PLANNING COMMISSION MEETING MINUTES
August 18, 2016
Chair Swenson called the meeting to order at 6:00 p.m. in the Council Chambers at City
Hall. The pledge of allegiance to the flag was given.
Members Present: Chair Jason Swenson, Vice Chair Brooks Lillehei, Scott Einck, Karl
Drotning, Pat Kaluza, Elizabeth Bakewicz, Jason Kelvie, Ex-officio member Nic Stevens
Members Absent: Paul Reuvers
Others Present: Daryl Morey, Planning Director; Frank Dempsey, Associate Planner;
Matt Decur, Project Engineer; and Penny Brevig, Recording Secretary
3. Approval of the Meeting Minutes
The July 21, 2016 Planning Commission meeting minutes were approved as
presented.
The July 21, 2016 Planning Commission work session minutes were approved as
presented.
4. Announcements
Mr. Morey stated the following item was distributed at tonight’s meeting:
1. August 17, 2016 Parks, Recreation and Natural Resources Committee draft
motion regarding the Schneidermans Furniture preliminary plat.
Mr. Morey stated that the Planning Commission meetings in September will be held
on the 8th and 22nd.
5. Schneidermans Furniture
Chair Swenson opened the public hearing to consider the application of JAS
Lakeville Properties, LLC for the following, located west of Kenyon Avenue between
Gander Mountain and Celebration Church: A. Preliminary plat of one lot to be known
as Schneidermans Furniture and B. Conditional use permit to allow an exception to
the commercial district exterior building material requirements.
Jerimiah Cunningham, with Opus, John Knutson, Civil Engineer with Loucks
Associates and Ernesto Ruis-Garcia with Opus presented a short overview of their
request, including review of the site plan, grading and drainage, and architectural
design.

Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey
stated that representatives of JAS Lakeville Properties, LLC and Schneidermans
Furniture have submitted preliminary plat and conditional use permit (CUP)
applications and plans for development of one lot on one block totaling 4.8 acres.
The subject property is zoned C-3, General Commercial District.
Mr. Dempsey reviewed the site plan, including access, parking, building elevations,
loading dock, roof-top mechanical equipment screening, and landscaping/screening.
He noted that the developer has revised the landscape plan since the neighborhood
meeting to address concerns raised by a neighboring property owner.
Mr. Dempsey explained that a conditional use permit is required because the
developer is proposing to deviate from the minimum requirements for commercial
exterior building materials. Approximately 30% of the building exterior is not visible
from the public street and the developer is proposing to screen that entire elevation
from view of the residential neighborhood with evergreen trees. The applicant
reasons that the percentage of high quality exterior building materials concentrated
on the front of the building can be reasonably balanced with less visually appealing
materials on a portion of the sides and the entire rear wall. The building is
consistent with the other commercial buildings in the area.
Mr. Dempsey stated that Planning Department staff and the Engineering Division
recommends approval of the Schneidermans Furniture preliminary plat and
conditional use permit and adoption of the Findings of Fact dated August 18, 2016,
subject to the 9 stipulations listed in the August 12, 2016 planning report.
Chair Swenson opened the hearing to the public for comment.
Comments and concerns from the audience:
Norm Nelson, 16800 Kenmore Drive
Mr. Nelson stated that his property runs the entire back wall of the proposed
Schneiderman’s building. He used an analogy of a Lakeville South high school
football game to describe the distance of the proposed building from his rear
property line. His concern was how the proposed evergreen trees will be offset
along his property line. He indicated that the developer is planning to meet with
him on his property to discuss his concerns.
Norbert Rother, 11075 168th Street W.
His concern is the noise and the possible use of noise walls along the freeway.
Kurt Kremer, 11090 168th Street W.
Concerned about the removal of the natural noise barriers (earth and trees).
Also concerned about the noise of the trucks coming into the loading docks.

Motion was made by Lillehei, seconded by Drotning to close the public
hearing at 6:34 p.m.
Voice vote was taken on the motion. Ayes – unanimous
Chair Swenson asked for comments from the Planning Commission. Discussion
points included:
• The noise issues were addressed. The Planning Commission felt the building
will help mitigate freeway noise.
• Project Engineer Matt Decur described the current 172nd Street realignment
project and future improvements in the area of Kenyon Avenue and 162nd
Street (CSAH 46).
• Timing of and types of delivery trucks entering the site.
• Minimum and proposed building setbacks.
• Existing and proposed grades.
• Extent of grading along the back of the property line and on the Celebration
Church property.
• Site drainage.
• Deferred parking.
Motion was made by Lillehei, seconded by Drotning to recommend to City
Council approval of the Schneidermans Furniture preliminary plat of one lot and
conditional use permit to allow an exception to the commercial district exterior
building material requirements, and adoption of the Findings of Fact dated August
18, 2016, subject to the following stipulations:
1. Compliance with the stipulations listed in the August 12, 2016 engineering report.
2. Implementation of the recommendations of the Parks, Recreation and Natural
Resources Committee.
3. The site development and building exterior shall be developed in compliance with
the plans approved by the City Council.
4. Landscaping shall be installed according to the landscape plan approved by the
City Council. A financial security shall be submitted with the final plat to
guarantee installation of the landscaping. The landscape plan must be amended
to increase landscape screening by including a staggered row of evergreen trees
for the property adjacent to the loading dock.
5. All signs shall comply with Zoning Ordinance requirements. A sign permit must
be issued by the City prior to the installation of any signs.
6. The site plan must be revised to provide the correct number of required and
proposed deferred parking spaces. A minimum of three additional deferred
parking spaces must be shown on the site plan prior to staff consideration of the
parking deferment application. A parking deferment application shall be
submitted prior to issuance of a building permit.
7. Parking lot and building exterior lighting shall be down-cast cut-off type fixtures
only. Tilt-up light fixtures or fixtures that glare onto adjacent properties are not

permitted. A lighting and photometric plan shall be submitted with the building
permit application.
8. All building materials shall be integral colored and shall not be painted.
9. Retaining walls shall not be constructed in a drainage and utility easement.
