ASSIGNMENT OF EASEMENT FOR 195TH STREET TRAIL
Proposed Action
Staff recommends adoption of the following motion: Move to approve Assignment of Easement
for 195th Street trail from the City of Lakeville to Dakota County.
Overview
As part of the Kenrick Avenue and 195th Street trail construction project, the City purchased and
was granted a permanent and temporary easement on the south -side of 195t" Street for trail
construction from Gopher Outside Storage at a cost of $9,067.50. Considering the City and
County anticipate that the constructed trail will become incorporated into a County regional trail
system and as per a joint powers agreement between the County and the City, the County shall
pay the City the sum of $9,067.50 as consideration for the conveyance by City to the County, of
the permanent trail easement.
At this time, staff is recommending the Mayor and City Council approve the Assignment of
Easement whereby the City shall be reimbursed $9,067.50 as per the joint powers agreement
stipulation.

ASSIGNMENT OF EASEMENT
KNOW ALL MEN BY THESE PRESENTS that the undersigned City of Lakeville, a
Minnesota municipal corporation, hereinafter called Grantor, for good and valuable
consideration the receipt of which is hereby acknowledged, hereby assigns, transfers and
conveys to County of Dakota, a political subdivision of the State of Minnesota, hereafter called
Grantee, its successors and assigns, Grantor's interest in that portion of the Grant of Permanent
and Temporary Easements from Gopher Outside Storage, a Minnesota general partnership,
filed for record with the office of the Dakota County Recorder on July 20, 2012 as Document
No. 2881530 described on the attached Exhibit "A."
IN TESTIMONY WHEREOF, this Assignment of Easement has been executed on behalf
of the City of Lakeville this day of , 2016.

That part of the Northeast Quarter (NE1/4) of the Southwest Quarter (SW1/4) of Section 24,
Township 114 North, Range 21 West, Dakota County, Minnesota, lying easterly of the easterly
right of way line of Kenrick Avenue, and westerly of the east 400.00 feet of said Northeast Quarter
(NE1/4) of the Southwest Quarter (SWI/4), and lying northerly of the following described line:
Beginning at the intersection of a line drawn parallel with and distant 33.00 feet south of the north
line of the Southwest Quarter of said Section 24 and the west line of the east 400.0 feet of the
Northeast Quarter (NE1/4) of the Southwest Quarter (SWI/4) of said Section 24; thence South 89
degrees 49 minutes 34 seconds West, assumed bearing along said parallel line, 752.87 feet; thence
South 74 degrees 04 minutes 45 seconds West, 140.06 feet to the easterly right of way line of
Kenrick Avenue and said line there terminating.
EXCEPTING therefrom that portion which lies northerly of the following described line: Beginning
at the intersection of a line drawn parallel with and distant 13.00 feet south of the north line of the
Southwest Quarter of said Section 24 and the west line of the east 400.00 feet of the Northeast
Quarter (NEI/4) of the Southwest Quarter (SWI/4) of said Section 24; thence South 89 degrees 36
minutes 44 seconds West, assumed bearing, 813.88 feet; thence South 81 degrees 27 minutes 55
seconds West, 75.53 feet to the easterly right of way line of Kenrick Avenue and said line there
terminating. (Approximately 18,475 sq. ft.)
