HomeMy WebLinkAboutItem 06.s Date: Item No. ACCEPTING DONATION FOR EXPLOSIVE BREACHING DOOR FABRICATION Proposed Action Staff recommends adoption of the following motion: Move to accept a donation of labor from Joey Miller. Overview Following Dakota County MAAG’s purchase of steel framing material, Joey Miller offered to fabricate an explosive breaching frame for the Dakota County MAAG Team. The adjustable door frame is multi-use and will allow training for explosive, mechanical and shotgun breaching. A breaching frame can cost several thousand dollars if purchased from a national distributor. Mr. Miller’s labor and fabrication is valued at approximately $3,000. Primary Issues to Consider • The Lakeville Police Department and Dakota County MAAG Team thank Mr. Miller. His continued support to both units, and to our community, is appreciated. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakeville that the donation of labor from Joey Miller is hereby accepted; and BE IT FURTHER RESOVED that the City of Lakeville sincerely thanks Joey Miller for the generous donation. DATED this 16 day of May, 2016 CITY OF LAKEVILLE BY:______________________________ Matt Little, Mayor ATTEST: _________________________________ Charlene Friedges, City Clerk 186573v1 DONATION AGREEMENT AGREEMENT made this 16th day of May, 2016 by and between the CITY OF LAKEVILLE, a Minnesota municipal corporation (“City) and JOEY MILLER ("Miller"), fabricated a free standing metal door frame (“Door Frame”) that the City intends to use to breach using hollow core wood doors, solid core wood doors and metal doors, using explosives or mechanical force to simulate breaching a residential or commercial building for law enforcement training purposes. 1. Donation. Miller donates to the City and the City accepts the donation of the Door Frame, subject to the terms of this agreement, in an "AS-IS" condition and with warranties only with respect to title. 2. Indemnification. Subject to the limitations and immunities in Minnesota Statutes Chapter 466, City agrees to indemnify and hold harmless Miller from and against all claims, causes of action, lability, damages and judgments, of whatever nature arising out of City’s use of the Door Frame and will, at City’s own cost and expense, defend any and all suits or actions which may be brought against Miller.
