ON-SALE AND SUNDAY LIQUOR LICENSE 3.2% OFF-SALE MALT LIQUOR LICENSE Proposed Action Staff recommends adoption of the following motion: Move to grant an on-sale and Sunday liquor license and an off-sale 3.2% malt liquor license to Hy-Vee, Inc. Overview Hy-Vee, Inc. is an employee-owned chain of 240 supermarkets located throughout the Midwestern United States. No one person owns five percent or more of the company. Hy-Vee plans to open a full service restaurant in its grocery store located at 16150 Pilot Knob Road and has applied for an on-sale and Sunday liquor license for the restaurant. Hy-Vee Market Grille has indoor seating for 154 guests and includes a 38-seat outdoor patio. Alcohol will be sold in the Market Grille and may be consumed only in the Market Grille and patio area. The Market Grille is divided from the store by a glass wall and doors. There is also an entrance/exit from the parking lot. Hours of operation will be 6 a.m. to 10 p.m. Hy-Vee has also applied for an off-sale 3.2% malt liquor license for its convenience store located at 16144 Pilot Knob Road. In accordance with Section 3-1-6-4 of the City Code, the licenses shall not be issued until the buildings are ready for occupancy. Hy-Vee plans to open both the convenience store and the restaurant on June 21st. Primary Issues to Consider • Does the applicant meet all requirements for the licenses requested? The patio application and site plan meet the requirements set forth in Section 3-1-8-14 of the City Code. Because the outdoor patio is located more than 150 feet from a residential zoning district, there is no restriction on the hours for serving food or alcohol on the patio. Hy-Vee, Inc.
