The Pledge of Allegiance to the flag was given. Members Present: Mayor Little, Council Members Davis, Swecker, Anderson and LaBeau Staff Present: Justin Miller, City Administrator; Roger Knutson, City Attorney; Jeff Long, Police Chief; Chris Petree, Public Works Director; David Olson, Community & Economic Development Director; Jerilyn Erickson, Finance Director; John Hennen, Parks & Recreation Director; Daryl Morey, Planning Director; Allyn Kuennen, Assistant City Administrator; Charlene Friedges, City Clerk 3. Citizen Comments: None 4. Additional Agenda Information: None 5. Presentations/Introductions • Mr. Olson introduced the Spotlight on Business, Sonnet Montessori, located at 19955 Idealic Avenue. Owner and director Ann Thompson, along with teacher Carolyn Regan, spoke on behalf of Sonnet Montessori. • Jay Young of the Lakeville Rotary Club presented two donations, a check in the amount of $2,500 for the puppet wagon and teen beach bash and a check in the amount of $8,000 for the new Valley Lake Park pollinator garden. • Kevin McCarney asked the City Council to proclaim May 5, 2016 National Day of Prayer in Lakeville. Council Member Davis read the proclamation. • Chris Petree presented the Public Works first quarter report. 6. Consent Agenda Council members removed Item 6d from the consent agenda. Motion was made by Anderson, seconded by Swecker, to approve the consent agenda items as follows: a. Claims for payment b. Minutes of the March 21, 2016 City Council meeting City Council Meeting Minutes — April 4, 2016 Page 2 c. Minutes of the March 28, 2016 Council work session d. (Removed from consent agenda) e. Ordinance No. 960 rezoning property located at 20405 Holyoke Avenue from RS -3 to RS - CBD f. Resolution No. 16-40 appointing the City's official depositories g. Professional Services Agreement with Blue Water Science for lake management h. Joint Powers Agreement with Vermillion River Watershed Joint Powers Organization and Agreement with Wenck Associates for professional services for the South Creek restoration project i. Joint Powers Agreement with Vermillion River Watershed Joint Powers Organization for Valley Lake Park pollinator garden project j. Award contract to Northdale Construction Co., Inc. for the Lift Station No. 6 rehabilitation, City Project No. 15-16 k. Set a Council work session to be held at 7:00 p.m. on April 11, 2016 1. Agreement for professional services with Oertel Architects, Ltd. for a space needs study at the Central Maintenance Facility Voice vote was taken on the motion. Ayes - unanimous Item 6d Motion was made by Swecker, seconded by Anderson, to approve Resolution No. 16-39 authorizing the acquisition of real property located at 9210 - 202°d Street W. Roll call was taken on the motion. Ayes - Davis, Little, Swecker, Anderson; LaBeau abstained due to a conflict of interest. 7. Warweg Property Street Vacation Mayor Little opened the public hearing to consider the vacation of a right-of-way easement in the Lenihan's Lots Antlers's Park. Mr. Kuennen stated this right-of-way easement must be vacated prior to recording of the Warweg Addition final plat and acquisition of Mr. Warweg's property by the City. City Council Meeting Minutes - April 4, 2016 There were no questions or comments. Motion as made by Davis, seconded by Anderson to close the public hearing. Voice vote was taken on the motion. Ayes - unanimous Motion was made by Anderson, seconded by LaBeau, to approve Resolution No. 16-41 vacating a public street right-of-way in Lenihan's Lots Antler's Park. Interim Use Permit for Domesticated Wild Foxes Mikayla Raines requested Council approval of an interim use permit to allow the keeping of up to three foxes on 10 acres of property located at 12110 - 2101 Street W. Sandy Raines provided copies of several letters and emails in support of her daughter's request. Mr. Morey explained that the property is zoned Rural/Agricultural District, which allows the keeping of horses and other farm animals. Foxes are considered domesticated wild animals and are not allowed except by interim use permit. The interim use permit process allows the City to measure and mitigate potential impacts posed by the request, as well as to adopt reasonable stipulations and a sunset date on the use, which is not an option available with permitted or conditional uses. He stated the foxes on Ms. Raines' property are housed in a kennel attached to a separate accessory structure, which meets the performance standards of the zoning ordinance. A DNR permit is contingent upon City Council approval of the interim use permit. Staff recommends approval of an interim use permit to allow the keeping of up to three foxes on this 10 -acre parcel of property subject to seven stipulations. As requested by the City Council at its March 21St meeting, the Planning Commission will continue to discuss the provisions in the zoning ordinance regarding the keeping of animals not defined as farm animals or household pets. The Planning Commission will also review the current definition of household pets. Motion was made by Davis, seconded by Anderson, to approve findings of fact and an interim use permit for Mikayla Raines to allow the keeping of up to three foxes at 12110 - 210th St. W.
