NORTH TRAIL ELEMENTARY SCHOOL
Proposed Action Staff recommends adoption of the following motion: Move to approve the North Trail Elementary School conditional use permit amendment and adopt the findings of fact.
Overview ISD #192 representatives are requesting a conditional use permit amendment to allow a 2,800 square foot expansion to North Trail Elementary School located at 5580 – 170th Street. The Planning Commission held a public hearing at it’s May 21, 2016 meeting. The Planning Commission recommended unanimous approval of the conditional use permit amendment subject to four stipulations. There was no public comment at the public hearing. Staff also recommends approval of the conditional use permit amendment.
Primary Issues to Consider Can the existing site accommodate the proposed building addition and parking needs? The
proposed building addition meets all setback and other Zoning Ordinance requirements,
including parking.

AMENDMENT TO CONDITIONAL USE PERMIT NO. 96-03
1. Permit. Subject to the terms and conditions set forth herein, the City of Lakeville approves a Conditional Use Permit Amendment for ISD #192 to allow an addition to North Trail Elementary School, located at 5580 – 170th Street. 2. Property. The permit is for the following described property located in the City of Lakeville, Dakota County, Minnesota:
Lot 1, Block 1, Farmington Elementary Addition 3. Conditions. The permit is issued subject to the following conditions: a) The site plan and building addition shall be developed in accordance with the plans approved by the City Council. b) A building permit is required prior to commencing construction. c) The addition is subject to review by the Fire Marshal. d) All lighting shall meet the requirements of the Zoning Ordinance. 4. Termination of Permit. The City may revoke the permit following a public hearing for violation of the terms of the permit. 5. Lapse. If within one year of the issuance of this permit the buildings addition has not commenced, this permit shall lapse. 6. Criminal Penalty. Violation of the terms of this conditional use permit amendment is a criminal misdemeanor.

NORTH TRAIL ELEMENTARY SCHOOL CONDITIONAL USE PERMIT
AMENDMENT
FINDINGS OF FACT AND DECISION On April 21, 2016 the Lakeville Planning Commission met at it’s regularly scheduled meeting to consider the application of ISD #192 for an amendment to Conditional Use Permit No. 96-03 to allow a building addition at North Trail Elementary School, 5580 – 170th Street. The Planning Commission conducted a public hearing on the proposed conditional use permit amendment preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. The City Council hereby adopts the following:
FINDINGS OF FACT 1. The property is zoned RS-2, Single Family Residential District. 2. The property is located in Planning District No. 11, Northeast Lakeville, and is classified as Public and Quasi-Public on the Comprehensive Land Use Plan. 3. The legal description of the property is: Lot 1, Block 1, Farmington Elementary Addition 4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are:
a) The proposed action has been considered in relation to the specific
policies and provisions of and has been found to be consistent with the
Official City Comprehensive Plan.
The proposed expansion of the elementary school is consistent with the policies and
provisions of Planning District 11 of the Comprehensive Land Use Plan.
b) The proposed use is or will be compatible with future land uses of the
area.
The proposed expansion of the elementary school is compatible with existing
land uses in the area.

c) The proposed use conforms with all performance standards contained in
the Zoning Ordinance and the City Code.
The elementary school is an existing use on the property. The proposed expansion
will conform to all performance standards set forth in the Zoning Ordinance
given compliance with the approved conditional use permit amendment.
d) The proposed use can be accommodated with existing public
services and will not overburden the City’s service capacity.
The proposed expansion to the elementary school use can be adequately served with
existing public services.
e) Traffic generation by the proposed use is within capabilities of
streets serving the property.
Traffic generation will not be effected by the proposed expansion to the elementary
school. The existing streets (170th Street and Pilot Knob Road (CSAH 31) that serve the
property can accommodate the proposed expansion. 5. The planning report dated April 15, 2016 prepared by Frank Dempsey, Associate Planner is incorporated herein.
DECISION The City Council approves the North Trail Elementary School conditional use permit amendment in the form attached hereto.

INTRODUCTION Representatives of ISD #192 are requesting a conditional use permit amendment to allow an expansion to the North Trail Elementary School building, located at 5580 – 170th Street. The proposed addition will include a two classroom, 2,800 square foot addition on the northeast side of the existing 111,667 square foot building. The subject property is zoned RS-2, Single Family Residential District. Section 11-51-7D of the Zoning Ordinance allows public elementary schools in the RS-2 District by conditional use permit.

SITE ANALYSIS The proposed 2,800 square foot expansion to the north side of the existing elementary school building will be over an existing grassy area facing the parking lot. The project includes the construction of two new classrooms and an extension of the connecting hallway. The proposed expansion was reviewed for conformance with Zoning Ordinance performance standards as follows:
Surrounding Land Uses and Zoning North –170th Street South – North Creek Manufactured Home Park (RSMH) East – Pilot Knob Road (CSAH 31) West –Single Family Homes (RS-3)
Building Setbacks. The existing building meets all setback requirements of the RS-2 District: Front – 30 feet Side – 15 feet, 30 feet on the side yard abutting a public right of way Rear – 30 feet The proposed building addition will have the following setbacks: Front (north) – 505 feet Side (east) –207 feet
Building Height. The building addition is a single story and 17 feet in height to match the existing building and will not exceed the maximum building height of 35 feet allowed in the RS-3 District.
Floor Plan. The floor plan for the addition will include two 1,300 square foot classrooms and 200 square feet of hallway space to accommodate the new all-day Kindergarten program.
Access and Circulation. The property access will remain unaffected by the proposed addition. The site is primarily accessed via two driveways to 170th Street. One driveway serves the teacher and visitor parking lot. The west driveway serves as the bus access to the south and west sides of the building.
Parking. According to ISD 192, the building has a capacity of 756 students. There are currently 640 students enrolled. The proposed classroom addition will not increase the number of students or the number of employees in the building. The Zoning Ordinance requires one parking space per seven students which equals 108 parking spaces at a ratio of one space per each seven students based on a building capacity of 756 students. The property currently has 201 parking spaces which greatly exceeds Zoning Ordinance requirements.

Building Elevations and Exterior Building Materials. The proposed building addition will be sided with brick to match the existing building and will include three windows and an exit door. The proposed building materials meet the requirements for an institutional use in the RS-2 District.
Mechanical Equipment. No additional mechanical equipment is proposed with the building addition.
Lighting. Exterior sconce lights are proposed on building exterior. One is proposed on the north wall, one each are proposed on the west and east walls above the exit doors, and one is proposed above the corridor exit door. Lighting shall be down-cast type only.
RECOMMENDATION Planning Department staff recommends approval of the North Trail Elementary School conditional use permit amendment subject to the following stipulations: 1. The site plan and building addition shall be developed in accordance with the plans approved by the City Council. 2. A building permit is required prior to commencing construction. 3. The addition is subject to review by the Fire Marshal. 4. All lighting shall meet the requirements of the Zoning Ordinance.
