Owner on April 18, 2016. CONTRACT DOCUMENTS for said 2016 Miscellaneous Roadway Repairs and Overlays dated February 16, 2016, referred to in the preceding paragraph of this Agreement and made a part of the aforementioned proposal. PLANS AND DRAWINGS for said 2016 Miscellaneous Roadway Repairs and Overlays as identified in a preceding paragraph of this Contract and which are dated February 16, 2016. ANY ADDENDA to the plans, drawings, general conditions and specifications for said 2016 Miscellaneous Roadway Repairs and Overlays which addenda were prepared by the City of Lakeville. PUBLIC CONTRACTOR’S SURETY BOND in the principal sum of the amount bid. Each and all of the aforementioned Contract Documents are hereby incorporated into this Contract by specific reference and the terms and provisions thereof are and constitute a part of this Contract as though attached hereto or fully set forth herein. 3. The Owner agrees to pay the Contractor for the performance of this Contract and the Contractor agrees to accept in full compensation therefor, the sums set forth within the aforementioned proposal of the Contractor for each unit and each type of unit of work to be performed. It is understood and agreed that the said proposal is for the construction of 2016 Miscellaneous Roadway Repairs and Overlays on a unit price basis in accordance with the said proposal, and that sum of $998,841.97 as set out in said proposal, is the sum of the unit prices, multiplied by the estimated quantities of the respective units of work listed therein. 2016 MISCELLANEOUS ROADWAY REPAIRS AND OVERLAYS CONTRACT FOR CONSTRUCTION CITY IMPROVEMENT PROJECT NO. 16-01 4. This contract may be terminated by the City at any time upon discovery by the City that the prime contractor or subcontractor has submitted a false statement under oath verifying compliance with any of the minimum criteria set forth in Minn.
