HomeMy WebLinkAboutItem 06.fMay 16, 2016 Item No. AGREEMENT WITH KEVIN CASEY, LLC FOR THE CONSTRUCTION OF RITTER FARM DOG PARK Proposed Action Staff recommends adoption of the following motion: Move to approve agreement with Kevin Casey, LLC. for the construction of Ritter Farm Dog Park. Overview Over tthe past few months, Staff has worked with .':TSB & Associates, Inc. on the preparation of plans and specifications for the construction of the Ritter Farm Dog Park. The dog park will consist of an all -breed area approximately 4 acres in size and a small -breed dog area 1 acre in size along with an aggregate parking lot. A well will also be installed on site that will be constructed under a separate contract. A total of six competitive bids were received for the project, three of which were below the engineers estimate. The bids ranged from a low of $78,420 to a high of 97,570. The low bid was submitted by Kevin Casey, LLC. At this time, Staff is recommending the Mayor and City Council approve an agreement with Kevin Casey, LLC to construct the Ritter Farm dog park at a cost of $78,420. The dog park is planned to be completed by August 1. WITNESSETH: That in consideration of their mutual covenants and agreements as hereinafter set forth, the Owner for Itself and the Contractor for Itself, its successors, and assigns, covenants and agrees as follows, to wit: 1. The Contractor agrees to furnish all the necessary materials, labor, use of tools, equipment, plant and every other thing necessary to perform the work designated and referred to In this Contract, including all Contractor's superintendence, and to furnish everything necessary for the completion of the Improvement which is the subject of this Contract (except such things as the Owner has specifically agreed to provide, according to the Contract Documents); and agrees under penalty of a public contractor's corporate surety bond in the amount of Seventy Eight Thousand Four Hundred Twenty and 001100 Dollars ($78.420.00) to perform and complete the work shown in the plans and drawings, entitled °Ritter Farm Dog Park Project" prepared by WSB & Associates, Inc. and dated April 1, 2016, and to conform in all respects with the provisions and requirements of the General Conditions, Supplementary General Conditions and Specifications for said improvement, which is entitled "Ritter Farm Dog Park Project" for the Owner prepared by WSB & Associates, Inc., dated April 1, 2016. 2. The Contractor agrees that performance shall be in accordance with the terms, requirements and conditions of this instrument, and laws of the State of Minnesota, and the following documents. ADVERTISEMENT FOR BIDS for said Ritter Farm Dog Park Project for the Owner. PROPOSAL by the Contractor, presented to the Council of the Owner on MAY 16, 2016, and accepted by the Owner on MAY 16, 2016. CONTRACT DOCUMENTS for said Ritter Farm Dog Park Project April 1, 2016, referred to In the preceding paragraph of this Agreement and made a part of the aforementioned proposal. PLANS AND DRAWINGS for said Ritter Farm Dog Park Project as identified in a preceding paragraph of this Contract and which are dated April 1, 2016. ANY ADDENDA to the plans, drawings, general conditions and specifications for said Summedyn Park Development Project which addenda were prepared by WSB & Associates, Inc. PUBLIC CONTRACTOR'S PERFORMANCE & PAYMENT BONDS In the principal sum of the amount bid. Within ten (10) calendar days after the execution of this Contract and before any work or services are rendered, the Contractor shall furnish a performance bond and payment bond each In the amount of the Total Bid insuring the faithful performance of the Contract and payment of all obligations arising thereunder pursuant to Section 674.26 of the Minnesota Statutes. If the bonds are not submitted within the time frame, then the Contract shall be considered void and the City may elect to collect the bid bonds or security as liquidated damages. Each and all of the aforementioned Contract Documents are hereby incorporated Into this Contract by specific reference and the terms and provisions thereof are and constitute a part of this Contract as though attached hereto or fully set forth herein. 3. The Owner agrees to pay the Contractor for the performance of this Contract and the Contractor agrees to accept in full compensation therefor, the sums set forth within the aforementioned proposal of the Contractor for each unit and each type of unit of work to be performed. It Is understood and agreed that the said proposal Is for the construction of said Ritter Farm Dog Park Project on a unit price basis in accordance with the said proposal, and that sum of RITTER FARM DOG PARK PROJECT CFC CITY OF LAKEVILLE PROJECT NO. 16-10 WSB PROJECT NO. 2680420 PAGE 1 $78,420.00_ as set out in said proposal, Is the sum of the unit prices, multiplied by the estimated quantities of the respective units of work listed therein. WSB recommends that the City of Lakeville execute a contract with Kevin Casey, LLC for the Ritter Farm Dog Park for the Base Bid of $78,420. We also recommend setting aside a construction contingency of 10% of the construction budget for any additional project unknowns.
