GRANT OF PERMANENT EASEMENT
ST. JOHN’S EVANGELICAL LUTHERAN CHURCH OF LAKEVILLE, MINNESOTA, a
Minnesota nonprofit corporation ("Grantor"), in consideration of One Dollar ($1.00) and other good and
valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does hereby grant unto
the CITY OF LAKEVILLE, a municipal corporation organized under the laws of the State of Minnesota,
the Grantee, hereinafter referred to as the "City", its successors and assigns, forever, a permanent non-
exclusive easement for public drainage and utility purposes over, on, across, under and through the land
situated in the County of Dakota, State of Minnesota, and legally described on the attached Exhibit “A” and
depicted on the attached Exhibit “B” (the "Easement Property").
INCLUDING the rights of the City, its contractors, agents, servants, and assigns, to enter upon the
Easement Property at all reasonable times to construct, reconstruct, inspect, repair, and maintain said public
drainage and utility systems over, across, on, under, and through the easement premises, together with the
right to grade, level, fill, drain, pave, and excavate the Easement Property, and the further right to remove
trees, bushes, undergrowth, and other obstructions interfering with the location, construction, and
maintenance of said public drainage and utility systems.
Grantor is authorized to construct a standard driveway section within the Easement Property, which
driveway shall not include more than 3 inches of bituminous over 6 inches of aggregate. Grantor shall not
construct any structures within the Easement Property, such as retaining walls or buildings. Grantor shall be

EXHIBIT “A”
TO
GRANT OF PERMANENT EASEMENT
A 20.00 foot wide permanent easement for drainage and utility purposes lying over, under and
across Outlot A, ST. JOHN'S FIRST ADDITION, according to the recorded plat thereof, Dakota
County, Minnesota the center line of said 20.00 foot wide easement is described as follows:
Commencing at the northeast corner of Outlot A, BERRES RIDGE 1ST ADDITION according to
the recorded plat thereof, said Dakota County; thence on an assumed bearing of South 00 degrees
51 minutes 26 seconds East along the east line of said Outlot A, a distance of 9.77 feet to the point
of beginning; thence North 64 degrees 50 minutes 43 seconds East a distance of 80.00 feet and
there terminating. The southerly line of said easement shall be prolonged to terminate on said east
line of Outlot A.
