The pledge of allegiance to the flag was given. Members Present: Chair Jason Swenson, Vice Chair Brooks Lillehei, Scott Einck, Pat Kaluza, Jason Kelvie, Ex-officio member Nic Stevens Members Absent: Paul Reuvers, Karl Drotning Others Present: Daryl Morey, Planning Director; Kris Jenson, Associate Planner; Matt Decur, Project Engineer; and Penny Brevig, Recording Secretary 3. Approval of the Meeting Minutes The April 21, 2016 Planning Commission meeting minutes were approved as presented. 4. Announcements Mr. Morey stated the following items were distributed at tonight’s meeting: 1. May 4, 2016 Parks, Recreation and Natural Resources Committee draft minutes regarding the Cedar Crossings preliminary plat. Mr. Morey reminded the Planning Commission that the start time of the May 19th Planning Commission meeting has been changed to 5:00 p.m. due to Taste of Lakeville. 5. Cedar Crossings Chair Swenson opened the public hearing to consider the application of Mattamy Homes – Minnesota Division for the following, located west of Cedar Avenue (CSAH 23) and north of 210th Street: A. Preliminary plat of 108 single family residential lots to be known as Cedar Crossings; B. Zoning Map amendment to rezone a portion of the property from RM-2, Medium Density Residential District to RST-2, Single and Two Family Residential District; C. Variance to allow cul-de-sac street length in excess of 600 feet. Daren Laberee from Mattamy Homes presented an overview of their request. Mr. Laberee clarified that Mattamy Homes will not be developing the site. Their goal is to get preliminary plat approval and then sell the property to another developer. He explained the reasoning behind the cul-de-sac street length variance request. Planning Commission Meeting Minutes, May 5, 2016 Page 2 Associate Planner Kris Jenson presented the planning report. Ms. Jenson stated that the Cedar Crossings preliminary plat consists of 108 single family residential lots and four outlots. Along with the preliminary plat, the developer has submitted an application for a Zoning Map amendment and a variance. Ms. Jenson explained that the developer is requesting to rezone a portion of the preliminary plat that is currently zoned RM-2 to RST-2, consistent with the west half of the preliminary plat. All 108 lots in the preliminary plat meet the RS-4 district lot area, width, and depth requirements of the Zoning Ordinance, which is the standard for single family homes in the RST-2 District. The proposed house pads indicate that all 108 lots in the Cedar Crossings preliminary plat meet the RS-4 district building setback requirements. There are four outlots in the Cedar Crossings preliminary plat. Outlots A, B, and C will be deeded to the City and Outlot D will be retained by the developer for future development. Outlot A will be used for a future neighborhood park and Outlots B and C contain a wetland complex that is proposed to be preserved. There is a ghost plat shown on the preliminary plat for possible townhomes on Outlot D and for single family lots on the parcels to the north of Cedar Crossings. Ms. Jenson reviewed the streets that will be included in the plat, which are described in detail in the April 28, 2016 planning and engineering reports. Ms. Jenson reviewed the 206th Street cul-de-sac variance request. Ms. Jenson stated that Planning Department staff recommends approval of the Cedar Crossings preliminary plat, Zoning Map amendment and cul-de-sac length variance, subject to the eight stipulations listed in the April 28, 2016 planning report, and adoption of the Findings of Fact dated May 5, 2016. Chair Swenson opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Kelvie, seconded by Lillehei to close the public hearing at 6:11 p.m. Voice vote was taken on the motion. Ayes – unanimous Chair Swenson asked for comments from the Planning Commission. Discussion points included: • Chair Swenson stated that he is comfortable with the variance request given the layout of the adjacent Linden Ridge preliminary plat, which will be considered at the next Planning Commission meeting. Planning Commission Meeting Minutes, May 5, 2016 Page 3 • Commissioner Kelvie asked why there are no sidewalks proposed for 206th Street. Ms. Jenson indicated that the City does not require sidewalks along cul-de-sac streets. Motion was made by Lillehei, seconded by Kaluza to recommend to City Council approval of the Cedar Crossings preliminary plat, Zoning Map amendment to rezone a portion of the property from RM-2, Medium Density Residential District to RST-2, Single and Two Family Residential District, and variance to allow cul-de-sac street length in excess of 600 feet, and adoption of the Findings of Fact dated May 5, 2016, subject to the following stipulations: 1. The recommendations listed in the Aril 28, 2016 engineering report. 2. The recommendations of the Parks, Recreation and Natural Resources Committee. 3. The developer shall construct five-foot wide concrete sidewalks along one side of Glade Avenue, Gosford Way, and 207th Street and along both sides of 208th Street. 4. If the Linden Ridge development does not move forward, barricades and “Future through street” signs must be placed at the west terminus of 205th Street and 207th Street. A barricade and “Future through street” sign must be placed at the north terminus of Glade Avenue. 5. If the Linden Ridge development does not move forward, a temporary cul-de-sac must be constructed within a temporary cul-de-sac easement at the west terminus of 205th Street and 207th Street. 6. Outlots A, B, and C shall be deeded to the City with the final plat. 7. Any subdivision identification sign must be monument style, not more than 10 feet in height and 100 square feet in area, and must be maintenance free or located within an outlot owned and maintained by an HOA. A sign permit must be issued by the City prior to the installation of any subdivision identification sign. 8. The following lots must have driveway access from Glade Avenue: Lot 10, Block 1; Lot 10, Block 2; Lot 1, Block 3. Tree saucer mulch to be four inches (4") depth natural single-shred hardwood mulch for trees outside of a plant bed. Install per tree planting detail. 2. Refer to civil plan sheets for grading, drainage, site dimensions, survey, tree removal, proposed utilities & erosion control. 3. All plant material shall comply with the latest edition of the American Standard for Nursery, American Association of Nurserymen. Unless noted otherwise, deciduous shrubs shall have at least 5 canes at the specified shrub height. Plant material shall be delivered as specified. 4. Plan takes precedence over plant schedule if discrepancies in quantities exist. 5. All proposed plants shall be located and staked as shown. 6. Adjustment in location of proposed plant material may be needed in field. Should an adjustment be required, the client will provide field approval. Significant changes may require city review and approval. 7. The project landscape contractor shall be held responsible for watering and properly handling all plant materials brought on the site both before and after installation. Schedule plant deliveries to coincide with expected installation time within 36 hours. 8. All plant materials shall be fertilized upon installation as specified. 9. The landscape contractor shall provide the owner with a watering schedule appropriate to the project site conditions and to plant material growth requirements. 10. If the landscape contractor is concerned or perceives any deficiencies in the plant selections, soil conditions, drainage or any other site condition that might negatively affect plant establishment, survival or guarantee, they must bring these deficiencies to the attention of the landscape architect & client prior to bid submission. Plant bed drainage concerns during plant installation shall be brought to the attention of the Owner and General Contractor immediately. 11. Contractor shall establish to his/ her satisfaction that soil and compaction conditions are adequate to allow for proper drainage at and around the building site. 12. Contractor is responsible for ongoing maintenance of all newly installed material until time of owner acceptance. Any acts of vandalism or damage which may occur prior to owner acceptance shall be the responsibility of the contractor. Contractor shall provide the owner with a maintenance program including, but not limited to, pruning, fertilization and disease/pest control. 13. The contractor shall guarantee newly planted material through one calendar year from the date of written owner acceptance. Plants that exhibit more than 10% die-back damage shall be replaced at no additional cost to the owner. The contractor shall also provide adequate tree wrap and deer/rodent protection measures for the plantings during the warranty period. 14. This layout plan constitutes our understanding of the landscape requirements listed in the ordinance. Changes and modifications may be requested by the city based on applicant information, public input, council decisions, etc. 15. The landscape contractor shall be responsible for obtaining any permits and coordinating inspections as required throughout the work process. 16. Plant size & species substitutions must be approved in writing prior to acceptance in the field. 17. The landscape contractor shall furnish an Irrigation Layout Plan for head-to-head coverage of all tree, turf and shrub planting areas. Use commercial-grade irrigation equipment and provide product cut-sheets and (4) copies of the proposed layout plan to the landscape architect for review and approval. Coordinate irrigation connection point, controller, back-flow and valve locations with the architect & general contractor. Irrigation system shall be zoned such that plants over building structure are separate. 18. All edger shall be professional grade black steel edger, 1/8" Thick, 12' straight lengths. Anchor every 18" on-center (minimum). Submit sample. 19. Landscape Contractor is responsible for coordination with the General Contractor, to protect the new improvements on and off-site during landscape work activities. Report any damage to the General Contractor immediately. 20. Unless otherwise noted/indicated, plant beds shall receive 4"depth single-shred hardwood mulch over fabric weed mat, per detail. Submit mulch sample for Owner approval. Do not install weed mat under perennials, with the exception of ornamental grasses. 21 All planting, seeding, and sodded areas shall be prepared prior to installation activities with a harley power box rake or equal to provide a firm planting bed free of stones, sticks, construction debris, etc. 22. Turf installation activity shall conform to all rules and regulations as established in the MnDOT Seeding Manual, 2014 edition, for turf bed preparation, installation, maintenance, and warranty. 23. The Landscape Contractor shall furnish samples of all landscape materials for approval prior to installation. 24. The Landscape Contractor shall clear and grub the underbrush from within the work limits to remove dead branches, leaves, trash, weeds and foreign materials. Remove trees where noted on the plan, including the stump to 30" below grade. 25. The landscape contractor shall contact Gopher State One Call no less than 48 hours before digging for field utility locations. 26. The landscape contractor shall be responsible for the removal of erosion control measures once vegetation has been established to the satisfaction of the municipal staff. This includes silt curtain fencing and sediment logs placed in the landscape. 27. The landscape contractor shall be responsible for visiting the site to become familiar with the conditions prior to bidding and installation. Coordinate with the general contractors on matters such as fine grading, landscaped area conditions, staging areas, irrigation connection to building, etc. 28. See Site and Civil plans for additional information regarding the project. 29. All sub-cut areas of the site that are designated on the site plan as open space for landscape shall have no less than 6" of imported, pulverized topsoil. Slope away from building. 30. Landscape contractor must prove the open sub-grade of all planting areas after their excavation is capable of infiltrating a minimum requirement of 1/4-inch of water per hour prior to installation of plant materials, topsoil, irrigation, weed mat, and mulch. Planting areas not capable of meeting this requirement shall have 4" diameter X 48" depth holes augured every 36" on-center and filled with MnDOT Free-Draining Coarse Filter Aggregate. Re-test sub-grade percolation for compliance to infiltration minimum requirement. 31. Landscape contractor shall coordinate tree removal activities and ensure all trees designated for removal are gone before start of landscape installation. Grind stump to 30" below grade and back-fill with topsoil. 32. Landscape contractor shall include in their bid to remove any existing shrubs, sod, edger, fabric, and edger that interferes with new improvements shown in this package. 33. The plat is adjacent to CSAH 23, and is therefore subject to the Dakota County Contiguous Plat Ordinance. The proposed plat includes a residential development with approximately 110 lots. The right-of-way needs are 75 feet of half right of way for a 4-lane roadway. Restricted access should be shown along all of CSAH 23 except for one access opening across at 205th Street West. A quit claim deed to Dakota County for restricted access is required at the time of recording the plat mylars. Turns lanes will be required on CSAH 23 for 205th Street West. The Plat Commission noted that the existing church access that will be moved to 205th Street West is very close to the CSAH 23 right of way. The Plat Commission is recommending this access be moved westerly to meet the City’s minimum setback requirements of 90 feet. It was noted by the Plat Commission that the “EA Update for the Cedar Avenue Corridor Transitway Study” identified 205th Street West as a future restricted access and Gemini Trail as a full access. The Plat Commission has approved the preliminary plat provided that the described conditions are met. The Ordinance requires submittal of a final plat for review by the Plat Commission before a recommendation is made to the County Board of Commissioners. Traffic volumes on CSAH 23 are 12,100 ADT and are anticipated to be 23,000 ADT by the year 2030. These traffic volumes indicate that current Minnesota noise standards for residential units could be exceeded for the proposed plat. Residential developments along County highways commonly result in noise complaints. In order for noise levels from the highway to meet acceptable levels for adjacent residential units, substantial building setbacks, buffer areas, and other noise mitigation elements should be incorporated into this development. No work shall commence in the County right of way until a permit is obtained from the County Transportation Department and no permit will be issued until the plat has been filed with the County Recorder’s Office. The Plat Commission does not review or approve the actual engineering design of proposed accesses or other improvements to be made in the right of way. Nothing herein is intended to restrict or limit Dakota County’s rights with regards to Dakota County rights of way or property. The Plat Commission highly recommends early contact with the Transportation Department to discuss the permitting process which reviews the design and may require construction of highway improvements, including, but not limited to, turn lanes, drainage features, limitations on intersecting street widths, medians, etc. Please contact Gordon McConnell regarding permitting questions at (952) 891-7115 or Todd Tollefson regarding Plat Commission or Plat Ordinance questions at (952) 891-7070.
