Staff recommends adoption of the following motion: Move to approve performance agreements
with the following pe , rmers,for the Lakeville Area Arts Center.

Passage of this motion will result in confirming the performers needed to offer programs advertised
in the Park and Recreation brochures and the LAACplaybiIl.
The Lakeville Area Arts Center offers activities to the public as advertised in the Lakeville Parks
and Recreation Brochures and the LAAC Playbill. Performers are contracted for concerts as
advertised.

The Schiffelly Puppets will perform on July 7, 2016 with a show time of 10:30am.
*The cost of the show is $350.00
*Performance fee is payable upon immediate completion of the show. A late fee of
$10.00 per day will be imposed unless prior arrangements are made.
*Please have all checks made out to Jim Schiffman
*Performers will arrive 20 - 30 minutes prior to scheduled show time.
*Liability Insurance must be carried by the hosting organization.
*Schiffelly Puppets agrees that this contract is non -cancelable with the
exception of proven detention due to sickness, accidents, acts of Cod and
other emergencies beyond our control

Agreement between the City of Lakeville
and
Rela#3 tv the Band
Relativity the Band will perform a three hour show with 2 ten minute intermissions beginning at
6:00 p.m. on Thursday, October 6, 2416 at the Lakeville Area Arts Center, 20965 Holyoke
Avenue, in Lakeville.
For the performance, Relativity the Band will receive a $400.00 guarantee.
Both Relativity the Band and the Lakeville Area Arta Center staff will work to promote the
show. Relativity the Band will announce the event on its website and use its data base of
contacts and fans to make the show known. The Lakeville Area Arts Center will promote in its
2016-2017 playbill, media releases, marquee, newsletters, and using other available resources.
The Lakeville Area Arts Center will print and sell tickets through its box office and ticket
outlets.
By signing at the bottom of this letter of agreement, Lakeville Area Arts Center agrees to the
following conditions:
1) Performance Space
Stage will be clear of furniture, props, scenery, etc. There will be general stage lighting, the
sound booth and the piano will be available.
2) Liability Insurance
The City of Lakeville carries the standard liability insurance for audiences, staff, and the building
of the Lakeville Area Arts Ccnter.
3) Payment
Payment of the $400.00 guarantee will be made immediately following the performance.
In the event of bad weather making travel to a performance unsafe, the decision to cancel shall
be made by the Lakeville Area Arts Center Manager and Relativity the Band. Rescheduling of
the concert will depend on availability of the performance space and Relativity the Band.

DUO PERFORMANCE CONTRACT RIDER
TECHNICAL PROVISIONS:
1. Presenter to provide PA system adequate for venue.
FOH mixing board — 8 channel minimum with reverb effects unit
2 monitor wedges
- 4 boom mics & stands
2. Lighting appropriate for venue/stage.
3. Stage or performance space that's a minimum of 8'x 12.'
4. Artist needs 30 minutes for set-up and sound check prior to doors opening.
MERCHANDISE:
Artist to retain 100% of merch revenue. Artist sells his own merchandise; presenter does not need to
provide personnel.
LODGING & HOSPITALITY:
1. Presenter to provide a secure, lockable dressing room for artist. Please supply a bag of chips (Nacho
Cheese or Cool Ranch Doritos, Fritos or Cheetos) and several bottles of water and diet soda (any
kind of diet soda is fine) in the dressing room.
2. Presenter to provide a healthy lunch or dinner for Artist, depending on the time of the show.
3. Unless otherwise indicated in the Other Terms and Conditions on the contract, Presenter to provide
overnight accommodations of two non-smoking hotel rooms with a Queen or King bed for Artist
(Holiday Inn Express, Hampton Inn, etc. are fine). Hotel should be near the venue, in a safe location.
Motels where the room door Is accessible to the outside and dorm/residence hall rooms are not
acceptable.
OUTDOOR ENGAGEMENTS:
Presenter bears all risk associated with Outdoor Engagements. An Outdoor Event Rider must accompany
contracts where performance location is outside.
CANCELLATION:
Presenter agrees that Artist may cancel the performance(s) hereunder, in Artist's sole discretion, by
providing at least ninety (90) days written notice to Presenter prior to the performance(s) date. In such
event, Artist will return any amounts previously paid by Presenter pursuant to this agreement without
payment or penalty of any sort.

2. PURPOSE. This agreement sets forth the terms and conditions for an engagement in which the Purchaser contracts the
Artist's professional services. it is expressly agreed that G. L. Berg & Associates, Inc. acts herein as Artist's agent whose
role is to facilitate the scheduling and contracting of this date between the Artist and Purchaser. G. L. Berg & Associates,
Inc. is not responsible and assumes no liability for any act of commission or omission on the part of either Artist or
Purchaser.
3. ARTISTS DUTIES. Artist agrees to provide entertainment services and to perform the engagement according to the
terms and conditions as set forth below in paragraph 7. Artist agrees to indemnify, defend and hold G. L. Berg & Associates,
Inc. harmless from and against all claims, costs or liabilities for damage or injury to Artist or the property of Artist during
engagement.
4. ARTISTS WARRANTIES. Artist/leader warrants that the entertainers working this engagement have given him/her the
power to bind them to the terms of this contract.
6. PURCHASER'S DUTIES. Purchaser agrees to contract the Artist for services as entertainer. Purchaser agrees to the
terms and conditions of the engagement and compensation for the Artist as set forth below in paragraph 7. Purchaser
agrees to provide a safe and secure stage/show area.
6. PURCHASER'S WARRANTIES. Purchaser warrants there will be no recording, reproduction or transmission from the
place of engagement without the prior written consent of Artist.
7. TERMS AND CONDITIONS:
(A) Name and place of engagement: Lakeville Area 4Q ggQ11C, Likeville,MN.
B Date; starting and finishing time of engagement: SATURDAY, F9brUarV 4. W01n90-minute to 2 -hour show
to begin at 7:30 p.m.. with intermission.
(C) Artist to be completely set-up by: 6:30p.m.
(D) Type of engagement: Public Ticketed Show. 2016-17 Performance Series "Pre -Valentine's" Theme.
(E) Compensation: Price is $2500.00 complete. No deposit is reguired. The full amount ($2.500.001 is to be made
payable to NEW AGE PRODUCTIONS INC and handed to the Artist immediately following the performance on 21412017.

8. INDEPENDENT CONTRACTOR. Artist is an independent contractor and is not an employee of the Purchaser or G. L.
Berg & Associates, Inc. while rendering services.
10. ACCESS TO ARTIST. G. L. Berg & Associates, Inc. representatives shall have access to the place of engagement
for the purpose of conferring with the Artist.
11. THIS AGREEMENT is subject to proven detention by sickness, accidents, riots, strikes, epidemics, acts of God, or
any other legitimate conditions beyond the Purchaser's or Artists control. NOTE: If it Is an outdoor event, Purchaser
should provide a rain site (or adequate & safe weather protection) as the Artist is to be paid in full even if it is rainy and/or
windy to the point Artist cannot perform at scheduled place (paragraph 7.A). Also, in case of snowstorms, if Artist is
notified of cancellation prior to leaving for the event it will constitute an act of God. If artist travels to the performance site
before learning the date is cancelled the Purchaser is responsible for 100% of payment.
12. BOOK -BACK. Artist and Purchaser agree that future engagements between them shall be booked through
G. L. Berg & Associates for a period of at least 24 months to run from the end of this engagement
13. ARBITRATION. Any disputes whatsoever which arise out of this Agreement or the performance of this agreement
shall be resolved before a mutually agreed upon arbitrator. The arbitrator's decision shall be final and binding upon both
parties. G. L. Berg & Associates shall in noway be liable or responsible for payments or obligations pursuant to this
agreement
14. CANCELLATION CLAUSE. Artist shall be paid in full amount (100%) if this engagement is cancelled by Purchaser
less than 45 days prior to the date. Artist to be paid one half (50%) of contracted amount if agreement is cancelled by
Purchaser more than 45 days prior to the contracted date. Purchaser may also be responsible for out of pocket expenses
including, but not limited to, airfare/transportation, hotel/lodging cancellation costs, etc.
15. RIDER. The following information and attached rider, if any, is part of this contract.
Purchaser to provide lights.
Purchaser and Artist to work together to provide sound; Artist will provide any supplemental sound equipment as needed.
16. ENTIRE AGREEMENT. This agreement shall constitute the entire agreement between the parties and any prior
understanding or representation of any kind preceding the date of this agreement shall not be binding except to the extent
incorporated in this agreement.

Deuces Wild! Dueline Pianos
Deuces Wild! Dueling Pianos will present two concerts on Saturday, February 18, 2017, at the
Lakeville Area Arts Center, 20965 Holyoke Avenue.
• 10:30 load in. LAAC Staff to assist with load in and out.
• Dave and Ted Present: What a Wonderful World at 2:00 p.m.
Deuces Wild! Dueling Pianos at 7:30 p.m.
Both Deuces Wild! and the Lakeville Area Arts Center staff will work to promote the show.
Deuces Wildl will announce the event on their website and use their data base of contacts and
fans to make the show known. The Lakeville Area Arts Center will promote in its 2016-2017
playbill, media releases, marquee, newsletters, and using other available resources.
The Lakeville Area Arts Center will print and sell tickets through its box office and ticket
outlets.
By signing at the bottom of this letter of agreement, Lakeville Area Arts Center agrees to the
following conditions:
1) Performance Space
Stage will be clear of furniture, props, scenery, etc. There will be general stage lighting and a
sound booth tech provided.
2) Liability Insurance
The City of Lakeville carries the standard liability insurance for audiences, staff, and the building
of the Lakeville Area Arts Center.
3) Payment
Deuces Wild! Dueling Pianos will be paid $15.00 per ticket for the 2:00 p.m. performance and
$20.00 per ticket for the 7:30 performance. Since the payment will include walk-up sales on the
day of the performance, the check will be processed during the week following the performance.
In the event of bad weather making travel to a performance unsafe, the decision to cancel shall
be made by the Lakeville Area Arts Center Manager and Deuces Wild!. Rescheduling of the
concert will depend on availability of the performance space and Deuces Wild!.

The Farmer's Daughters
The Farmer's Daughters will perform a three hour show with two 10 minute intermissions
beginning at 6:00 p.m. on Thursday, March 2, 2017 at the Lakeville Area Arts Center, 20965
Holyoke Avenue, in Lakeville.
For the performance, The Farmer's Daughters will receive a $550.00 guarantee.
Both The Farmer's Daughters and the Lakeville Area Arts Center staff will work to promote the
show. The Farmer's Daughters will announce the event on their website and use their data base
of contacts and fans to make the show known. The Lakeville Area Arts Center will promote in
its 2016-2017 playbill, media releases, marquee, newsletters, and using other available resources.
The Lakeville Area Arts Center will print and sell tickets through its box office and ticket
outlets.
By signing at the bottom of this letter of agreement, Lakeville Area Arts Center agrees to the
following conditions:
1) Performance Space

payable to Joleen Lamers.
In the event of bad weather making travel to a performance unsafe, the decision to cancel shall
be made by the Lakeville Area Arts Center Manager and The Farmer's Daughters. Rescheduling
of the concert will depend on availability of the performance space and The Farmer's Daughters.
